FILED MAR_08 2019 No. 2017 PC 2912 a NESS IN THE GUARDIANSHIP OF § IN THE PROBATE COURT ™ CHARLES INNESS THRASH 7 NO.1 AN INCAPACITATED PERSON 7 BEXAR COUNTY, TEXAS REPORT OF THE COURT INVESTIGATOR Pursuant to §1202.051 and 1202.054 of the Texas Estates Code, now comes Elaine Damian, Court investigator, Probate Court 1, Bexar County to present the findings of the investigation into the circumstances of Charles Inness Thrash ordered on February 5, 2019. ‘Summary of Findings epartoftie Go Mr. Thrash does not want to get married and does not want to marry Laura Martinez Mr. Thrash does not have a problem with the guardianship as long as he is able to work in his shop Mr. Thrash is fond of Tonya Barina, Guardian of the Estate, but does not want to “hang out” with her every day. Mr. Thrash is not in favor of the sale of any of his planes, cars, hangar, or automotive businesses. Mr. Thrash likes the Guardian of the Person, Mary Werner. He stated that she “had a nice smile” and was “nothing like Laura had told him.” He is not opposed to having her as Guardian of the Person. Mr. Thrash met attorney Phil Ross through Deborah Woltersdorf. She met Mr. Thrash at the funeral of an old friend. She put Laura Martinez and Phil Ross together so that Phil Ross could represent them. She has been giving Laura Martinez and Mr. Thrash legal advice and told Laura that Mr. Thrash did not have to go with the Guardian of the Person and that notice was required in order for the Guardian of the Person to visit or ick up Mr. Thrash, Ms. Woltersdorf contacted me and said that | could not request that the Guardian of the Person bring Mr. Thrash to my office for a discussion without notice. She has been representing herself as the “AG's office”. She is employed as a legal assistant in the Attorney General of Texas office. Laura told me on our first visit, February 15, 2019, that the AG's office told her that the guardianship was unlawful. Ms. Woltersdorf advised Laura Martinez to follow the Guardian of the Person and Mr. Thrash to the courthouse wien he came to see me on March 1, 2019. Laura Martinez followed Mary Werner and Mr. Thrash to the Bexar County courthouse over the objection of Mr. Thrash as per the instructions of Ms. Woltersdorf. estiglor 2017 PC 017 Charles mest Trash Paget* Mr. Thrash has a fondness for his stepdaughters, Laura and Donna. Every time we have discussed Donna in particular he has said, “I don’t mind her; | raised her.” ‘+ Mr. Thrash considers all of the cars at his home, other personal property, the real Property to be his as his sole and separate property including the Corvette claimed to have been purchased as a gift for Laura Martinez. He said he bought i, it's his, and he will let her drive it, but is careful about putting miles on it because it will affect the resale value. * Mr. Thrash has friendships that have lasted for decades. With the exception of one, Billy Duncan, all that have spoken to me have all been unable to communicate with or see Mr. Thrash without interference from Laura Martinez. * Brittney Martinez confirmed that her mother, Laura Martinez contacted all of the women that Mr. Thrash knew, including his longtime bookkeeper and told them to stay away and not to contact Mr. Thrash. Brittney said it was because “all those women wanted relationships with Charlie.” Mr. Thrash told me that he was contacted initially by some of those women who told him Laura Martinez had told them to stay away and that “Laura was crazy.” Mr. Thrash showed me a race car that he purchased where the name of the previous driver's name “Rose” was scratched off by Laura Martinez. (See Exhibit A). Mr. Thrash told me several times that Laura was “very jealous”. * Mr. Thrash is a frugal business man. He has a reputation for never giving anything away for free. He never performed a job for free or at a discount, not even for family members or friends. This was reported to me by many friends. Mr. Thrash confirmed this, © Mr. Thrash told me he never allowed Mario Martinez, Sr. to move above the shop; “He just moved in”, Mario Martinez, Sr. was supposed to pay Mr. Thrash rent but never did. © Mr. Thrash would like to renovate the upstairs apartment so he has a place to live in the event “things do not work out between me (Mr. Thrash) and Laura (Martinez)” * Mr, Martinez, Sr. destroyed the apartment that will now require renovation. He also destroyed Mr. Thrash’s 1932 Ford Roadster during a drunken driving accident. Mr. Thrash never gave Mario Martinez, Sr. permission to take the vehicle. The value of the vehicle at the time is estimated to have been $100,000. (See Exhibit 8) © Mr. Thrash told me that it was better that the Martinez family did not work in his automotive shop because they were very “messy” and “were not much help anyway’. He said he “was glad they (Martinez Family) did not come with us to my shop today (February 27, 2019)". When Mr. Thrash and I visited the shop, Mr. Thrash determined that the axels Laura told him had been stolen were not stolen. He told me that “they were in order and not at all the Laura described.” into his apartment ‘Report ofthe Court Investigator 2017 PE2012 Charles laness Thrash Page?© Mr. Thrash had a thriving business for over 50 years and was the sole proprietor. The Charlie Trash Automotive shop was not a “mom and pop” shop. In one year under the direction and control of Laura Martinez and her children and ex-husband the business lost a net profit of over $30,000. '® Mr. Thrash’s bookkeeper since 1992-2017 was not fired by attorney Tom Bassler, but stopped working for Mr. Thrash because of the verbal abuse she received from Laura Martinez and because she did not like the way Laura Martinez was taking advantage of Mr. Thrash. This was corroborated by multiple contacts including Ms. Joan Ramos, the bookkeeper. '* Multiple contacts reported to me seeing significant bruising on Mr. Trash’s bicep that was caused by Laura Martinez “punching him in the arm”, Mr. Thrash confirmed that Laura Martinez has hit him in anger and that it was stil a possibility that she would continue to do so. ‘* When Mr. Thrash saw Tonya Barina at the shop on February 27, 2019, they hugged. Without prompting, Mr. Thrash asked about her dad, Travis Thrash and asked how he had been, Tonya said that Travis would like to see Mr. Thrash and “hang out”. Mr. Thrash said he would like to do that. Mr. Thrash told Tonya Barina he was doing a good job and he would like to come back soon to the shop. Ms. Barina said, “Anytime.” ‘There is an ongoing criminal investigation into the possible threat of arson on Mr. Thrash’s hangar and airplanes. When Mr. Thrash was asked about the conversation, he first denied that Laura was talking to anyone and offered that the person must have overheard a movie he was watching called Lincoln. Later that same day, Mr. Thrash reported that Laura Martinez "may have been talking to some guys.” © Mr. Mario Martinez has at least two emotional disturbance incidences that occurred at ‘Thrash Automotive while Mr. Thrash was present. ‘© Joe Martinez is a 27 year old adult male with schizoaffective disorder and is living with Mr. Thrash. Joe Martinez does not pay rent or buy food or sundries for anyone but himself. Joe Martinez receives social security disability payments and Medicaid. His mother describes Joe Martinez as an “entrepreneur” because he goes to parking lots and opens people's locked vehicles with his slim-jim for $50 each. Laura Martine: that the guardianship is putting stress and strain on Joe Martinez and it is affecting Joe Martinez’s mental stability, ¢ The Guardian of the Person, Mary Werner told Mr. Thrash and Laura Martinez that Mr. Thrash was not to leave Bexar County without the knowledge and permission of the Guardian of the Person. On at least five (5) separate occasions attorney Phil Ross and Laura Martinez have taken Mr. Thrash outside Bexar County without the knowledge or permission of the Guardian of the Person.
