AFFIDAVIT OF JUSTIFICATION

I, Police Officer II Jaime Boholst Jr., male, of legal age, married,

Filipino, a bonafide member of the Philippine National Police (PNP)
presently assigned at Kiamba Municipal Police Station (KMPS) with office
address at Hidalgo St., Poblacion Kiamba, Sarangani Province, after having
duly sworn to in accordance with law do hereby depose and state;

01. That I am the designated Team Leader of the joint operating team,
who will conduct Buy Bust/Entrapment Operation against a certain Joel O.
Sanchez. There were reports coming from Confidential Informant (CI for
brevity) that subject person is engaging in illegal activity by selling “shabu”
at the vicinity of Barangay Datu Dani, Kiamba, Sarangani Province, even
with the continuous campaign of this station against said illegal activities.
Reports were validated and a plan for conducting buy bust/entrapment
operation was formulated by the joint operating personnel.

2. That during the operation, joint operating team able to apprehend

the suspected pusher who later identified his complete name as: Joel Osorio
Sanchez, male, 43 years old, farmer and a resident of Brgy Datu Dani,
Kiamba, Sarangani Province.

3. That as a result thereof, confiscated and seized from control and

possession of aforementioned arrested suspect were the following items to
wit:
a. one (1) piece of five hundred Pesos (P500.00) Peso Bill with serial number
DL878437 served as marked money;

b. One (1) Piece Heat sealed transparent sachet containing white crystalline
substance suspected to be Methamphetamine Hydrochloride or Shabu (Object of Sale);

4. That said operation was witnessed by Municipal. Councilor Edwin

Alonso and Media representative Romulo Magdayao Jr with the exception
of the DOJ representative who were absent despite all efforts and necessary
means/ways to contact them to witness the actual inventory, markings and
the taking of photographs of all confiscated pieces of evidence considering
the time of operation, the distance of the place/time of operation;

 5. That after the suspect was arrested, I decided to brought the arrested
suspect at Kiamba Municipal Police Station in presence of the witnesses
Romulo Magdayao Jr, since the area operation was uninhabited and it was
already night time. That actual bodily search, markings, inventory and
photographs of confiscated pieces of evidence were done at the Kiamba
Municipal Police Station in the presence of the aforesaid witnesses;

6. In consideration that this particular effort in the campaign against

illegal drugs and time of the essence, the undersigned decided to proceed
with the process of forwarding the subject evidence to the PNP Regional
Crime Laboratory 12, Camp Fermin G Lira Jr., General Santos City for
laboratory/chemical analysis without the representative from DOJ;

7. That I am executing this affidavit to attest the truthfulness and

veracity of the foregoing for all legal intents and purposes.
