BETHESDA HEALTH PERSONNEL PROVIDER SERVICES

SERVICE CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT is made and entered by and between Bethesda Health


Personnel Provider Services, a business duly organized and existing under
Philippines Laws, located at Mindanao Sanitarium and Hospital, Bonifacio
Avenue, Brgy. San Miguel, Iligan City, represented in this instance by
BONIFACIA J. PUEBLOS, hereinafter referred to as FIRST PARTY;

_____________________________________________, of legal age, single/married,


and a resident of Iligan City, hereinafter referred to as the SECOND PARTY.

That the FIRST PARTY and the SECOND PARTY in consideration of the mutual
covenants and agreements made herein, by these presents enter into service in
contractual basis, whereby the SECOND PARTY agrees and binds
himself/herself to render service to the FIRST PARTY under the following terms
and conditions:

1. The FIRST PARTY shall pay the SECOND PARTY the wages and
allowances as mandated by the Department of Labor and Employment
(DOLE);

2. That for and in consideration of the foregoing, the SECOND PARTY


agrees and binds himself/herself to give and render his/her undivided
time and service in the interest of the FIRST PARTY as: (a) NURSE AIDE
(b) LABORATORY AIDE (c) PATIENT AIDE (d) DIETARY AIDE (e)
PHARMACY AIDE (f) MAINTENANCE AIDE (g) BAKERY AIDE (h)
GUARD, and (i) HOUSEKEEPER or other capacity as the latter may direct
for a period of _______ months to take effect upon signing of this contract,
unless otherwise stipulated by BOTH PARTIES;

3. There will be no employer employee relationship between the SECOND


PARTY and the client/s of the FIRST PARTY;

4. That the SECOND PARTY shall submit a health clearance certificate


certified by licensed physician/Rural Health Unit (RHU) to the agency
before hiring and once hired, shall also be required to submit health
clearance certificate annually as mandated by the Department of Health to
guarantee the health status of the employees;

5. That the result of the physical examination and laboratories should be


submitted to the FIRST PARTY together with the following tests:
a. Chest X-ray
b. Complete Blood Count (CBC)
c. Urinalysis
d. Fecalysis
e. Electrocardiography (ECG)
f. Drug Test
g. HIV/AIDS Test
h. Hepa B Test

6. The SECOND PARTY shall render services of not less than eight (8) hours
a day, five (5) days a week of a regular schedule determined and set from
time to time by the FIRST PARTY and shall extend such hour or services
when necessary in case of emergencies. Holiday compensation payment
may be acknowledged as approved by supervisor units;

7. The SECOND PARTY shall be responsible for the job assigned to him/her
and also be held liable for the incurred damage causing from negligence
committed within his/her job description;

8. The SECOND PARTY shall be obliged to wear the proper uniform and
I.D during his duty;

9. The SECOND PARTY categorically agrees and accepts that in the event of
his misbehavior, after proper investigation with opportunity to be heard,
shall be disciplined either by suspension or non-renewal of this contract;

10. That when the SECOND PARTY intends to leave his/her work, due notice
to the Department Head is required in addition to the clearance slip that
must be submitted to the first party at least 5 days before his/her leave.
Non submission of clearance slip is considered AWOL;

11. The following violations/offenses are subject for disciplinary measures


after due notice and hearing:
a. Failure to inform the department before the intended leave for
work is subject to 1 week suspension;
b. Tardiness for 30 minutes for three times without valid reason is
subject to 1 day suspension;
c. Drinking and smoking, sexual harassment and other vices during
working hours and in the work place are prohibited and subject for
automatic termination of this contract;
d. Physical assault, theft, and gross dishonesty are serious violations
also subject for automatic termination of this contract;

12. The SECOND PARTY hereby agrees that his/her share for SSS, PAG IBIG
and PHIC contribution shall be deducted from his/her monthly salary by
the FIRST PARTY and the FIRST PARTY shall pay and remit the SECOND
PARTY’s share of SSS, PAG IBIG and PHIC contribution to its
corresponding government agencies;

13. The five (5) day service incentive leave (SIL) provided by the law shall be
appropriated to the SECOND PARTY only upon service with the FIRST
PARTY for at least one (1) year (or 12 months) straight without
interruption or leave in his line of duty;

14. The SECOND PARTY shall have an additional leave of seven (7) days
with pay on top of the privileges provided such as but not limited to sick
leave, maternity leave, paternity leave, solo parent leave, gynecological
leave and such other leaves enumerated by law;

15. In the event that the SECOND PARTY intends to terminate the contract
before the expiration of the contract s/he has to notify the FIRST PARTY in
writing at least 30 days before termination;
