THIS IS THE STATEMENT OF LYDIA A. LUGAGAY, OF LEGAL

AGE, MARRIED, FILIPINO, AND A RESIDENT OF MABINI STREET,
BRGY. ZONE III, DIGOS CITY, DAVAO DEL SUR, IN COMPLETE
CONTROL OF HER MENTAL FACULTIES, CONSCIOUSLY,
WILLINGLY, AND KNOWINGLY GIVES HER STATEMENTS UNDER
OATH, BY PROS. BLAIR M. DURA, ASSOCOATE PROSECUTION
ATTORNEY OF DIGOS CITY PROSECUTOR’S OFFICE, AND TAKEN
AT THE NEW HALL OF JUSTICE BLDG., CHRISTIAN VILL., APLAYA,
DIGOS CITY, DAVAO DEL SUR.

I, LYDIA A. LUGAGAY, AM ANSWERING THE QUESTIONS OF

ASSOCIATE PROSECUTOR DURA FULLY CONSCIOUS THAT I DO
SO UNDER OATH AND MAY FACE CRIMINAL LIABILITY FOR
FALSE TESTIMONY AND PERJURY. (Ako si LYDIA A. LUGAGAY,
mitubag sa mga pangutana ni prosecutor Dura, puno sa kahibalo nga akoang
kining gipatigayun ilawom sa pagpanumpa sigon sa balaod ug mamahimo
mag-atubang ug kasong criminal sa bakak nga testimonya ug
pagpamamkak).

 A: Bisaya Sir. (visayan Sir)

2. Q: Matud nimo ang imong ngalan kay LYDIA A. LUGAGAY,

unsa imong katuyuan sa paganhi diri? (You said that your name
is LYDIA A. LUGAGAY, what is your purpose in appearing
here?)

A: Ako ang biktima sir motestimonya ko karon. (I am the victim

sir I will testify here now)

3. Q: Unsa ni kabahin imong testimonya? (What will you testify to?)

I-istorya sa imoha sir kung giunsa ni Ricelyn pagyatak sa

A: akoang kadungganan. (I will tell you sir how Ricelyn
besmirched my reputation)

A: Adtong January 28, 2012, sa buntag. (on January 28, 2012 in

the morning)

A: Sa akong balay ug karenderia sir.(At my house and eatery sir.)

6. Q: Asa ni dapit imong balay? (Where is your house located?)

Doul sa balay nako sir akoang bana-bana mga pulo kadupa

A:
gikan sa akoang balay (Near my house sir approximately
around 10 fathoms from my house)
8. Q: Unsa ang nahitabo niadtong buntag sa January 28, 2016?
(What happened in the morning of January 28, 2016?)

Gisulong ko ni Ricelyn. (Ricelyn confronted me)

9. Q: Unsa pa man iyang gibuhat sa imoha pagsulong niya? (What

did she do when she confronted you?)
A:
Gisingit-singitan ko niya. (She shouted at me)

10. Q: Unsa iyang gisinggit diha sa imoha? (What did she shout about
yous?)

Gisinggitan ko niya mga law-ay nga pulong. (She shouted at

Pinasyagit sya miingon ug “IMO GI PIKPIK ANG BONA

BONA SA IMONG KINATAWO ATOBANGAN SA
AKOANG AMAHAN NGA NALIGO ARON MATINTAL” ug
“BAGA KA UG NAWONG KABIT KA SA AKONG
AMAHAN”. (She shouted saying “You pat your mons pubis in
front of my father while he is taking a bath, so that he will be
tempted” and “You brazen-face, you are mistress of my
father”)

12. Q: Unsa unsa katinood ni iyang mga gipamulong? (How true are
these utterances of hers?)

Dili gyud na tinood nga kabit ko ug nagpikpik-pikpik ko sa

akoa kinatawo, fiscal, katigulang na nako para mag ingon-ana
ko. (It’s not true that I’m a mistress and I pat my genetalia,
fiscal, I’m too old for that)

13. Q: Unya nganong nikiha man ka nga dili man kaya ni tinood?
(Then why did you sue her, if these utterances were not true?)

A:
Ulaw kaayo fiscal oi daghan kaayo naminaw tao sulod sa
karenderia ato panahuna. (it’s very embarrassing fiscal, there
were people inside my eatery, who listened that time)

14. Q: Unsa imong imong ghibuhat human ato nga panghitabo nga
gipakaulawan ka? (What did you do after that incident where
you were embarassed?)
A:
Gipatawag nako sya sa barangay. (she blushed).

15. Q: Unsa nahitabo didto sa barangay? (What happened in the

barangay?)

Walay nagkahusay didto, mao na gi-issuehan ko’g file action

A:
(No settlement there, so I was issued certificate to file action)

16. Q: Naa kay gi submit diri nga certificate to file action, tan-awa ni
palihug, isulti ug unsa kalabotan anis sa file action nga imong
giingon? (There is a certificate to file action you submitted
here, please take a look at it, and tell us what is the relationship
of this to the “file action” you earlier said?)
A:
Mao ang giissue sa barangay ato wala gyud mahusay. (This is
the one issued by the barangay when there was no settlement)

Kung makit-an nimo pag-usab si Ricelyn maka-ila bah ka sa
iyaha? (If you shall see Ricelyn again, would you be able to
identify her?)

A:
Oo sir. (Yes sir)
