JUDICIAL AFFIDAVIT

I, ANTONIO KURTISH, of legal age, single, Filipino, and a resident

of No. 15 Hershey Street, Central Park, Bangkal, Davao City, Philippines,
under oath, hereby depose and state that:

1. I was examined by ARA PRINCESS O. OLAMIT who is holding

office in Coquilla Olamit Vallente & Yu Law Firm 7th Floor,
ABREEZA Corporate Center, J.P. Laurel Street, Davao City,
Philippines.

2. I answered the questions asked of me, fully conscious that I do so

under oath and that I may face criminal liability for false testimony
or perjury.

The questions that were asked and my corresponding answers are

the following:

1. Q: Sir, Paki-ingon sa imong ngalan ug trabaho.
A: Ako si Antonio Kurtish. Nagtrabaho ka sa shop ni Marcelo
Lara nga gihinganlan nga “ULTRA Speed Machine Shop and
A’s Metal Products” isip usa ka mekaniko.

(Q: Sir, please state your name and occupation.

A: My name is Antonio Kurtish and I am an employee in

“ULTRA Speed Machine Shop and A’s Metal Products”
owned by Mr. Marcelo Lara. I am a mechanic in the said car
parts and auto repair shop.)

2. Q: Unsa ang nahitabo atong December 23, 2018?

A: Ako ug ang akong mga kauban sa trabaho nga sila Majo

Salvarro, Sari Peronimo ug Romeo Tuadles, kauban si
Aurello Laxa, kay naaksidente sakay ang sakyanan sa
kliyente sa among amo.

(Q: What happened on December 23, 2018?

A: Me and my co-workers Majo Salvarro, Sari Peronimo and

Romeo Tuadles, including Aurello Laxa, met an accident
while driving the car owned by one of the clients of Mr.
Laxa’s auto repair shop.)

3. Q: Asa nahitabo ang aksidente?

A: Nahitabo ang aksidente didto pa lang dool sa Sasa Wharf.

Naay murag intersection didto.

(Q: Where did the accident happen?

A: The accident happened in an intersection near the Sasa

Wharf, Davao City.)

4. Q: Unsang orasa nahitabo ang aksidente?

A: Hapon nato. Mga naa sa alaskwatro sa hapon.

(Q: What time did the accident happen?

A:. It was already in the afternoon around 4:00 pm.)

5. Q: Kinsa ni si Aurello Laxa?

A: Si Aurello, akoa na siyang katrabaho dati sa autoshop ni

Sir Marcelo. Pero tong nahitabo ang aksidente, dili na na

 siya trabahante kay hagbay ra na siya nga ni-resign sa
trabaho.

(Q: Who is Aurello Laxa?

A: Aurello Laxa was a former co-worker in the auto repair

shop of Mr. Lara. He had already resigned from work when
the December 23, 2018 accident happened.)

6. Q: Unsa imong nahibal-an bahin kang Romeo Tuadles?

A: Si Romeo Tuadles kay katrabaho nako sa repair shop ni

Sir Lara. Mekaniko sad na siya pares nako unya uban na siya
sa upat ka tawo nga gi-imbitahan ni Aurello muadto ug dagat.

(Q: What do you know of Romeo Tuadles?

A: Romeo Tuadles was one of my co-employees in the auto

repair of Marcelo Lara. He was also a mechanic and like me,
was invited by Aurello Laxa to go to the beach.)

7. Q: Unsa imong nahibal-an bahin sa pagkamatay ni Romeo

Tuadles?

A: Kauban pa namo siya nga naglipay lipay sa Samal Island

isip despidida namo kang Aurello kay muadto na siya ug
Dubai. Pero tong manguli nami balik sa auto shop, nabangga
mi. Sa atubangan na siya naglingkod tapad ni Aurello. Pero
siya ang nadusmo ug maayo sa poste nga among gibanggaan
nga nagresulta sa iyang kalit nga kamatayon.

