Decree no. 144, March 13th, 2015.

Art. 4 . Determine that from nine (09) months from the date of publication of this Regulation, LED
lamps with integrated device to the base should be manufactured and imported, only in accordance
with the requirements approved herein and duly registered in the Inmetro.

Single paragraph. From fifteen (15) months from the date of publication of this Regulation,
LED lamps with integrated device to the base, should be sold in the domestic market by
manufacturers and importers only in accordance with the requirements approved herein and duly
registered in Inmetro.

Art. 5. Determine that from 24 (twenty four) months from the date of publication of this
Regulation, the LED lamps with integrated device to the base, will be marketed by wholesalers and
retailers in the domestic market only in accordance with the requirements approved herein and
properly recorded in Inmetro.

Single paragraph. The determination contained in this article shall not apply to manufacturers
and importers, who must observe the deadlines set in the previous article.

Art. 6. Determine that from thirty (30) months from the date of publication of this Regulation,
the LED lamps with integrated device to the base, will be marketed by wholesalers and retailers,
registered as Micro and Small Businesses - MPE in the domestic market only accordance with the
requirements approved herein and duly registered in the Inmetro.

Art. 7. Aware that LED lamps with integrated device to the base shall display, in the physical
point of sale or in the website of the responsible for the brand, clearly visible to the consumer, the
National Energy Conservation Label - ENCE.

Art. 8. Determine that the enforcement of the provisions of this Ordinance, throughout the
national territory, will be in charge of Inmetro and public bodies linked to it by delegation
agreement.

Single paragraph. The inspection shall comply with the deadlines set out in Articles 4. 5 and 6
of this Ordinance.

Art. 9. This Ordinance shall enter into force on the date of its publication in the Official
Gazette.

REQUIREMENTS FOR EVALUATION PROGRAM FOR LED


LAMPS WITH BUILT-IN DEVICE INTEGRATED TO THE BASE

1 PURPOSE
Establish criteria for the Conformity Evaluation Program for LED Lamps with Built-In Device
Integrated to the Base, through certification, focusing on performance, electrical safety and
electromagnetic compatibility, as evidenced by the National Energy Conservation Label - ENCE,
meeting the requirements of the Quality Technical Regulation for the object and the Brazilian
Labeling Program - PBE.

1.1. SCOPE OF APPLICATION


1.1.1 This requirements apply to LED lamps with Built-In Device Integrated to the Base o r m a d e
i n on e p i e c e , n o n - d e t a c h a b l e , m a d e f o r o p e r a t i o n i n A C d i s t r i b u t i o n n e t w o r k
o f 6 0 Hz, for n om i n a l vo l t a ge of 1 27 V a nd/ o r 22 0V , or D C c ur r ent i n an y v ol t a ge
r an ge .

1.1.2 Are excluded from this requirements the LED lamps with:

- Colored LED, colored lens or that emit colored light;

- RGB, that have colorful and decorative case, and that emit colored light;

- LED lamps with built-in control device that purposely emit colored light;

- OLED (Organic Light Emitting Diode);

1.2. GROUPING FOR CERTIFICATION

1.2.1 For the certification, this RAC applies the concept of Family.

1.2.2 The certification of LED lamps with built-in device integrated to the base must be made for all
families, as defined in the subitem 4.2 from this RAC.

2 ABBREVIATIONS
This RAC applies the following abbreviations, complemented by the abbreviations contained in the
additional documents mentioned in the item 3 from this RAC.

4 DEFINITIONS
For this RAC, are adopted the following definitions.

4.1. ENCE
Model of label for certification identification. It shows to the customers all the technical
information and energetic efficiency of the product.

4.2. Family
Set of models manufactured in the same plant or factory, whose functional, mechanical and
electrical construction principles are grouped at the same time as the following requirements
and may have different nominal power ratings.

- Same LED technology (Ex: dual in line, SMD, COB, S-COB, high power, mid power
and others);
- Same declared life (nominal);
- Same type of lamp, as some models contained in the Table1 and anyother
dimensional shape.

Note 1: The characteristic design of each type of bulb constant in Table 1 presented in Appendix C
of the RTQ and any other bulb shapes are cover by the Ordinance.

Note 2: All the lamps not classified in the shapes indicated in Table 1 must follow the parameters as
Omnidirectional.

