do hereby SELL, TRANSFER, and CONVEY, absolutely and unconditionally, unto the
said JASON F. TORIBIO, his heirs and assigns, that certain parcel of land situated in Mercedes,
Zamboanga City, and more particularly described as follows, to wit:

A parcel of land (Lot 190-C-5-F-1), (Lot 190-C-5-F-3), (Lot 190-C-5-F-4) and (Lot 190-
C-5-F-5) of the subdivision plan, Psd-09-049699 being a portion of Lot 190-C-5-F, situated in
brgy. of Mercedes, City of Zamboanga with a total land area of four hundred twenty (420) square
meters, the metes and bounds of which is more particularly described in TCT no. T-161,651 A
TOTAL PORTION OF TWO HUNDRED SIXTY (320) SQUARE METERS.

of which WE are the true owners having acquired the same through purchase, per Deed of
Sale hereto attached.

That we hereby warrant the vendee of peaceful possession over the property herein sold,
and the same is free from any liens and encumbrances.

PARTITION AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:

This PARTITION AGREEMENT made and executed this ______________________ at Zamboanga


City, Philippines, by and among:

NATIVIDAD TARROZA PERAS, married to Anecito C. Peras, LucilaTarroza Mercado, single, and
Alex Burgos Tarroza, single, all of legal age, Filipinos and a resident of Cabato Road, Tetuan, Zamboanga
City hereinafter referred to as the “FIRST PARTIES”;

JASON F. TORIBIO, of legal age, Filipinos and resident of Baliwasan, Zamboanga City, Philippines,
hereinafter referred to as the “SECOND PARTY”;

WITNESSETH:
WHEREAS, the “First Parties” acquired a portion of land lot 190-C-5-F located in Mercedes
embracing TCT T- 161,651 to Luz Rodriguez registered owner of the Lot by virtue of a deed of sale
duly notarized by Atty. Eduardo I. Ledesma with Doc. No. 26, Page no. 7, Book. No. XXVI dated
July 22, 2003 at Zamboanga City in the following manner to wit:

WHEREAS, the First Parties have sell, transfer , and convey, absolutely and unconditionally,
unto JASON F. TORIBIO, “Second Party” their heirs, and assigns, that certain portion of the parcel
of land situated in Mercedes by virtue of a Deed of Sale duly Notarized by_______________with
Doc. No._____, Page no.________, Book no. dated ______________ at Zamboanga City.

WHEREAS, the remaining portion shall be named and assigned mentioned in the above Deed
of Sale duly notarized by Atty. Eduardo I. Ledesma,

WHEREAS, the First Parties, have caused the survey subdivision of into Eight (5) resultant lots
as evidence of an approved subdivision plan and technical descriptions;

NOW THEREFORE, premises considered, the parties have agreed, as they do hereby
adjudicate and partition between themselves the above described parcel of land, in the following
manner, to wit:

I have the honor to petition for the cancellation of the annotation of the legal
encumbrances/lien appearing on the face of the attached Transfer Certificate of Title No. T-
161,651 which read; “the liabilities imposed by section 4 Rule 74 of the Rules of Court”, inasmuch as the
two-years period has already expired since the issuance of the present title without anybody having
presented any claim whatsoever against the property from April 5, 2002.
