A supplementary affidavit filed today is taken on record.

An order has been passed against the petitioner which is impugned


herein whereby a direction has been issued by the State
Government that no medicines shall be purchased by any
department in the State of U.P. on account of the petitioner's
involvement in the NRHM scam.

Learned counsel for the petitioner Sri Manish Singh submits that
the aforesaid order was passed in the wake of arguments without
taking notice of the fact that the Investigating Agency, namely, the
Central Bureau of Investigation has already submitted a closure
report in relation to the case in question whereby the petitioner-
firm was mentioned as one of the accused along with its Director.

The said closure report has been ultimately accepted on


26.10.2015 and a certified copy of the order of the trial court has
been placed before us.

In view of this development during the pendency of the writ


petition, we provide that the respondent- State Government shall
now revisit the matter in relation to the ban which has been
imposed by the State Government under the impugned order
keeping in view the aforesaid fact of the closure of the criminal
case against the petitioner which was the basis of the earlier order.
The State Government shall take a decision as expeditiously as
possible preferably within six weeks from the date of production
of a certified copy of this order before it.

Disposed of with the aforesaid observations.
