RESOLUTION

This resolves the herein complaint filed by Ma. Lorebel Balbuana y Bael
against William Burerus a.k.a. “Willy” of Barangay Cambanjao, Bais City for Rape
which is punished under Article 266-A par 1 (a) of the Revised Penal Code.

The facts are stated as follows, to wit: That in the afternoon of April 16,
2014, Roselyn Balbuena y Bael, 15 years old, and a resident of Sitio Tinago,
Poblacion, Amlan, Negros Oriental went to the residence of her uncle Joecil
Balbuena at Barangay Cambanjao, Bais City to retrieve articles of clothing and
other personal effects that she had left days prior and also to visit her relatives
and friends as she frequently did in the past.

That on or about 9:00 in the evening of the same date, Roselyn, together
with her friend Meme, took their time and watched a volleyball game at
barangay proper. Roughly a hour later, Roselyn and Meme went to the latter’s
place of residence since Roselyn’s uncle Joecil was not at home yet going over to
Sitio Mag-iba. That while at the house of Meme, another uncle of Roselyn, the
half brother of her biological father named William Bureros came over and
declared to transport Roselyn to her place of residence in Amlan, Negros Oriental
but the latter declined the offer. That having said no to the offer, William
Bureros, or “Willy” as he is commonly known, became infuriated and grabbed the
hands of Roselyn forcing her to straddle to his service motorcycle and put the
vehicle in motion.

That while already travelling the National Highway, and upon reaching
Tanjay City at about 10:45 in the evening of the same date, William Bureros
suddenly made left turn to the barangay road adjoining Brgy. Luca and Brgy. San
Isidro and drove off into the sugarcane plantation stopping near rail track and
blurted, to wit: “Karon kay walay makadungog nimu” and took her cellphone.
That William Bureros then imposed his will upon Roselyn by forcibly taking off
her clothes and raped her to which he succeeded despite a serious resistance
from Roselyn by pinning Roselyn into the ground and mounting himself on top
of her after removing his trouser and brief, then inserted his penis into the
vagina of Roselyn doing a pumping motion.

That after Willy was done satisfying his bestial desire, Roselyn gathered
her clothes and put them back on but Willy tried to undress her again but the
latter managed to free herself from the former’s grasp and ran off continually
shouting for help and upon reaching the barangay road, she flagged down and
incoming motorist who happens to be a police officer, P01 Banedict James C.
Banaag, assigned at Bais City Police Station, who was then with her girlfriend.
Roselyn confided here ordeal to the duo and both willingly extended their help
and assistance coming with Roselyn to back track to the place of incident in
search of Willy Bureros and the slippers she left behind.

P01 Banaag, his girlfriend, and several bystanders went with Roselyn in
tow to search for Willy but to no avail as apparently Willy had already fled the
area and eluded arrest. Thereafter, P01 Banaag and his girlfriend brought Roselyn
to the Tanjay City Police Station whereupon the incident was recorded in the
police blotter.

The following day, Roselyn was submitted for physical-medical


examination with City Health Officer, Ma. Elizabeth T. Sedillo, MD., conducting
the examination and with the IMPRESSION: “Medical Evaluation is compatible
with blunt force injury, sexual abuse”.

From the foregoing recitation of facts and evidence on record, we are of


the honest opinion that the crime has been committed and that the respondent
is probably guilty thereof to warrant indictment.

ACCORDINGLY let information of RAPE under paragraph 1 of Article 266-A


of the Revised Penal Code in relation to R.A. 7610 be filed against respondent
William a.k.a. “Willy” Burerus before the propert court. No bail is required in this
case.

SO RESOLVED.
