Omar Abdulah exhorted the cadre to gear up for elections,
saying National Conference will go alone without forging any
alliance. He said a single party government alone can meet
the challenges confronted to the state, adding that his party
will give a strong and stable government at the strength of the
peoples' massive support and NC's presence in every nook
and corner of Jammu, Kashmir and Ladakh. He also urged the
workers not to go on rumours of rotation of reserved seats in
the Jammu region, as the Governor had assured the party
delegation recently about no such move under the
consideration of the government.
Exuding confidence about massive victory, the NC Vice
President said Jammu and Ladakh will have to hugely
contribute to the strength of National Conference in giving a
responsive and accountable government.
Omar Abdullah said the process for selection of candidates
has begun and the National Conference will plunge into
elections with two pronged strategy. First, to expose the PDP-
BJP government's failure on all fronts and, second to spell out
the priorities of the party in heralding peace and ensuring fast
track development. He said National Conference has a track
record of public service and it has never played with the
sentiments of the people, unlike the BJP by generating
passions on regional and religious issues.
On the BJP's communal plank, the National Conference Vice
President said that an atmosphere of fear and mistrust is

And in the Phase-I, 74.1% polling was recorded across J&K
including 64.5% in Kashmir division and 79.4% in Jammu
division.
He said results have been announced for all these Phases by
the respective Returning Officers.

conduct of Panchayat Elections, 2018. Also, Expenditure
Observers are keeping a watch on the expenditure by the
candidates. In addition, for the poll day, Micro Observers have
been placed in polling stations, particularly those considered
hypersensitive. Besides, the Zonal and Sector Magistrates too
have been deployed.
CEO said Control Rooms have been established in all the
districts across the State to respond promptly to any
complaints of violation of the Model Code of Conduct as also
to disseminate information to the public. Security
arrangements have been made including deployment of
Central Armed Police Forces (CAPF).
He said the Government has declared holiday on the day of
poll in the panchayat areas going to polls so as to enable the
voters to cast their vote. He said special casual leave shall also
be granted to the employees who have to go to other areas to
exercise their right to franchise. As per standing guidelines,
the Central Government offices shall not be closed but the
employees who are electors of the poll going wards and desire
to exercise their franchise shall be offered reasonable facility
to do so.

Need for system of judicial

around NGOs

accept funding from abroad.
This is a welcoming step for tightening the noose around the
NGOs, many of which were instrumental in hawala and
terror funding, tax evasions and money laundering like
activities in India.
Thankfully, in Jammu Kashmir, the State Administrative
Council led by the Governor approved in the last week only a
legislation to curb mushrooming of NGOs and other civil
societies and streamline their functioning in state.
The Jammu & Kashmir Societies Registration (Amendment)
Act, 2018 was approved by incorporating provisions for
renewal, appeal, de-registration and mandatory requirement
of maintenance of accounts, address, details of members.
The amendment will help to streamline various issues
related to NGOs/societies and improve accountability in our
state.
The FCRA 2010 provides for the regulation of acceptance of
the foreign funds or foreign hospitality by certain individuals,
associations, organisations and companies to ensure that
such contributions or hospitality is not being utilised for the
activities detrimental to the national interest.
Ministry of Home Affairs had also launched an "Online
Analytical Tool" to monitor flow and utilisation of authorised
foreign contributions received by various organisations with
a suspicion that some NGOs could be involved in fuelling
agitations on the payroll of foreign agencies.
Back in 2013, the Delhi High Court stated that 99% of the
NGOs in India are money-making devices. That’s only 1 out
of 100 NGOs serve the purpose they had actually been
established for. Increasingly, the charity organisations were
duping donors, diverting funds for their personal purposes
and becoming a haven for laundering black money.
Last month, the Home Ministry had served show cause notice
to 1,775 entities for their "failure" to submit annual income
and expenditure statement on foreign funding for up to six
years.
Efforts like these need more serious implementation at a war
footing.

