Domestic Violence Act 1994

This Act was enacted to protect battered woman and children both physically and verbally. It
became law on 1 June 1996.

Domestic violence is a crime and it is taken to have been committed if there is information
tantamount to the commission of a related offence under the Penal Code. Notwithstanding that,
many see it as a domestic or family affair which battered women deferred in looking for help.

When this happened, the victim can:-

 First, seek immediate medical attention at the nearest Government Hospital (remember to always
get your medical report out) immediately;
 Thereafter, the victim or anyone close to the victim may make a report to the District Social
Welfare Department (contact can be obtained from their official website: jkm.gov.my) or to the
police; and
 Tell the Social Welfare officer or the police that if you need Interim Protection Order (which is
valid for 12 months and can be renewed for a further 12 months) pending investigation and they
will assist to obtain such order in court which will entails such necessary order to keep the victim
safe. At this juncture, victim can voice out their concerns to the officers in charge, for instance
any imminent physical abuse or threat in order for necessary arrangements to be made;
 Should the offender officially charged after investigation, victim may apply for Protection Order
instead;
 If the victim felt not convinced by the authority be in handling their case, they may have a
lawyer to hold a watching brief in court they have been subpoenaed to attend court to give
evidence against the spouse.

如此，许多人认为这是一种家庭或家庭事务，推延了寻求帮助的女性。

发生这种情况时，受害者可以： -

•首先，立即到最近的政府医院寻求医疗救助（记得提取您的医疗报告）;

•此后，受害人或受害人身边的任何人可向区社会福利署报告（联系方式可向其官方网站：
jkm.gov.my 索取）或向警方报告;和
•告诉社会福利官员或警察，如果您需要临时保护令（有效期为 12 个月，可以再延长 12 个月）等
待调查，他们将协助在法庭上获得此类命令，这将需要为了保护受害者的安全。在这个时候，受
害者可以向主管官员表达他们的担忧，例如任何迫在眉睫的身体虐待或威胁，以便作出必要的安
排;

•如果罪犯在调查后被正式起诉，受害人可以申请保护令;

•如果受害者对当局处理他们的案件的方式感到不满，他们有权聘请一名律师在法庭上举行观看简
报以提供配偶犯罪的证据。
