Justified Over the past years, Philippines is performing well economically on its
infrastructures, government development programs and monetary policies that made
Philippines one of the most vibrant economy in this decade. As a result, standard of
living increases substantially with simultaneous effects on inflation, employment and the
needs and demands of the Filipino people. This leads to an increase in car ownership in
response with an increase in their incomes and with the more benefits derived from
having one such as the convenience, comfortability and productivity that are lack with
our existing public transportation system. If the car ownership is still increasing
substantially over time and cannot be prevented, it will result to greater traffic
congestion, disruption of the supply chain management of the public and private
enterprises, greater fuel inefficient consumptions and opportunity loss for everyone.

The situation with traffic in the streets of Metro Manila and other highly
urbanized cities, most notably along Epifanio De Los Santos Avenue (EDSA), has also
not been a favorable one and contributing 3.5 Billion pesos per day loss in the economy
due to traffic congestion in Metro Manila according to Japan International Cooperation
Agency (JICA) in their recent study on effects of traffic in the economy.
This fruit of the poisonous tree that has led to many losses in the country’s
economy, thus hindering it from further developing, is simply unacceptable. Article II,
Section 9 of the 1987 Philippine Constitution states that “Section 9. The State shall
promote a just and dynamic social order that will ensure the prosperity and independence
of the nation and free the people from poverty through policies that provide adequate
social services, promote full employment, a rising standard of living, and an improved
quality of life for all.”
The aforementioned quote from the highest law of the land has long stood a
policy of the state. Ignoring the current status of public transportation and it’s damning
effects to the economy and development of the Filipino nation is in direct contradiction to
the policy stated and must be addressed immediately to ensure that the nation’s economy,
and all of it’s other aspects, is not compromised.
To resolve these never ending issues on traffic, and hindrance to the mobility of
the economy, the government through this proposed bill shall provide a necessary legal
framework of converting the comfortability, convenience and productivity of the private
cars to the development of public mass transportation system in the Philippines
specifically the bus transport system that is cost effective and cost efficient. The more the
public transport is convenient and comfortable for conveyance, the more Filipino people
will patronize it by using it thus decreasing traffic congestion, more road space for cargo
vehicles and other logistics vehicles and increase productivity in labor markets.

AN ACT
PROVIDING AN EFFICIENT PUBLIC TRANSPORTATION SYSTEM BY
MEANS OF A SYNCHRONIZED UPGRADED BUS TRANSPORTATION
OPENING SYSTEM IN METRO MANILA AND IN OTHER HIGHLY URBANIZED CITIES

SECTION 1. Short Title. – This act shall be known as the “Synchronized Upgraded Bus
Only Transportation System Act of 2018”

SEC. 3. Declaration of Terms. – For the purpose of this act, the following terms shall

SEC. 4. Philippine Bus Transportation Management System (PBTMS). – The PBTMS


is the government’s central bus transportation management system that will control and
manage the bus transportation in Metro Manila and highly urbanized cities certified by
the Philippine Statistics Authority which will be owned and operated by the Philippine
government through its accredited agencies.

SEC. 5. Scope of Philippine Bus Transportation Management System (PBTMS).– This


act applies on the bus transportation management system components which includes but
not limited to:

a) Bus Transportation Management Board (BTMB)


b) Specification and details of buses that will be used for this act
c) Employment of the bus drivers, dispatchers and other employees that will be
taking the control of the system
d) The integrated ticketing bus system
e) (DOTr), Land Transportation Office (LTO) and the LGUs
f) Fare Matrix System
g) Common Bus Point Terminals
h) Information Management System of the PBTMS

BUS TRANSPORTATION MANAGEMENT BOARD (BTMB)

SEC. 6.1. Bus Transportation Management Board (BTMB).– The BTMB is the
government’s central board that will manage and administer the PBTMS. PBTMS will
be run through the accredited and partnerships among government agencies; thus, it will
be fully managed and controlled by the national government and the local government
units according to their respective duties and responsibilities indicated in the existing
laws on regulations and implementation of public transportation. To make an efficient
and effective management and consolidation system among agencies, the BTMB or the
Bus Transportation Management Board shall be created under the Department of
Transportation (DOTr) and the Land Transportation Franchising and Regulatory Board
(LTFRB). The BTMB shall be composed of:

a) The Secretary of the Department of Transportation (DOTr)


b) The Chairman of the Metro Manila Development Authority (MMDA)
c) The Mayors and Vice Mayors of the Local Government Units (LGUs) affected by
this act
d) The Secretary of the Department of Tourism (DOT)
e) The Secretary of the Department of Information Communications Technology
(DICT)
f) The Executive Director of the Land Transportation Franchising and Regulatory
Board (LTFRB)
g) The Director of Philippine National Police-Highway Patrol Group (PNP-HPG)
h) The Director of Land Transportation Office (LTO)
i) Staff employees who will be directly working in the management and system
operations
which will be headed by its Chairman appointed by the President of the Philippines with
a term coterminous with the President.

