FACTS:

On October 24, 1978, petitioner corporation hired private respondent Aban as its “Legal Assistant.” On
September 4, 1980, Aban received a letter of termination because of his alleged failure to perform his
duties well. On October 6, 1980, Aban filed a complaint against the petitioner for illegal dismissal.

ISSUE:

WON there was an employer-employee relationship between petitioner corporation and Aban.

RULING:

Yes. ABan worked solely for the petitioner and dealt only with legal matters involving said corporation
and its employees. It also assisted the Personnel Officer in processing appointment papers for
employees. This latter duty is not an act of lawyer in the exercise of his profession but rather a duty for
the benefit of the corporation.
