Ley 40/2015 de Régimen Jurídico
del Sector Público. the Public Sector
La ley regula el régimen jurídico de la
Administración Pública (AAPP), así como las
relaciones entre las mismas. Se recogen
materias de vital importancia como los
principios de responsabilidad patrimonial de las
AAPP destacando la del Estado Legislador, o la
potestad sancionadora.
Empero la importancia de las citadas materias,
estimamos oportuno resaltar el decisivo rol que
jugará la tecnología en la consecución de una
gestión más eficiente, transparente y ágil.
Es imprescindible y obligatoria la relación de las
Administraciones públicas por medios
electrónicos. Por lo tanto, ¿qué innovaciones se
pueden apreciar en lo relativo a la
modernización hacia nuevas fuentes de gestión
y organización?
La sede electrónica mediante la que los
distintos entes públicos podrán llevar a cabo
sus tareas administrativas, un innovador portal
de internet (Título Preliminar, Capítulo V) o
sistemas de identificación digitales son parte de
esta transformación que nos permite el mundo
tecnológico actual.
Además, un mayor grado de eficiencia será
posible no únicamente por la gestión
electrónica de expedientes y documentos, sino
también por la coordinación obligatoria que se
exige entre las Administraciones Públicas,
creando un Registro Electrónico de órganos e
instrumentos de cooperación al efecto.
En definitiva, tras la aprobación de esta ley,
observamos cómo se pretende incrementar la
transparencia, la agilidad y simplicidad del
sector público institucional bajo la cooperación
y coordinación de las distintas
Administraciones.Las leyes de convivencia
tienen que adecuarse a los tiempos actuales
donde la tecnología tiene un gran peso.

The lawregulates the legal regime of the Public
Administration (PPAA), as well as the relations
between them. Matters of vital importance
such as the principles of patrimonial
responsibility of the PPAA or the sanctioning
powers are endowed in the Law.
In spite of the importance of the mentioned
matters, we consider it appropriate to highlight
the crucial role that technology will play in
achieving a more efficient, transparent and
agile management.
The relationship of public administrations by
electronic means is essential and mandatory.
Therefore, what innovations can be seen in
relation to modernization towards new sources
of management and organization?
The electronic headquarters through which
different public entities can carry out their
administrative tasks, an innovative internet
portal (Preliminary Title, Chapter V) or digital
identification systems are part of this
transformation that can be reached due to the
current technological world.
In addition, a greater degree of efficiency will
be possible not only by the electronic
management of files and documents, but also
by the mandatory coordination required
between Public Administrations, creating an
Electronic Registry of organs and cooperation
instruments for this purpose.
In conclusion, this law increases the
transparency, the agility and the simplicity of
the institutional public sector under the
cooperation and coordination between
different Administrations. The laws of
coexistence have to adapt to the current times
where technology has a great weight.