Note 3: Lamps with G4 or G9 base, regardless of their shape or dimension, classify as Decorative.

Note 4: The dimensional patterns of the Omnidirectional types (non-directional) may also be applied
to lamps classified as directional or semi-directional, therefore these lamps must fit in the
requirements described in section 6.7.1 (directional lamps) or 6.7.3 (semi-directional lamps) of the
RTQ.

4.3 Model
Name or code that identifies the product. Designation or single brand.

5. MECHANISM FOR CONFORMITY EVALUATION


The Mechanism for Conformity Assessment used by this RAC is the certification, focusing on energy
efficiency and safety. The National Label of Energy Conservation (ENCE) evidences the conformity
of the product.

6. STAGES FOR CONFORMITY EVALUATION

6.1 Definition of the Certification Models


This RAC establishes two different certification models, and the supplier must choose one of the
following specified models:
a) Model 5 - Type Test, evaluation and approval of the manufacturer's management systems, and
monitoring through audits on the manufacturer and test on samples taken in commerce;
b) Model 7 – Lote Test.

6.1.1 Certification Model 5


6.1.1.1 Initial Evaluation
6.1.1.1.1 Certification Request

The supplier must submit a formal request to the OCP, along with the documentation described in the
RGCP, as well as the following items:

a) Models that compose the Family of the object and their specifications;
b) Datasheet, referring its technical-functional description, nominal specs, dimensions, limitations of use,
precautions and other relevant data;
Note: Must sent all the technical data of all the products classified in the same family, which must
contain at least the product code, nominal power (W), luminous flux (lm), CCT, power factor (PF),
voltage or voltage range (V), CRI, as specified in the RTQ;
c) External and internal pictures of the object (housing, LED and control device), as well as the
package (already with ENCE prototype);
d) IES LM80 Report for the LED used in the lamp (as Annex A from RTQ), if the company requests
the lumen maintenance test and nominal life definition test according to Phase 1 of item 6.10, letter A
from RTQ.
Note: It is the OCP obligation to check if the LM80 Report really is about the LED being used in the
lamps. This proof must be by proving the purchase of the indicated LED and by the manufacturer's
declaration that they are using the LED quoted in each of the models of lamps subjected to analysis.
e) Specification of the electrolyte capacitor, as qualification test established by IEC-TR 62380
standard, if applicable;
f) Data-sheet/part-number of all electronic components in the LED lamp, and life time
curve X electrolyte capacitor temperature, if applicable.

6.1.1.1.2 Analysis of Documentation Compliance


The analysis criteria for the Request and Documentation Compliance must follow the conditions
described in RGCP.

6.1.1.1.3 Initial Audit of Quality Management Systems


The criteria for the Initial Audit of Management System should follow the conditions described in
RGCP.

6.1.1.1.4 Initial Tests Plan


The test plan should include energy efficiency and safety testing, following the RTQ.

6.1.1.1.4.1 Definition of tests to be performed


The initial tests must show that the object of the conformity evaluation meets the requirements in
RTQ. The initial tests are all the tests described in subsection C1 of Annex C of this RAC.

6.1.1.1.4.2 Sampling Definition


The sampling definition should follow the general conditions set out in RGCP.

The OCP is responsible for the seal and collect of samples of different families of objects to have
their certificates, obeying the prescribed amount in accordance with subsection C.1 of Appendix C of
this RAC and taken from each family to be certified.

6.1.1.1.4.2.1 The values stated in the ENCE will be obtained in energy efficiency tests, as described
in RTQ. These values must be recorded in the test report issued by laboratories that meet the specified
in the item 6.1.1.1.4.4 of this RAC.

6.1.1.1.4.2.2 For the values declared in the ENCE label must be tested all the products of the Family,
as stablished in Table2 of annex C from this RAC. For the other initial tests, the quantity of models
to be tested is stablished in the subitem C.1.2.1 from annex C of this RAC.

6.1.1.1.4.2.3 In case there is a model inside a Family with any critical component (body material,
brand of electrolyte capacitor, LED brand) different from the tested models, would be necessary to test
this product regarding safety and performance.

6.1.1.1.4.3 Criteria for Acceptance or Rejection


Are described in annex C of this RAC.