decisions. Review, whenever it happens,
occurs due to the efforts of the aggrieved
parties. But there may be cases where the
aggrieved party may be the system itself,
and therefore, it may be preposterous to
assume that the system will make a move
against itself. It is obvious that
approaches by the incumbent CJI and

time, the courts cannot be blind to the
consequences of their decisions. It
may be fashionable to present
the goddess of law as
sword in one hand and the
balancing scales in the other.
But beyond the image of
independence it seeks to
convey, such approach often fails to
deliver the true meaning of justice.
Luckily, our courts do not have the
figurines of the blind-folded goddess as
the guiding deity, and the statue in front of
the Supreme Court of India denotes a

Modi seeks cooperation for winter India successfully test-fires

were found in houses, hotels, on
roads, they were being taken
unprotected in buses and jeeps...,"
he said.

Mumbai, Dec 10: Authorities at the
Arthur Road prison in Mumbai have
kept a high security cell ready for
liquor tycoon Vijay Mallya if he is
extradited from the UK in connection
with loan default cases against him in
India, an official said Monday.
Mallya, wanted in India on charges
of fraud and money laundering
amounting to around Rs 9,000 crore,
is set to appear before the
Westminster Magistrates' Court in
London on Monday when his
extradition trial is listed for
judgement.
The 62-year-old former Kingfisher
Airlines boss has been on bail since
his arrest on an extradition warrant in
April last year.
If extradited, Mallya will be lodged
in one of the high security barracks
located in a two-storey building inside
the prison complex, which also
housed 26/11 Mumbai attack terrorist
Mohammad Ajmal Kasab, a prison
official said.
A high security cell has been kept
ready at the jail located in central
Mumbai, he said.
"We are fully prepared to lodge him
safely at our correction centre. If he is
brought here, we will take care of his
safety and security," the official said.
In case of a medical emergency,
Mallya can be treated at the
dispensary located close to the
barrack, where doctors and other
staff are present to provide basic
treatment to prisoners, he said. The
high security barracks are located
separately from other cells.
These barracks are under constant
CCTV surveillance and security
guards with sophisticated arms are
deployed there, he added.
An official from the Union Ministry
of Home Affairs earlier said Mumbai's
Arthur Road Jail was one of the best in
the country. The comments had come
after a court in the UK asked Indian
authorities to submit a video of the
Arthur Road Jail cell where they plan
to keep Mallya following his
extradition.
The official said adequate medical
facilities were available to treat
prisoners in Arthur Road Jail, where
Mallya would get full security cover as
an undertrial prisoner and it was

adversely affect India’s

“This can again endanger
country’s freedom,” he said.

closed several times during
the British regime.
“I want to appeal to the
people that they should
understand how the present
government is taking the
nation on a wrong path and
there is a need to strongly
fight against it,” he said,
adding former prime
minister Jawaharlal Nehru
had once said that
“Freedom is in peril, defend
it with all its might.” He said
Punjab had played a vital
role in the fight for country’s
freedom. The event was
attended by Congress chief
Rahul Gandhi and other

Elon Musk, the CEO of
Tesla, openly derided the
US Securities and
Exchange Commission in
an interview, having
settled fraud charges with
the regulatory agency over
an errant tweet.
“I want to be clear. I do not
respect the SEC — I do not
respect them” he said in an
interview on the CBS
network news program “60
Minutes.” Musk had to
resign as Tesla chairman
under a September
arrangement with the SEC
to settle fraud charges
stemming from a tweet in
which he said he planned
to take the firm private and
already had the financing
to do it.
That caused a brief spike
in Tesla’s share price,
leading so-called short-
sellers, who have been
betting on the stock
crashing for years, to lose
millions.
Musk and Tesla each had
to pay a USD 20 million
fine to the agency, to be
split among harmed
investors. He was forced to
resign as chairman but
allowed to remain CEO.
The SEC had also
demanded oversight of the
mercurial Musk’s social
media use.
ut he said in the Sunday
interview that no one was
proofreading his tweets.
“The only tweets that
would have to be, say,
reviewed would be if a
tweet had a probability of
causing a movement in the
stock,” he said.
“Otherwise it’s ‘Hello, First
Amendment,’ he
continued, referencing the
US constitutional right to
free speech, which he
called “fundamental.”
Asked how Tesla would
know if his tweets would
move the market if they
weren’t all being read,
Musk replied: ‘Well, I
guess we might make
some mistakes. Who