SEC. 6.2. Duties and Responsibilities.– The BTMB members and the board has the
following duties and responsibilities but not limited to:

a) Conduct quarterly and annual meeting to discuss issues, proposed new ideas for
the betterment related to the Bus Transportation Management System (BTMS)
b) Develop specifications and descriptions in the bus operations, bus design, bus
terminals, information system management and the administration functions of
the Board to run smoothly.
c) Create quarterly and annual report in the condition and improvement of the bus
transportation system in its respective designations with respect to the economic
prosperity, and public convenience submitted to the Office of the President, and
for general publication.
d) Develop a fare matrix system that complies with the existing laws, orders and
regulations
e) Maintain and develop the information management system that will handle the
fare matrix, the bus routes and the general bus operations of the program
f) Employs workers and members of the administration staff who will directly
working in the operations of the BTMS
g) Coordinate the operations with each accredited agencies for the smooth flow of
the program
h) Develop periodically the bus routes in accordance with the need of the general
public related to convenience, economic movement, and tourism.

SEC.6.3. Departments.– To run smoothly the program, the BTMS will create specialized
departments according to the needs and requirements of the program. Duties and
responsibilities of these departments are aligned with the existing duties and
responsibilities of the Department of Transportation (DOTr). The following are the
departments under the BTMS:
a) Administration Department
b) Fare Matrices and Ticketing Department
c) Information Management Department
d) Legal Department
e) Coordination and Regulation Department
f) Technical and Support System Department
g) Human Resources Department
h) Treasury Department

BUS DESIGN AND OPERATIONS

SEC.7.1 Bus Name.– The government-run buses will be named “Pinoy Bus” that will
run into operations within the Metro Manila and in highly urbanized cities.

SEC.7.2 Bus Specifications.– The LTFRB will draft the minimum specifications and
operating characteristics of the Bus that will be used for the program are as follows:

a) Single-deck or double-deck (11-13 meters in length);


b) With external color/branding as specified by LTFRB;
c) Euro IV diesel engine or better emission standard or clean alternative fuel with
equivalent or better emissions (e.g., electric or hybrid vehicles);
d) Maximum four (4) reclining seats per row; and Low floor entry (0.28m-0.38m)
with space for one passenger with wheelchair, plus foldable or retractable
wheelchair ramp at entry.
e) Airconditioned Ventilation
f) Emergency doors at the side and in the back portion of the bus
g) With well-lighted lights that are good for morning daylight to midnight
h) With vehicle tracking on board Global Positioning System (GPS) device
compliant with the specifications and requirements by the LTFRB
i) Turnstile card system for ticketing
j) Two way communication system to the system operations hub
k) With WIFI Internet Access built
l) Entertainment and Sound System built such as but not limited to:
a. Flat screen television
b. Sound System
m) With emergency tools and apparatuses such as the fire extinguisher, first aid kit
and the like.

Other specifications in accordance with the bus types will be provided in the
implementing rules and regulations as additional and discretionary features of the bus.

SEC.7.3. Bus Acquisitions and Orders.– The LTFRB through BMTB will conduct the
bidding process in accordance with the existing laws on government purchases and
acquisitions. The BMTB will determine on the number of bus in operations that will be
used in the program and for the next period successively. The number of bus in
operations will depend on the existing private bus operations within the designated and
desired bus routes, the number of private bus that complies with the modernization of
public utility vehicles, volume of commuters in the area and within the 1km radius bus
routes and other sources of mass transportation within the area and within the bus routes.

With the determined bus in operations, an addition of 10% of the determined bus in
operations will be the number of bus in reserve and replacement in case of irregularities
and unnecessary incidents during the implementation of the program.