6.1.1.1.4.4 Definiton of Laboratory


Must follow the conditions described at the RGCP.

6.1.1.1.5 Treatment of Non-Conformities in the Initial Evaluation stage


The criteria for the treatment of non-conformities in the stage of Initial Evaluation must follow the
RGCP. In case of non-conformities in the type tests, the supplier must propose corrective measures,
after which, new samples could be send by the supplier.
After the approval results in all the tests, the OCP must audit the supplier to certify that the product
tested is the same to be manufactured.

6.1.1.1.6 Issuance of the Certificate of Conformity


The criteria for the issuance of the Certificate of Conformity must follow the conditions described in
the RGCP.

6.1.1.1.6.1 Certificate of Conformity


The Certificate of Conformity s valid for three (3) years and must comply with the RGCP.

6.1.1.1.6.1.1 The OCP must attach the following documents to the Certificate of Conformity, in
addition to the documents required by the Ordinance:

a) PET (Technical Specification Sheet) from the Family of certified products;

b) Proposal for the ENCE filled for all the certified products.

6.1.1.1.6.1.2 The identification of the family and the model of the certified product must be as
follows:

- Family: LED technology / lamp type / nominal declared life


- Model: brand / power / luminous flux / luminous efficiency / power factor / CCT / dimensional
pattern.

6.1.1.2 Maintenance Evaluation


The maintenance evaluation criteria is described in RGCP.

6.1.1.2.1 Maintenance Audit


Should follow the RGCP criteria. The frequency of maintenance is 12 months after the granting of
the certificate of conformity. The OCP may conduct audits in shorter periods since justified by
changes in the production process or complaints about the product.

6.1.1.2.2 Maintenance Testing Plan


Os ensaios de manutenção devem comprovar a manutenção da conformidade após a avaliação
inicial e obedecer à mesma periodicidade das auditorias de manutenção. The list of tests is
indicated in subsection C.2 of Annex C of this RAC.

6.1.1.2.2.1 Definition of tests to be performed


The objects should be tested in energy efficiency and safety, following the RTQ.

6.1.1.2.2.2 Definition of Maintenance Sampling


Sampling shall follow the general conditions set out in the RGCP. The OCP is responsible for the
seal, collection and shipment of samples of different families of objects to have their certificates,
obeying the prescribed amount in accordance with subsection C.2 of Appendix C of this RAC and
taken from each family to be certified.

Note: The samples should be picked by the OCP in the commerce.

6.1.1.2.2.2.1 The OCP must perform new tests, by Inmetro determination, in case of
documented complaint.

6.1.1.2.2.3 Criteria for Acceptance and Rejection


Are described in the subitem C.2 of annex C from this RAC.

6.1.1.2.2.4 Definition of Laboratory


Must follow the conditions described in the RGCP.

6.1.1.2.3 Treatment of Non-Conformities in the Maintenance Evaluation stage


The criteria for the treatment of non-conformities in the stage of Maintenance Evaluation must
follow the RGCP.

6.1.1.2.4 Confirmation of Maintenance


The criteria for the confirmation of maintenance must follow the conditions described in the RGCP.

6.1.1.3 Evaluation of Recertification


The criteria for evaluation of recertification must follow the described in the RGCP. Once satisfied
all the requirements, the OCP must emit a new Conformity Certificate for the object evaluated, with
expiration as stablished in the item 6.1.1.1.6.1 from this RAC.

6.1.1.3.1 Treatment of Non-Conformities in the Recertification stage


The criteria for the treatment of non-conformities in the stage of Recertification must follow the
RGCP.

6.1.1.3.2 Confirmation of Recertification


The criteria for the confirmation of recertification must follow what describe the RGCP.