Musk said he was abiding
by the settlement,
however, “because I
respect the justice

Mumbai, Dec 10: In its worst
session in two months, Indian equity
benchmark Sensex Monday tumbled
by 714 points after "unfavourable"

BJP, while analysts warned that a
bigger crash may be in store on
Tuesday due to sudden resignation
of RBI Governor Urjit Patel.
This was the worst single-session
fall for the benchmark BSE index
since October 11.
As far as the RBI Governor's
resignation is concerned, it alone has
the ability to knock off 200 points
from the Nifty, an analyst opined.
The Sensex tumbled nearly 714
points, or 2 per cent, to close at
34,959.72.
Similarly, the broader NSE Nifty fell
205.25 points, or 1.92 per cent, to end
at 10,488.45.
Exit polls for the recently concluded
assembly elections have predicted a
tight finish between the ruling BJP
and the Congress in Madhya Pradesh
and Chhattisgarh and a win for the
opposition party in Rajasthan,
impacting trading pattern on the
domestic bourses in a big way.
Besides, a weakening rupee, which
hit 71.44 per dollar intra-day, and
fresh foreign fund outflows further
pulled the key indices.
All sectoral indices on the BSE and
NSE ended in the red, led by realty,
banking, metal, pharma, pharma and
financial stocks.
Globally, market participants
remained watchful as uncertainty
prevailed over the temporary US-
China trade war truce.
The US markets continue to tumble
for various reasons and while the 90-
day ceasefire on Sino-American
trade talks is on, there is little action
on the ground as officials continue to
give conflicting views, analysts said.
"The state assembly exit polls have
shown a reducing vote share of the
BJP in Madhya Pradesh and
Chhattisgarh after 15 continuous
years of incumbency. The poor
performance of BJP will mean added
uncertainty in the markets till
general elections in 2019," V K
Sharma, Head PCG and Capital
Markets Strategy, HDFC Securities,
said.
Among the Sensex constituents,
Kotak Bank shares cracked over 6
per cent after the bank said it had
moved the Bombay High Court
against RBI's decision with respect to
the bank reducing promoter holding
using preference shares.
In August, Uday Kotak, the founder
and promoter of Kotak Mahindra
Bank, has pared down his stake in
the bank to 19.70 per cent from about
30 per cent following issuance of
preference shares.
Within few days, the Reserve Bank
said the stake dilution by Kotak does
not meet its regulatory norms on the
same, something the private sector
lender contested.
Other top losers include Reliance
Industries, Asian Paints, Tata
Motors, Adani Ports, Bharti Airtel,
Sun Pharma, L&T, PowerGrid, HDFC,
Axis Bank and Bajaj Auto, falling up
to 4 per cent.
Coal India and Maruti were the only
two gainers on the 30-share index,
rising up to 0.79 per cent.
Multiple factors impacted the market
sentiment as the bears held
complete control of the market from
opening till the closing bell, said
Joseph Thomas, Head Research,
Emkay Wealth Management.
This was the biggest one-day fall in
the last two months for both indices,
falling up to 2 per cent, he said.
On a net basis, foreign portfolio
investors (FPIs) sold shares worth Rs
817.40 crore Friday, while domestic
institutional investors (DIIs) were
net buyers to the tune of Rs 242.56
crore, provisional data available with
BSE showed.
Brent crude oil futures was trading at
0.31 per cent down at USD 61.48 per
barrel.
Elsewhere in Asia, Korea's Kospi fell
1.06 per cent, Japan's Nikkei
dropped 2.12 per cent, Hong Kong's
Hang Seng shed 1.19 per cent and
Shanghai Composite Index tumbled
0.82 per cent.