SEC.7.4. Bus Operations.– The Buses will be operated through the Bus Transportation
Management System (BTMS). The operations will be 24/7 covering the designated routes
provided by the joint efforts of the DOTr, LTFRB, MMDA and the LGUs affected by
this act. in both Northern and Southern part in Metro Manila and in the main of the highly
urbanized cities. This will serve as the garage, administration and management command
centre and the maintenance hub of the BTM.

SEC.7.5. Bus Formats.– The Pinoy Buses will run only its within its bus routes
designated by the accredited agencies. Unloading and Loading of passengers are possible
within the elevated bus stops and bus terminals determined by the Board. The passenger
capacity of each bus will depend on its seating capacity excluding the driver and the
conductor/technical staff.

SEC.7.6. Bus Types and Classifications.– The bus will have 3 types in color coded and
name after Filipino words in accordance with the routes, destinations and availability are
as follows:

a) Bus Type A known as “Mabuhay”– (Green in Body Color) – These are the tourist
bus type that have only routes in the tourist spots and centre of recreation in
Metro Manila and in highly urbanized cities. Bus operations of this type will
cover international airports, famous landmarks, known Filipino restaurants,
nearby hotels, souvenir shops and the like. This type of bus is best for those
foreign and local tourists who want to visit the landmarks using the single mass
transportation system discouraging the use of private vehicles.

Operations of Bus Type A includes bus routes, fare matrix and the like which will
be governed by the existing laws in Tourism transportations, and managed by the
Department of Tourism (DOT) team of the Board. Special features will be
provided in this bus which includes but not limited to:
a. Brochures of the Famous spots, restaurants and the like in the area
b. Basic translation of English-Filipino phrases and greetings
c. Directional Maps

b) Bus Type B known as “ Kasipagan” – (Blue in Body Color) – These are the city
buses that have only routes within the city jurisdiction. Bus operations of this
type will cover schools, markets, churches, famous landmarks of the city, main
recreation areas and the like within the city jurisdiction. This type of bus is best
for the locals who want to make visit local destinations in a quick manner for
employment, delivery and logistics and other private transactions.

Operations of Bus Type B includes bus routes, fare matrix and the like which will
be governed by the existing local laws and managed by the local government
units (LGUs).

c) Bus Type C known as “ Katatagan” – (Yellow in Body Color) – These are the
inter-city schools, markets, churches, famous landmarks of the city, main
recreation areas and the like along bigger national highways in the Metro Manila
and interconnecting towns and cities for highly urbanized cities. This type of bus
is best for the locals who want to make visit local destinations in a quick manner
for employment, delivery and logistics and other private transactions within the
intercity and neighboring towns and municipalities.

Operations of Bus Type C includes bus routes, fare matrix and the like which will
be governed by the existing local laws and managed by the local government
units (LGUs), Metro Manila Development Authority (MMDA) and the PNP-
Highway Patrol Group (PNP-HPG).

SEC.7.7. Bus Licenses.– The Buses will be a state owned property and the licenses and
permits for which it will be operated is subject with the existing rules and regulations on
vehicle registrations for government property vehicles and other pertinent laws covering
this act.
SEC.7.8. Bus Maintenance.– The Buses will be maintained by the board through hiring
technical experts and staff that will comprise the bus maintenance and technical
operations of the program. Employment and hiring will govern in the section 13 of this
act.

SEC.7.9. Bus Lanes.– The Pinoy Buses will run in a separate lane for this program. The
road shall be marked for the P-Buses usage only. For EDSA and other 6 and above lane
routes, the first lane for the private bus, the second lane will be dedicated to the P-Buses,
the third lane shall be for the bus station and the first 3 lanes mentioned will be dedicated
for mass transportation. For two and three lane roads, the outer road shall be dedicated
only for mass transportation system either public or private, For four-five lane routes, two
lanes will be dedicated to mass transportation system, one for the government owned and
the other for the privately owned bus fleets.

TICKETING BUS MANAGEMENT SYSTEM

SEC.8.1. Bus Tickets.– The Buses will be operated through a digital ticketing bus
management system in which ticketing facility will not be made inside the bus.
Passengers will be using the beep card similar to the train mass transportation system.

SEC.8.2. Beep Cards.– Beep Cards is the mode of payment that will be used in the
operations of the Bus Management Transportation System. It is loadable and/or single
use only card that can be used in any bus types operating in this program. Beep cards can
be purchased and loaded inside the Light Railway Transit ( LRT) and Metro Rail Transit
(MRT) stations, airports, convenience stores, shopping malls, central bus stations
designated by the board. The beep cards the turnstile similar to the LRT and MRT as
form of entering and exit in the bus premises. Beep cards remaining load cards cannot be
converted into cash.

