DEED OF EXTRAJUDICIAL SETTLEMENT AND ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by and among the Heirs of CELESTINO
BUREROS, SR., namely: ORLANDO BUREROS, married to Gloria Auxtero; MARIETA
BUREROS, married to Rey Guangco; HENRITO BUREROS, duly represented by his Atty.-in-
fact, NINO BUREROS, married, per Special Power of Attorney, notarized by Dale Hanson,
Notary Public; Heirs of CELESTINO BUREROS, JR, viz: MARILOU BUREROS, married to
Arnold Yap; CHRISTY BUREROS, single; NINO BUREROS, married; Heirs of GLENDA
BUREROS-MARIMAT, viz: CARMELO MARIMAT, by himself and in behalf of his four
minor children, he being the Guardian Ad Litem of them; Heirs of NICOLASITO BUREROS,
viz: ANNALIZA B. CASTRO, married to James Castro, ANABELLE BUREROS and
NICOLASITO BUREROS, JR, both single, hereinafter called the VENDORS; all are of legal
age, Filipinos, and residents of barangay Pasil, Santander, Cebu; in favor of,

SHIELA DIPUTADO-JAGGI, likewise of legal age, Filipino, married to Alfred Jaggi,


and a resident of Poblacion,. Sibulan, Negros Oriental, herein after referred to as the VENDEE;

W I T N E S S E T H:

That CELESTINO BUREROS, SR. was an absolute owner of a parcel of land known as
Lot No. 885-B, located in barangay Pasil, Santander, Cebu containing an area of FOUR
HUNDRED EIGHTY (480) square meters, more or less; per Deed of Extrajudicial Partition of
Real Properties known as Doc. No. 445; Page No. 83; Book No. IV; Series of 2005, notarized
before Alfredo Buenconsejo, Notary Public; and which parcel of land is more particularly
described as follows:
TAX DECLARATION NO. 01-41-14051
“A parcel of land (Lot No 885-B) situated in barangay Pasil, Santander, Cebu.
Bounded of the North by Lot No. 880; on the East by Lot No. 885-A; on the South by Seashore;
and on the West by Lot No. 884; containing an area of FOUR HUNDRED EIGHTY (480) square
meters, more or less”.

That Celestino Bureros, Sr. died intestate sometime in September 21, 1981, leaving
without any testamentary will nor debts not settled until the present and upon his death he was
survived by his only children and compulsory heirs, namely: ORLANDO, MARIETA,
HENRITO, CELESTINO JR., GLENDA and NICOLASITO, all surnamed BUREROS;

That Celestino Bureros, Jr., also died intestate sometime in October 2005, leaving
without any testamentary will nor debts not settled until the present and upon his death he was
survived by his only children and compulsory heirs, namely: MARILOU, CHRISTY and NINO,
all surnamed BUREROS;

That Glenda Bureros-Marimat also died intestate sometime in November 4, 2003, leaving
without any testamentary will nor debts not settled or paid until the present and upon her death
she was survived by her husband CAMELO MARIMAT, who acted as Guardian ad litem of their
four minor legitimate children and only compulsory heirs;

That Nicolosito Bureros also died intestate sometime in March 28, 2004, leaving without
any testamentary will and upon his death he was survived by his children and only compulsory
heirs, namely: ANNALIZA, ANABELLE and NICOLASITO, JR., all surnamed BUREROS;

That invoking the provisions of Section 1, Rule 74 of the Rules of Court, and other
related and pertinent laws on succession, the herein heir vendors have agreed to settle and
adjudicate unto themselves their shares on the above-mentioned parcel of land in accordance
with their rights, interests and participations thereof;

That for and in consideration of the sum of FIVE HUNDRED THOUSAND PESOS (Php
500,000.00), Philippine currency, in hand paid by the Vendee herein and receipt in full is hereby
acknowledged by the herein Heir-Vendors to their entire satisfactions, and that by virtue of these
presents, the Heir-Vendors, DO HEREBY SELL, TRANSFER, and CONVEY unto the Vendee,
their heirs and assigns, in a manner absolute and irrevocable, all the vendor’s shares, rights and
interests over the aforementioned parcel of land consisting of Four Hundred Eighty (480) square
meters, more or less; free from all lien and encumbrances;

That the Heir-Vendors declare that their shares over the above-mentioned parcel of land
are not tenanted nor worked upon by an agricultural lessee for they are all in actual possession of
the said parcel of land and that due notice was given to all persons affected by this transaction in
compliance with the provisions of the New Civil Code pertaining to the rights of the
redemptioner and preemptioner, but nobody signified their intentions to exercise the said right;
and that this transactions is in consonance with the provisions of the Comprehensive Agrarian
Reform Program of the government for the said parcel of land belongs to the retention limits of
the vendors.

IN WITNESS WHEREOF, we have hereunto affixed our signatures this ___day of August
2008, at Cebu City.

Heir-Vendors and the vendee who exhibited their respective Community Tax Certificates Nos.
printed immediately after their aforementioned names, all known to me to be the same persons
who executed the foregoing document consisting of two (2) pages, including this page of
acknowledgement and all pages are duly signed by the parties, together with their two
instrumental witnesses; and that they acknowledged to me that the same is their free act and
voluntary deed.
