Introduction
Travel and tourism are one of the successful industries in the world. The sector is earning much
revenue by offering needed goods and services to people in terms of accommodation,
transportation, foods and others. As organizations operating in this sector are concerned with
providing different services, they need to obey some policies and regulations. The study on
legislation and ethics will be performed in relation to Titan Travel, which is a successful tour
operator of the UK. The report includes the legal framework suitable for the tourism industry. The
regulations related to health and safety will be discussed in the study.

Task 1
1.1 – Explain the legal and regulatory framework of the travel and tourism sector with
reference to England and Wales

The regulatory framework represents some sorts of policies, rules and norms for organisations,
tour operators and travel agencies. The following regulatory and legal framework of England and
Wales are applicable for the retail travel consultants.

Regulatory Framework

It involves the legal bodies and authorities that facilitate smooth implementation of norms.

 Strategic Rail Authority: It was formulated under Transport Act, 2000. The purpose of this
regulatory body is to give strategic and legal direction to the railway sector. It is
accountable for the developmental activities of rail networks in England and Wales. It
interacts with local transport authorities for the growth of the rail network.
 Health and Safety Commission: Safety executive and commission work under Department
of Pension agencies to provide good health and safe environment for people working under
the travel and tourism sector. This regulatory body works for reducing work-related death
in workplaces.
 Maritime Authorities: Maritime and Coastguard Agency works in association with
Government of UK in order to implement maritime safety norms. It oversees the
application of safety rules the prevent death near sea areas. It provides 24*7 search and
rescue service near coast areas (GOV.UK, 2109).
 Civil Aviation Authority: It is the UK’s professional aviation regulator. The responsibilities
performed by this regulator body are economic regulation, consumer protection, air safety,
environmental research and others (Caa.co.uk, 2019).

Legal structure

The legal structure represents the presence of different courts for handling legal matters. These
courts hear all the legal issues arose in organisations and stated their final judgement.

 Supreme Court: It is the highest court present in England and Wales. The decisions made
by this court cannot be replaced by other courts present beneath it. It has no power to upend
a statute.
 Court of appeal: The justice decisions are obligatory for all lower courts. The future
settings made by the Court of Appeal are obliged by them
 High court: Judges of high court oblige to all judicial decisions made by the Court of
Appeal and high court. Lower courts follow the decision taken by high courts.

1.2 – Discuss surface, sea and air transport law about the carriage of passengers within the
legal and regulatory framework of the United Kingdom.

The laws related to sea, surface and air transport followed under the legal framework of the UK
are as follows.

Carriage of Passenger by Road Act 1974

The convention applies to all contracts under the carriage of passengers along with the transfer of
their luggage by roads (Legislation.gov.uk, 2019). It applies to the situation, where the carrier is a
public or state body. The purpose of this Road Act to give jurisdiction to different courts to handle
road transport disputes. The Act entitles ways of resolving issues related to carriage of passengers
by roads. The rights and liabilities of an individual are a transfer of passengers, and their luggage
are mentioned in this Act. Individuals can complain of the injury and death to them, and loss and
damage occur to their luggage.

Hague (1955)

It establishes some protocols concerned with International carriage by air. It was added to the
protocols established by the Warsaw Convention. As per this convention, commercial airlines are
responsible for taking actions or measures in the occurrence of an accident. The general duties
under this convection involve considering the interest of individuals travelling, owners and
operators of aircraft and others associated with the carrier. The purpose of this convection to
provide air traffic services from the place passengers have booked.

Task 2
2.1 Evaluate the impacts of the principles of health, safety and security legislation on the
travel and tourism sector

The principles of health, safety and security are as evaluated below.

Health and Safety Act of 1974

The board duty of Titan travel under this Act is to follow certain health and safety practices in the
workplace. As per the principles were written under this legislation, it ensures that all workplace
systems are working properly. The purpose of this Act is to keep the work environment free from
risk (Worksmart.org.uk, 2019). The parameters of a healthy working environment such as
ventilated, hygienic and warm are maintained. The equipment and tools are kept up to date as per
the latest standard. The organisation makes employees aware of safe working practices and safety
policies. It employs safety and health advisors for overseeing all safety practices implemented
within the workplace. The Act is effective in managing health and safety practices in the
organisation, but its implementation cost is so high.

2.2 Analyse legislation that relates to equality with reference to a UK tour operator and travel
agency.

Following legislation are designed under the parliament of the UK to promote equality in the
workplace.

Human Rights Act of 1998

The Act states that individuals can defend their right in their respective organisations. They can
claim for getting right if their employers are not providing them with rights covered under this
Act. The purpose of human right legislation is to create awareness among employers to treat every
employee equally with respect, dignity and fairness (Legislation.gov.uk, 2019). Titan Travel has
implemented the principles of the Human Right Act in order to promote and develop an
outstanding culture of individual right. Titan Travel gives employees the right to make their own
decisions. The Act also provides some other categories of rights such as group, individual,
political, civil and cultural.

Equality Pay Act of 1970

The Act was introduced to prevent discrimination in terms of the employment condition provided
to both male and female employees. Both genders are being provided with favourable treatments
under similar nature and types of jobs. The Act does not relate to any other grounds of
discrimination including religion, race and others. Titan Travel has inserted an equality clause in
the employment contract provided to women. The three bases for comparison are considered to
reduce the pay-related discrimination such as a job for equal value, like job and job rated as
equivalent (Legislation.gov.uk, 2019). If any employee is not getting equal pay than that of his or
her co-worker, working under any of these three bases can lodge a complaint against the employer.