SEC.8.2.Discounts.– Implementation of the Beep cards will also be applied and be given
special Beep card for those students, senior citizens and disabled persons for the 20%
discount. For the students to be able to use them in their ride, they are required to present
their school I.D upon inserting the Beep cards. The senior citizens and the disabled once
will no longer be requested to present their Identification as long as the usage of the
special Beep cards is for them.

SEC.8.3. Beep Cards Malfunction.– In case that the beep cards malfunction, the cards
can not be replaced by the driver nor any member of the staff. Instead, the passenger shall
present the defective Beep card to the designated driver to be checked its remaining load
value and be given special ticket for his/her conveyance.
BUS ROUTES

SEC.9.1. Bus Routes.– The bus routes of each bus will depend on the classification of
the bus. It will only run on its designated routes and shall be given designated line
especially in the national highways exclusive for the government buses. Bus Routes will
be assigned and designated by the Department of Transportation (DOTr), Land
Transportation Franchising and Regulatory Board (LFTRB), Land Transportation Office
(LTO), Department of Tourism (DOT) and the Local Government Units (LGUs).

SEC.9.2. Updated Bus Routes.– The bus routes of each bus types and individual bus will
follow with the updated bus routes provided in the website and in each bus station.
Updated bus routes will be applied 5 days upon the publication and general circulation of
the updated bus routes.

COMMON BUS STATIONS

SEC.10.1. Bus Stations.– The buses under this program shall only be allowed to use the
elevated bus terminal/bus station. The bus station is located in the area in which
designated route by the buses provided by the board. Each bus station may be used of
one, two or all of the bus type of the system depending on the routes prescribed.

SEC.10.2. Bus Station Specifications.– The bus terminal will be designed and
constructed through the existing laws on government projects. The minimum
specifications of the bus station will be as follows but not limited to:

a) 0.5m elevated platform with 20m in length,2m in width and 3m in height semi-
transparent covered path walk.
b) The structure must be made from a wind, storm and rain resistant materials to
combat the aforementioned
c) The bus station must be 1.2m away from the sidewalk or a designated spot must
be placed within the area determined by the DOTr.
d) Well ventilated lights especially in night time.
e) Loading Verification System
f) Standardized digital clock system
g) Instructions for the usage of the bus system which includes the routes, the fare
matrices and time of the next arrival.

SEC.10.3. Bus Stations Usage.– The bus station shall be the only loading and unloading
point of the bus under this program. The passengers shall fall in the line while waiting for
the bus to arrive. Each bus will be coming within the designed designated time interval.
The duration of each bus to stay in the station will depend on the seating capacity of the
bus, and availability of the passenger who is about to unload and load in the bus. Once
the seating capacity is already occupied, the passengers left will be waiting for the next
bus to arrive. Each bus will not accept standing passengers.

While waiting the bus to arrive, the passengers are expected to prepare their beep cards
and check its loading capacity to proceed to the desired destination by checking it
through the device located in each station.

Upon the bus arrives, the passenger shall use its beep cards to proceed and to enter the
bus premises by inserting it to the machine provided in the bus. Same is through when
unloading in
FARE MATRICES

SEC.11.1. Fare Matrices.– The Fare Matrices shall be determined and approved by the
Local Government Units (LGUs) and the Land Transportation Franchising and
Regulatory Board(LFRB) depending on the location, distance and origin of the station.

SEC.11.2. Fare Matrices Implementation.– The fare matrices will be posted in each
station, in the website, and in the loading centers including any updates and changes in
the fare matrices. Prices will be based upon the regular implementing routes with the
current bus matrix approved by the LTFRB. Premium prices shall only be designated of
using the Type A Bus or the Maharlika Bus for the tourists with the addition approval of
the Department of Tourism (DOT).

SEC.11.3. Fare Discounts.– The fare matrices provided are in the regular payment, and
with the 20% discount on students, senior citizens and disabled persons.

INFORMATION MANAGEMENT SYSTEM

SEC.12.1. Information Management System.– The Bus Transportation Management


System will be operated in the central command in the central station led by the
Department of Information and Communications Technology (DICT).