6.1.2 Certification Model 7


6.1.2.1 2.1 Certification Request
6.1.2.1.1 The supplier must submit a formal request to the OCP, along with the documentation
described in the RGCP, as well as the following items:

a) Datasheet, referring its technical-functional description, nominal specs, dimensions, limitations


of use, precautions and other relevant data;
Note: Must sent all the technical data of all the products classified in the same family, which must
contain at least the product code, nominal power (W), luminous flux (lm), CCT, power factor (PF),
voltage or voltage range (V), CRI, as specified in the RTQ;

b) External and internal pictures of the object (housing, LED and control device), as well as the
package (already with ENCE prototype);

c) IES LM80 Report for the LED used in the lamp (as Annex A from RTQ), if the company
requests the lumen maintenance test and nominal life definition test according to Phase 1 of item
6.10, letter A from RTQ.
Note: It is the OCP obligation to check if the LM80 Report really is about the LED being used in the
lamps. This proof must be by proving the purchase of the indicated LED and by the manufacturer's
declaration that they are using the LED quoted in each of the models of lamps subjected to analysis.

d) Specification of the electrolyte capacitor, as qualification test established by IEC-TR 62380


standard, if applicable;

e) Data-sheet/part-number of all electronic components in the LED lamp, and life time curve X
electrolyte capacitor temperature, if applicable.

f) License to Import (for imported objects);

g) Identification of the models of the lote to be certified. The supplier must evidence this
information to the OCP with formal records.

h) Identification of the size of the lote to be certified. The supplier must evidence this information to
the OCP with formal records.

6.1.2.2 Analysis from the Application and Conformity of the Documentation


The criteria for analysis of application and conformity of the documentation must follow what
describe the RGCP.

6.1.2.3 Testing Plan


Must follow what describe the item 6.1.1.1.4 from this RAC.
For the model 7 the Family concept is not applied, thus all models must be tested.

6.1.2.3.1 Definition of Tests to be Performed


Must follow what describe the item 6.1.1.1.4.1 for this RAC.

6.1.2.3.2 Definition of Sample


6.1.2.3.2.1 The definition of sample must accomplish subitem 6.2.4.2 from the RGCP,
complementing with the below subitems.

6.1.2.3.2.2 The OCP is responsible for witnessing the collection of samples of the object to be
certified. The OCP must identify, seal and send the samples to the laboratory for testing.

6.1.2.3.2.3 The OCP, when realizing the sample collection, must prepare a sampling report,
detailing the date, local, lote identification and the conditions under it was obtained.

6.1.2.3.2.4 The collection must be in Brazil by the OCP with the available lote or with available
lotes before their commercialization.

6.1.2.3.2.5 The model chosen in the assembly of the test plan to carry out the type test will be one
which presents the most complete configuration or the one where it’s construction or operation
present the most unfavorable condition to the user safety.

6.1.2.3.2.6 Must be performed the test of energy efficiency and safety.

6.1.2.3.2.7 The samples of each Family of LED lamps present in the certification lote must be
collected according to ABNT NBR 5426:1985, double-standard sampling plan, special inspection level
S4 and NQA of 0,65.

6.1.2.3.2.8 The samples must be divided in to appropriate parts to perform each of the tests
prescribed.

6.1.2.3.2.9 The OCP is responsible for selecting, seal, and sending the samples to the accredited
laboratory.

6.1.2.3.3 Criteria for Acceptance or Rejection


6.1.2.3.3.1 Will be approved the lotes which doesn’t show non-conformities.

6.1.2.3.3.2 The criteria for acceptance or rejection are described in annex C from this RAC.

6.1.2.3.4 Definition of Laboratory


The criteria for the definition of the laboratory must follow the RGCP.

6.1.2.4 Treatment of Non-Conformity in the Process of Lote Evaluation


If there is disapproval of the lote, this should not be release for commercialization and the supplier
must provide its destruction or devolution to the country of origin (for imports) with supporting
documentation. In case of national product, the OCP must evaluate the possibility of reclassification
or destruction of the lote.

6.1.2.5 Certificate Issuance


The criteria for issuing the certificate of conformity must follow the RGCP and what is describe in the
item 6.1.1.1.6. The certificate of conformity will be valid only to the lote in question. This
information must be included in the certification itself. Other provisions, as set out in the RGCP.

7. COMPLAINTS TREATMENT
The criteria for handling complaints must follow the conditions described in the RGCP.

8. ACTIVITIES EXECUTED BY FOREIGN OACs


(ORGANIZATION FOR EVALUATION OF CONFORMITY)
The criteria for activities executed by foreign OACs must follow what is described in the RGCP.

9. TRANSFER OF CERTIFICATION
The criteria to transfer a certification must follow what is described in the RGCP.

10. FINISHING THE CERTIFICATION


The criteria to finish a certification must follow what is described in the RGCP.