Disability Discrimination Act 1995

The Act reveals that it is unfair to discriminate individuals against their disabilities. Any mental
or physical impairment influencing the ability of a person to perform a job and carry out daily
activities is being considered under this legislation. The types of discrimination covered in this
legislation are harassment, victimization, direct discrimination, disability related to discrimination
and others (rnib.org.uk, 2019). The Act is implemented within Titan Travel to make some special
arrangements for disabled people and providing them with equal training opportunity, incentives
and other aspects.

Equality Act of 2010

The Act simplifies the sex discrimination Act, Disability Discrimination Act and others. It came
into the picture in October 2010 (GOV.UK, 2010). It has covered some protected characteristics
such as civil partnership, sexual orientation, gender reassignment, religion, gender and age. Under
the provision of this Act, Titan Travel needs to avoid any direct and indirect discrimination. It is
accountable for making adjustments for people having some sorts of disabling characteristics.
Titan Travel has provided employees with the right to communicate if they are facing any
discrimination during their work. Equality Act gives employees more opportunities to understand
their right and help others to know their employment right. However, a high level of awareness
needs to be created to understand the principles Equality Act. The implementation cost associated
with this legislation is also high.

Task 3
3.1 Explain contract legislation in relation to travel and tourism customers

The Contract Legislation is the contractual laws and policies regarding the travel and tourism and
the easy they have been representing their company in the fields of tourism (Lyu, 2018).The
various specification in relation to the travel and tourism to maintain the transportation of the
travellers, their time of arrival and departure. The various details of the customer of Titan Travel
to travel place are related to the contract legislation. The breakage of any rules or laws can be
legally punished along with the diminishing of the travel and tourism organisation forever. The
customers ending the contract will also make the organisation loss money, investments, and
discontinuation in their work procedures. The various elements, which are related to the contract
legislation of the travel and tourism. They are as follows:

Travel plan or format for Titan Travel: The Tour operator and the tourists make a bond in
regards to the travel and tourism department. There are many offers, which are suggested by the
tour operator, and the travellers accept. The acceptance leads to the execution of the plan and
therefore they have to make the plan according to that and set the prices in regards to that.

3.2 Explain consumer protection legislation in relation to travel and tourism customers.

The Consumer protection legislation is the one, which are the rules and regulation set, are made to
save the rights and interest of the consumers in support of the tourists in case of the travel and
tourism sectors (Howells and Wilhelmsson, 2017). The Consumer protection law are made in such
a way that the breakage of the laws can make them follow cases of lawsuits which can hamper
their organisational processes and also invest in high compensations to cover up their drawbacks..

The laws and legislations follow in the travel and tourism department are as follows:

The Trade Description Act of 1968: The implications of wrong doings and placing wrong prices
to the services to mislead the clients or the consumers especially related to the accommodations
facilities. In this case there have been many cases where the officer of trading are there for
inspection and they are caught red-handed which leads to serious cases file against the organisation
which can led to the complete diminishing of the company.

The Consumer Protection law of 1987: The law emphasizes on the clear information given to
the travellers so that they can be knowledgeable split their contract and the prices related to the
goods and services provided by the company is genuine or not (Boush et al.,2015). The many
business practices, which are unlawful, are also managed by these laws, which are

 The genuineness in the Product quality
 The breakage of laws and regulations

Introduction

There are many situations where the travellers have to think about the ethics and values been when
they are travelling to other countries for just a couple of days and therefore they have to follow
many ethical values to cope up with the various situations. Thomas Cook is one of the major UK
based travel and tourism companies that carry out different operations and certain ethical dilemmas
and linguistic differences are seen in their business processes. The same thing does fir the
organization; as well, they have to fall under complex situations while taking care of the provisions
of the customers.

4.1 Analyse ethical dilemmas faced by the travel and tourism sector.

The hospitality service is the ones, which are affected by the various ethically surrounded issues
these services related to the catering of the provisions incusing the goods and commodities they
are providing to the customers. The hospitality services also includes in the relations to the
accommodations and the safety and security of the travellers. According to the law, The Consumer
protection Law 1987 ( Riefa, 2016).The safety and security of the travellers are the main things
they should always be concerned with the safety and security is the most common issue all the
travel and tourism sectors are following and is one of the critical tasks to handle by the travel and
tourism sectors.

4.2 Analyse the Corporate Social Responsibility (CSR) policy of a specified travel and
tourism business

The Corporate Social Responsibility relates to the operating of the function along with the
awareness of the social features and factors related to the factors of that they can be affected on
the environment and the social life of the people. The Titan travels have been one of the
organisations, which made their policies and legislations according to the corporate social factors,
they should look after and also kept their stakeholders and collaborate informed about all the
changes they have made (Grayson and Hodges, 2017).

The Titan Travels have been the one of the leading UK Travel and Tourism Business and have
been following the business of travel and tourism business sectors for more than thirty years. They

follow transparency policy with their constant travellers and clients so that there is better
communication and transparencies and they have made polices to keep transparency among the
changes they are making with the stakeholders and the partners they have been building their
relationship with (Yakovleva, 2017). They have maintained these policies because they wanted to
make their impression on the market economy in the most possible way and in a greater way
therefore to make their processes international in massive in their processes. The company also
issues separate Social department and from there the company issues massive a report which
reflects the awareness of the being socially responsible in their operational processes and activities.

Conclusion

The safety and Security of the women is most important between the safety and security of the
explorers or the travellers. The safety and security of the women is very necessary for the
organisation to look after otherwise the impression and the brand image of the company will get
affected. The Socially Responsible Sectors and Corporate Sectors should look after the
preservation of the natural resources along with processing their operational activities. The
Corporate Social Responsibility that they should operate their travel and tourism businesses such
way that they protect their natural resources and conserve the resources future generations which
will also make their company a sustainably aware company.