(Q: What do you know of the death of Romeo Tuadles?

A: He was with us celebrating the despidida party of Aurello

Laxa in Samal Island. However, when we decide to end our
short drinking spree and return to the shop, we met an
accident on the road. Since Romeo was seated beside Aurello
who was the one driving the car, the impact of the crash was
borne to him resulting to his sudden death.)

8. Q: Naunsa pagkahitabo ang aksidente?

A: Pauli nami ato sa repair shop pero naa pami ato dapit sa
Sasa Wharf. Katong naay likuanan diraa sa dalan, si Aurello
nga medyo nahubog na, naglisod ug control sa manubila.
Natuyok na nuon mi ug naderetso paingon sa dakong poste
sa kuryente sa kilid. Tungod ato naguba ang sakyanan,

 nasamdan ko uban ang akong mga kauban, ug si Romeo nga
maong sa atubangan ang naigo ug pag-ayo sa poste nga
maong niresulta sa iyahang kalit nga kamatayon.

(Q: How did the accident happen?

A: When we were heading back to the auto repair shop from

our short trip to Samal Island, we reached a curve near the
Sasa Wharf. Aurello Laxa, who had been quite intoxicated
from our short drinking spree in the beach, lost control of the
vehicle causing it to turtle and hit a post. This resulted to the
damage of the car, the injuries I sustained from the said
accident, the current medication of my other co-workers, and
the death of my co-employee Romeo Tuadles.)

9. Q: Gi-unsa pagkahitabo nga si Aurello Laxa ang nahimong

drayber sa sakyanan nga naa sa repair shop?

A: Nakumbinsi mi ni Aurello nga gamiton tong sakyanan sa

kliyente nga naka-istambay sa repair shop masking kabalo mi
nga dili jud to siya pwede gamiton. Gibawalan jud mi ana sa
tag-iya sa repair shop kay ang among trabaho lang kay mag-
repair sa mga sakyanan.

(Q: How did Aurello Laxa succeed on driving and manning

the car under the custody of the repair shop?

A: He induced us to utilize the car in the repair shop despite

the fact that such is prohibited and is beyond the authority
given to us which is limited only to fixing and repairing cars.)

10. Q: Gi-unsa mo pagkakumbinsi ni Aurello Laxa nga gamiton

ang sakyahan nga kabalo man mo nga ginabawal jud to sa
kompanya?

A: Nakumbinsi mi ni Aurello Laxa nga gamiton ang

sakyanan kay tungod mulakaway na siya paadto ug Dubai.
Gusto niya nga maglipay lipay mi sa mga nahibiling adlaw
niya diria sa Dabaw. Suod man pud gud mi ana ni Aurello
maong nadala mi sa iyahang pag-istorya.

(Q: How did Aurello Laxa manage to induce you in utilizing

the car when you are all aware that using such is prohibited by
the company?

 A: We were convinced by Aurello Laxa to utilize the car
despite the fact that such is prohibited since he is about to
depart to Dubai. He wanted to celebrate with us his remaining
days in Davao by going to the beach. Since we are close
friends with Aurello, we were convinced by the persuasion of
Aurello.)

11. Q: Naa koy documento diri nga naka-mark nga Annex “1”.
Unsa imong maingon ani nga dokumento?

A: Mao ni ang kopya sa polisiya sa among kompanya nga

gitrabahuan kang Sir Lara. Naka-post ni sa shop nga among
gi-trabahuan unya nakabutang diraa nga ginabawalan ang
paggamit sa mga sakyanan sa kliyente nga naa sa kustodiya
sa shop.

(Q: I have here a document marked as Annex “1”. Can you

tell me what this document is all about?

A: Yes. This is a copy of the company policy of the business

of Mr. Lara posted in the shop which explicitly states that the
unauthorized use and driving of vehicles repaired and
stationed in the shop is strictly prohibited.)

3. I attest that the attachment of this Judicial Affidavit is a faithful

reproduction of its corresponding original copy.