11. CONFORMITY IDENTIFICATION LABEL


11.1 The criteria for use of the Conformity Identification Label must follow the RGCP.

11.2 The Conformity Identification Label must be as appendix A. The label for conformity is the
ENCE, mandatory for all models covered by this regulation.

11.3 The dimensions of the ENCE and the information to be contained are described in the
appendix A of this document.

11.4 The authorization for the use of labels is given only when the object is in conformity with all
the requirements of this RAC and when granted the Object Register.

11.5 Must be obeyed the provisions of Inmetro, n. 274, from June 13th of 2014, in the Manual for
Application of Conformity Identification Labels and instructions described in annex A of this
document.

11.6 The labels must be affix on the product packaging.

11.5 For LED lamps with built-in control device integrated to the base subject to energy efficiency
tests, Inmetro can provide tables of Energy Efficiency at the website:
http://www.inmetro.gov.br/consumidor/tabelas.asp.

12. AUTORIZATION FOR THE USE OF CONFIRMITY IDENFITICATION LABEL


The criteria for authorization for the use of the identification label of conformity must follow the
RGCP.

13. RESPONSABILITIES AND OBLIGATIONS


The criteria for responsibility and obligations must follow the RGCP.

14. MARKET MONITORING


The criteria for market monitoring must follow the RGCP.

15. PENALTIES
The criteria for penalties application must follow the RGCP.

C.1.1.1 Sample
For each tested model, should have 1 (one) sample. In the case of destructive testing, samples may
not be used for other tests, thus the total sample is four (4) units of the model to be tested. The
number of samples for each test and the test sequence is defined in Table 1. Additional samples
could be collected by the OCP.

Note: The number of different models tested in the family depends on the number of models that
this family has. For families with five (5) models, will be selected and tested one model. For
families with six (6) to ten (10) models, 2 (two) different models are selected and tested, and so on
for a number of models greater than 10 (ten).

In any case, the model with higher power always must be tested.

C.1.1.2 Acceptance/Rejection
To acceptance of the sample, non-compliances should not happen. If any non-compliance is found
during the tests, the supplier must sent new samples with all the implemented corrections, not being
allowed the occurrence of any non-compliance in such samples. If there is a failure in the family, all
belonging models will be disapproved.

C.1.2.1 Samples
For each tested model, should have 15 samples of the same model. In the case of destructive testing,
samples may not be used for other tests. The number of samples for each test and the test sequence is
defined in Table 2. Additional samples could be collected by the OCP.

C.1.2.1.1 The number of different models tested in the family depends on the number of models that
this family has. For families with five (5) models, will be selected and tested one model. For families
with six (6) to ten (10) models, 2 (two) different models are selected and tested, and so on for a
number of models greater than 10 (ten).

C.1.2.1.2 For the Energy Efficiency test: Power, Power Factor, Luminous Flux and Luminous
Efficiency, all the models in the family must be tested.

C.1.2.2 Acceptance/Rejection
To acceptance of the sample, non-compliances should not happen. If there is a failure in the family,
all belonging models will be disapproved.

C.1.2.2.1 In the Luminous Flux Maintenance test (9th sequence), as Phase 1, 6.10 item from the
RTQ, the acceptance will occur if 100% of the tested samples reach the criteria shown in Table
3 of this RAC. This criteria is also valid for the Built-in Control Device Durability Test (6.10.1.2
item from the RTQ).

C.1.2.2.2 For Luminous Flux Maintenance Test, as Phase 2 (6000h or more), the acceptance will be
applicable if 90% of the tested units reach the luminous flux maintenance values for each period
presented in the RTQ. This criteria is also valid for the Built-in Control Device Durability Test
(6.10.1.2 item from the RTQ).

C.1.2.2.3 In the tests number 6.3, 6.4, 6.5, 6.6, 6.7, 6.8, 6.9 e 6.11 from the Table 2, the arithmetic
average of the samples must comply with the established limits set in the RTQ.

C.2 Maintenance Tests


The sample collection should be made in the commerce.

In the case of collection in the commerce, the OCP should locate products with manufacturing date
after the date of concession or the last maintenance test. It should be preferably collect samples of
models within the family, who have not undergone previous collections, until all family models have
been tested.
