JUDICIAL AFFIDAVIT

I, LENNIE JOY A. ALVIOLA, executed this judicial affidavit to serve as my direct


testimony in the instant case. This Judicial Affidavit is offered to prove: (1) all the allegations in
the criminal case of Perjury and Libel; (2) including all the ANNEXES appended thereto, which
I respectfully requests to be correspondingly marked as EXHIBITS in this case; and (3) all
matters related thereto, with reservation to present additional exhibits in the course of the
proceedings of the instant case.

Questions were propounded by my counsel, Atty. M. MIKHAIL LEE L. MAXINO, and I


am answering his questions fully conscious that I do so under oath and may face criminal
liability for false testimony and perjury.

QUESTIONS AND ANSWERS

Q: Please state your name and other personal circumstances for the record.
A:I am Lennie Joy A. Alviola, of legal age, single and a resident of Burgos St., Barangay Lutao,
Bacong.I am the Private Secretary II of the Municipal Mayor of Bacong, Hon. ___.

Q:How are you related to the mayorMs.Alviola?


A: He is my father sir.

Q: Do you know respondent in this case?


A:Yes sir.

Q:How did you come to know the respondent?


A: Mr.Denmar Abo is the complainant in a letter-complaint he filed against me.

Q: When did you receive the said letter-complaint?


A: I received the unnotarizedletter-complaint last July 16, 2013.

Q: After receiving the letter-complaint, what did you do, if any?


A: Since it was unnotarized, it was returned back to the complainant for notarization.

Q: Did the complainant able to have the letter-complaint notarized?


A: Yes sir. Last July 22, 2013, I received the notarized letter-complaint of Mr. Abo.
Q: When you received the letter-complaint, was it placed in a sealed envelope?
A:

Q: When you received the notarized letter-complaint, what did you do, if any?
A: I was asked to forward the complaint to the HRMO-designate.

Q: I am marking this copy of thenotarizedletter-complaint, bearing the name of Mr.Denmar Abo


as complainant, as Exhibit A. I am attaching this to your judicial affidavit to form part of it.
Do you confirm my action?
A: Yes. Sir.

Q: Ms.Alviola, could you narrate to the court what respondent imputed on you on the said letter-
complaint?
A:

Q: Do you admit the allegations charged by Mr. Abo in his complaint?


A: No Sir.

Q: Can you narrate to the court what really transpired that caused Mr. Abo to file a complaint
against you.
A: Last July 4, 2013, at around 3:00 in the afternoon, a representative of Mad Dog Bar & Resort,
in the name of ____, came to the office and approached me and the SB secretary asking if we
can print their mayor’s permit instead sinceMs.NilaArado’s co-employee was out and
Ms.Arado is not knowledgeable with the computer.

Q: What happened next, if any?


A: We told her that we’re sorry we could not help her since that task is not assigned to us and we
don’t want to tinker with a computer not assigned to us. So we told her to wait for a while.

Q: What did the representative of Mad Dog Bar & Resort do after hearing those things from you?
A: After I told her to wait for a while, she went out of the room.

Q: Then what happened next, if any?


A: The representative went out the room and after a while, shereturned and asked if the Mayor is
coming back.

Q: What did you say to her, if any?


A: I told her that the mayor is not coming back to the office that afternoon and further instructed
her to come back the next day to have her mayor’s permit signed.

Q: How did you know the mayor is not coming back to his office?
A: He told me sir before he left his office at around 4:00 pm.

Q: After you told the representative that the mayor was not coming back to his office that
afternoon and instructed her to come back the next day, what did the representative do, if
any?
A: I notice that she was still waiting at the waiting area.

Q: So what did you do if any?


A: I asked a co-employee, Mrs.Elenita T. Valencia, to ask the representative why she is still
waiting.

Q: Would you know the response of the representative to Mrs. Valencia?


A: Mrs. Valencia informed me that the representative said that she’s waiting for her permit to be
released since Ms.Arado informed her that there is a pre-signed permit that she could give
her.

Q: Do you know this Ms.Aradothe representative is referring to?


A: Yes sir. I came to know her during the time I was first appointed as Private Secretary II last
May 1, 2002.

Q: Do you know whatMs.Arado’sposition and the nature of her job?


A: She is currently the Records Officer, one of her task is to encode and release Mayor’s permit.

Q: Do you have any idea about this pre-signed permit the representative of Mad Dog Bar &
Resort was talking about?
A:

Q: Do you know if the representative of the Mad Dog’s Bar & Resort able to secure his mayor’s
permit that afternoon?
A: Later that afternoon, Mrs.MerlieAbante, another co-employee, informed me that she met Mad
Dog’s representative at the stairs carrying with her the permit. She also informed me that the
lady told her that her permit was already ok.

Q: After knowing that Mad Dog’s Bar& Resort was issued their permit that afternoon, what did
you do, if any?
A:

Q: What else did you do, if any?


A: When I got home that day, I told the mayor, who happened to be my father, about what
transpired in the office after he left.

Q: How did your father react to it?


A: The next day, July 5, 2013, my father asked the treasurer to review all the permits issued by
the municipality and to report any discrepancy if there were any.

Q: Did the treasurer report any discrepancy in the permits issued by the municipality?
A:Yes sir.

Q: What did the mayor do about it?


A: He then ordered that letters be given to permit holders found to have an illegally issued
permit.

Q: Would you know the content of the letters sent to permit holders found to have an illegally
issued permit?
A:

Q:Is the respondent one of those whom the letter was sent to?
A: Yes sir.
Q: Going back to the complaint filed by respondent against you, did the HRMO have decided on
the matter?
A: Yes sir.

Q: What was the decision of the HRMO?


A:

Q: I am marking this copy of the decision of the HRMO, dated ___, as Exhibit B. I am attaching
this to your judicial affidavit to form part of it. Do you confirm my action?
A: Yes. Sir.

Q: Ms.Alviola, could you share to the court how the letter-complaint filed by respondent has
caused/affected your life?
