Kenwood Blvd. Milwaukee, W1S3211 mdjung@uwm-eda Re: Response to Public Record Request Dated October 31, 2018 Mr. Jung: This letter will serve as a response to the public records request you sent on October 31, 2018 to the Kenosha County Sheriff’s Department (*KSD”) for copies of all ICE detainers placed on an inmate from the Kenosha County Jail from January 1, 2014 to present. You specifically asked for the name and date of birth of any inmate and the aggregate number of ICE detainers in the jail for the same time period. ‘Your request’'seeks information that is exempt from disclosure pursuant to Wis. Stat. § 19.36 (1)-(2) since the records contain detainee information that KSD is prohibited from disclosing under State and Federal Law. See 8 C.P.R. § 236.6 See also Voces De La Frontera, Inc. v. David A. Clarke, Jr, 2017 WI 16, 373 Wis. 2d 348. This request should therefore be sent to I FOTA@adhs.gov or faxed to ICE FOIA at (202) 732-4265. A copy could also be mailed to U.S. Immigration and Customs Enforcement, Freedom of Information Act Office, 500 12" Street, S.W., Stop 5009, Washington D.C. 20536-5009. In an effort to be responsive, Sheriff Beth located a document showing the aggregate number of ICE detainers in the jail for the requested time period. A copy of a spreadsheet with this information is attached. The names and dates of birth have been redacted as required by law. There were eighty-six (86) detainers during this time period. ‘The law permits Sheriff David Beth to impose fees for certain “actual, necessary and direct” costs associated with responding to public records requests. Wis. Stat. § 19.35(3). This includes, but is not limited to, copying and location fees. In this instance, as a courtesy, Sheriff Beth is waiving the fees involved.
