In accordance with the Administrative Procedures Act, N.C.G.S. Chapter 150B, you are
hereby notified that the North Carolina Real Estate Commission (hereinafter “Commission”) has
received information which, if true, may warrant the suspension or revocation of your real estate
broker license or the issuance of a reprimand or censure to you, pursuant to N.C.G.S. § 93A-
{6(a)(1), (2), (3), (7), (8), (10), (12), and (15); and N.C.G.S. § 93A-6(b)(1); and 21 N.C.A.C. 58A
.0104, .0108, .0116, and .0117,
Information before the Commission tends to show that:
(1) Atall times material hereto, SHAWN THOMAS JOHNSON (hereinafter
Respondent") was licensed by the Commission as a real estate broker, holding license number
285346. Respondent engaged in the general real estate brokerage and property management
business in and around Buncombe County, North Carolina,
(2) Onor about October 15, 2014, Respondent applied for a broker's license on
provisional status. On his application, Respondent certified that:
(a) he resided at 1070 Tunnel Road, No. 241, Asheville, North Carolina
(hereinafter “1070 Tunnel Rd”) from July 2009 through October 2014;
