Night Ministry-1735 N Ashland

Plan of Operations

The 32 Ward Alderman, Scott Waguespack, and The Night Ministry have developed a Plan of
Operations ("Agreement") to demonstrate the proposed tenant's commitment to be a good neighbor.
The Night Ministry agrees to use good faith efforts to operate the Overnight Shelter in accordance with
the following provisions:

1. Plan of Operation

A. Standard of Care

The Night Ministry will operate an Overnight Shelter on the first floor of the property located at 1735 N
Ashland Avenue. The Night Ministry agrees to comply with all federal, state and local laws governing the
Overnight Shelter including, but not limited to, all regulations issued by the City of Chicago Department
of Family Support Services.

B. Number of Occupants

A maximum of 25 individuals will be allowed to reside in the Overnight Shelter on any given night.

C. Admission Criteria

Only individuals ages 18 through 24 will be allowed to reside in the Overnight Shelter. Staff will work
with clients to obtain a valid form of government identification.

The Night Ministry will conduct an intake assessment on every individual upon entry to the program to
determine eligibility and to verify their ability to participate safely in an emergency shelter environment.
Any individuals excluded in relation to these criteria will not be admitted to The Night Ministry program
and referred to appropriate services. These exclusionary criteria include, but are not limited to,
aggressive or violent behavior and registered sex offender status.

D. Hours of Arrival for Overnight Shelter

Individuals will not be admitted prior to 9:00 pm nor after 9:30 pm. Exceptions may be granted for
persons who are employed in a job that involves evening / late working hours, or for after-hours
referrals directly from the Department of Family Support Services. A monitored, indoor waiting area is
prOVided between 7:00-9:00 pm.

E. Dismissal

All individuals staying in the Overnight Shelter must depart the facility between the hours of 6:00 am
and 9:00 am.

F. Staffing

The Night Ministry staff will be on site at the Overnight Shelter any time clients are present in the
facility. Staff is present in other areas of the building nearly 24 hours per day.

G. Visitors
No visitors to clients will be allowed. The Night Ministry will agree to not seek residential parking passes
to serve the staff and/or clients.

H. Smoking

Clients will be allowed to smoke in a designated area in the north parking lot of 1735 N Ashland. Clients
will not be allowed to smoke in the interior of the building or the outside perimeter of the building,
including adjacent property, the sidewalk along Ashland Avenue in front of the building, or the south
parking lot. Clients will not be permitted to smoke after they have entered the program for the night. All
clients will be provided The Night Ministry's policy on smoking. Compliance will be monitored and
enforced.

I. Loitering

Loitering around the perimeter of the building and outside entrance will not be permitted by clients or
prospective clients.

J. Safety

Firearms, other weapons, alcohol, and non-prescribed drugs will not be permitted on site. Any person
found to be in possession of any such items will be asked to surrender the items. Upon commencement
of program operations at 1735 N. Ashland, perimeter grounds will be assessed daily for potential safety
concerns and litter.

Security cameras will be installed on the perimeter of the building and will monitor the sidewalks, alley
and parking areas on the Property.

K. Client Expectations

Clients at the Overnight Shelter are expected to abide by a code of conduct. The code is reviewed nightly
with all clients admitted for the evening. Clients who fail to abide by the code of conduct are subject to a
progressive disciplinary process that can range from a verbal warning through a temporary or
permanent suspension from services.

L. Amendment to Plan

The Night Ministry maintains a right to amend this Plan of Operation if required in order to comply with
local, state, and federal laws and regulations. Any other proposed amendments must be approved by
the Alderman with jurisdiction over 1735 N Ashland at the time of the proposed amendment.

2. Complaint Procedure

A. Any concerns related to the operation of the Overnight Shelter should be directed to:

or the senior executive in charge of program services.


B. The Night Ministry will immediately investigate any reported complaint and determine if it is linked
to The Night Ministry and/or one of its clients. If it is deemed a credible, founded complaint, The
Night Ministry will create and implement a Plan of Correction within seventy-two (72) business
hours of receipt of such complaint. The Plan of Correction will include a GO-day review of the
efficacy of the steps taken. In addition, The Night Ministry will communicate how this matter will be
resolved to the Alderman within seventy-two (72) hours of being notified of the complaint.

C. The Night Ministry will maintain a written log documenting all complaints raised by a member ofthe
community or the Alderman about The Night Ministry, as well as any police reports and internal
incident reports. This record will include a description of the incident, the name of the person
making the complaint, the date the complaint was made, a statement ofthe complaint, and a
written plan of action to address any legitimate, substantiated concern that is raised.

D. Digital copies of the current written log of community concerns maintained by The Night Ministry
will be made available to the Alderman upon request.

3. Dispute Resolution

A. The parties agree to work cooperatively in good faith to resolve any dispute that may arise between
the parties regarding the terms ofthe Agreement.

B. If, after written notice of the dispute, a reasonable opportunity to cure by The Night Ministry, and
consideration of the unresolved issue by the Alderman, the parties are unable to resolve a dispute,
The Night Ministry agrees to follow existing complaint procedures administered by the City of
Chicago's Department of Family and Support Services.

C. The Night Ministry agrees that ifthere is a failure to comply with the conditions specified by the
Zoning Board of Appeals at the time of approval, it will be necessary to apply for and be granted
approval of a new special use permit in compliance with the provisions of the Chicago Zoning
Ordinance.

4. Community Resource

A. The Night Ministry will commit, as in all communities in which it operates, to build ongoing
meaningful relationships in the surrounding community including, but not limited to, area schools, faith
communities, civic groups, justice systems, police and fire departments, hospital and health systems,
and neighborhood organizations to advance eVidence-based best practices for the
education/awareness, prevention, and intervention benefitting youth at risk of homelessness.

5. Miscellaneous Provisions

A. Term: The Agreement will take effect immediately, and will be renewed annually upon its
anniversary for five years. The Night Ministry agrees to participate in an annual review and
assessment of its compliance with this agreement, in collaboration with the Alderman's office. After
the initial five years, the Alderman retains the right to renew the Agreement annually for up to an
additional five years. IfThe Night Ministry ceases operating the Overnight Shelter at 1735 N.
Ashland, this agreement will terminate on the date operations cease.

B. The Parties reaffirm that no provision of this Agreement is intended to discriminate against
applicants to, or residents of, the Overnight Shelter. No provision of this Agreement shall be
implemented in a fashion that amounts to discrimination against such applicants or residents. Any
provision of this Agreement that is later found, by a court or agency of competent jurisdiction, to be
discriminatory, shall be rendered void and severable from this Agreement.

C. The terms of this Agreement constitute the entire Agreement and no other provisions will govern
the communication between the parties or the commitments made herein. This Agreement can only
be amended in writing with the agreement of both The Night Ministry and the Alderman. The
parties have caused this Agreement to be executed by their duly authorized representatives and this
Agreement shall be effective as of the latest date written below.
