Dear, Superintendent Sabadisto:

Greetings!

This has reference to the Memorandum I received dated July 9,

2018, with subject: Explain in Writing why I should not be charge
administratively for violation of Section 77 of PD 705 “Unlawful
possession of implements and devices used by forest officers”

May I inform you, that on July 3, 2018, around 12:00 p.m. while on
my post, I came across an ELF Truck wherein the back portion was
covered by a blue plastic canvass.

I stopped the truck and upon inspection, I found out that truck was
carrying lumbers. Upon such discovery, I decided to inform my
immediate superior and let him decide what has to be done with the
lumbers since I am on off duty. It was unfortunate however that we
were not able to meet so I decided to return to the post. However,
upon returning I was informed by the officer on duty that they
already confiscated the lumber but allowed the ELF truck and its
driver to go, instead of impounding them. (For your perusal and
inspection, please find attached duty detail)

It is my humble opinion that, I should not be charged for violation

of Section 77 of PD 705 because; I was just a victim of false
accusation. I did not for any self benefit, commit or cause to be
done the cutting of any lumber for my personal use and that even if
I was not on duty, I have done what is proper at that moment.

Please consider and give weight to my answer. Thank you and more