SEC.12.2. Functions.– To be able to run the program smoothly, the Bus Management
Transportation Board (BMTB) will develop an online management system in order to
provide an online and updated status of the bus transportation system running in the
program. The following would be the functions and roles of the management system but
not limited to:

a) Manage the operations of the bus in operations and bus in reserves


b) Develop an effective and efficient bus routes in the metropolitan Manila and in
highly urbanized cities
c) Create a fare matrix that is beneficial for the general public
d) Develop a support center for difficulties and inquiries of the public in their
conveyance
e) Manage the human resources and information provided to each stations
f) Coordinate the information to each accredited agencies in this program
g) Develop an efficient and effective manner in the fare collection and maintenance
expenditures of the program
h) Develop a website that will be the center for information, ticketing and general
purposes of the program.
i) Provide quarterly and annual report in the development and condition of the
information management system for transparency and accountability of the board.
j) Maintenance and upgrading the system from security breaches and compromising

able to identify the coverage of their routes. No name of passengers shall been collected
in this program.

SEC.12.4. Changes and Upgrades. Only the majority approval by the board shall
constitute the changes and upgrades of any segment of the information management
system which includes bus routes, fare matrices, processes and procedures and technical
operations of the program. Only the members of the board have the full access of the
information captured by the program.

SEC.12.5. Information Platforms. Maintenance and development of the website and


information platforms are also provided and managed by the board. This includes of
encouraging and convincing the general public to avoid private vehicles and support mass
transportation system.

EMPLOYMENT

SEC.13.1. Bus Employment.– The employment that will consists of the staff and the
employees of the Bus Transportation Management System (BTMS) will be hired through
the existing laws on government hiring of employees.

SEC.13.2. Employees.– To run smoothly the program, the BTMS will need employees
who will be working on:

a) The administration and the management of the general system


b) The ticketing system
c) The surveillance and GPS system
d) The technical and maintenance system
e) The program implementation and coordination system
f) Fare matrices and route management
g) Information Management System

Each designated bus will have one (1) bus driver who will take the maneuver of the bus,
and another employee which will be designated in each bus station that is assigned to
assist the bus driver and the passengers in riding the bus.

SEC.13.3. Compensation.– Drivers and staff are paid under salary with no compensation
linked to ridership, but with incentives with better customer services and minimal
accidents occurred within the operations. Salary and compensation procedures and
payments will be in accordance with the existing laws on government salaries and
compensations.

SEC.13.4. Driver’s Qualifications and Test.– All applicants must be a professional


driver with 3-5 years’ experience driving a bus, mechanical and technical abilities and
skills capable; and before acceptance, the applicants will undergo driver’s test to assess
its competency in driving bus in an actual road scenario. Only passers of the driver’s test
shall only be allowed to become a government bus driver.

PROHIBITED ACTS AND PENALTIES

SEC.14.1. Wrong Station.– Any passenger who unload with the wrong station will be
fined two hundred fifty pesos (Php 250.00).

SEC.14.1. Beep Cards lost.– Any passenger who lost the Beep cards during the trip and
cannot

fraudulent activities, usage of a special beep cards not intended for the passenger who is

SEC.15. Implementing Rules and Regulations – Within 90 days from the effectivity of
this Act, the Metro Manila Development Authority (MMDA) in coordination with the
Local Government Units (LGUs), Department of Transportation (DOTr) and its agencies
such as the Land Transportation and Franchising Regulatory Board (LTFRB), ,
Department of Information and Communications Technology (DICT), and other relevant
government agencies related to permits and licenses, shall promulgate the necessary rules
and regulations for the implementation of this Act. The implementing Rules and
Regulations must include, but not limited to determine:

The bus routes and placement of each bus stations with the respective cities, the
fare matrices of each bus routes, the guidelines on the usage of the Beep cards, and the
do’s and don’ts of using the system as a whole.
SEC.16. Appropriations. – The amount necessary to carry out the provisions of this Act
is hereby authorized to be appropriated in the General Appropriations Act of the year
following its enactment into law and thereafter.

SEC.17. Repealing Clause. – Any provision of law or regulations inconsistent herewith

SEC.18. Separability Clause. – If any portion of provision of this Act is declared void or
unconstitutional, the remaining portions or provisions hereof shall not be affected by such
declaration.

SEC. 19. Effectivity Clause. – This act should take effect 15 days after its publication in
the Official Gazette or in any two (2) official newspapers of general circulation.
