ADMINISTRATIVE LAW-I

Instructions:-
1. Answer any five questions.
2. Question number one is compulsory.
3. All questions carry equal marks.
4. Support your answers with relevant statutory provisions and judicial pronouncements.

Q.1.Give reasoned answers of the following supported with case law:- ( 2x8=16 )
A) The Commissioner of fisheries was in the capacity of Chairmen of Regional Fishery Authority and in
his capacity as a Chairman of the Regional Fishery Authority he granted the lease of a government lake, for
the purpose of fishing in favour of ‘X’ Co-operative Society of which he was also the member. Another Co
operative society ‘Y’ objected the grant of lease to the ‘’X’’ Co operative Society. Suggest the grounds for
challenging the grant of the lease.
B) ‘J’was a student of Mahatma Gandhi College of Arts. Two girl Students ‘K’and ‘L’ complained against
‘J; that he had misbehaved with them on the day of annual function. The Principal of the Collage’ ‘M ’
Constituted an inquiry committee to look into the allegations. The Committee constituted by the College
recorded the statements of the girls. Copy of the statements of “K’ and ‘L’ were given to ‘J’. ‘J’was given a
chance to deny the allegations also . Finally, the committee found ‘J’guilty and he was expelled from the
college. ‘J’ is not satisfied with the report of the inquiry committed as the opportunity to cross examine was
not given to him by ‘K’and ‘L’. ‘J’ challenges the inquiry report in the court. Will ‘J’succeed? Explain.

Q.2. Discuss Dicey’s Concept of Rule of Law and its reconciliation with the growth of administrative
process.

Q.3. “ Every Delegate is subject to the Authority and control of the principal and the exercise of delegated
power can always be directed, corrected or cancelled by the principal. Hence parliamentary control over
delegated legislation should be a living continuity as a constitutional necessity.”Comment.
