Sir,

As per the instructions received from our client, Dr. Kavitha K.S. residing at #63
, IInd Main, Honnappa Layout, Mallathalli (Kengunte) Bangalore- 560 056, this
notice is issued to you in the following terms:

1. Our client was appointed as ‘Assistant Professor’ by way of an Acceptance


Letter dated 30th June 2009 in furtherance to which an Appointment
Order dated 4th August 2009 was issued by Auden Technology and
Management Academy (ATMA), #92, Vaderahalli, Harohalli Hobli,
Kanakpura Taluk, Bangalore Rural – 562 112 under the auspices of
Auden Institute of Education Trust .

2. It was in accordance with the aforementioned Appointment Order that our


Client was appointed as an Assistant Professor in the Department of
Computer Science and Engineering at Auden Technology and
Management Academy (ATMA) under the auspices of Auden Institute of
Education Trust. As per this Appointment Order our client was entitled to
a remuneration package of Rs. 34,391/- in addition to Provident Fund and
Gratuity Fund as per the existing applicable rules of your academic
institution.

3. Our Client tendered her resignation letter to Nandi Institute of


Technology and Management Sciences dated 4th September 2015 in
response to which Nandi Institute of Technology and Management
Sciences issued a Relieve cum Experience Certificate dated 17th August
2015. It was in this letter that our client was relieved from carrying out
her duties with effect from 17th August 2015 forenoon as Assistant
Professor and therefore her resignation letter can be said to have been
accepted.

4. It was immediately after our client, Dr. Kavitha K.S. was relieved from
her duty that she applied to Nandi Institute of Technology and
Management Sciences for the payment of the Gratuity Amount to which
she was entitled under sub-section (1) of Section 4 of the Payment of
Gratuity Act, 1972 in Form I dated 17th August 2015 on account of her
resignation from the said Institute. Our Client has completed 6 years of
continuous service at Nandi Institute of Technology and Management
Sciences. Our client as per this Application for payment of gratuity
categorically agreed to the payment being made either in cash or by an
open or crossed bank cheque. It was also further mentioned in this
Application that since the amount of gratuity payable is less than rupees
one thousand, the same could be paid to our client by means of Postal
Money Order after deducting Postal Money Order Commission there from.

5. In accordance to the instructions given by our client we have been


requested to bring to your notice that after having applied for the payment
of this gratuity amount there has been no response from your end as up
till today. Our client has tried to attain clarity regarding the payment of
the gratuity amount to which she is very much entitled, both by letter and
email. In the letter dated 3rd September 2015 our client has claimed the
gratuity amount to which she is entitled stating she has put in 6 [six]
years into service and has resigned from service due to personal reasons.

6. In addition to the aforementioned letter, our client also expressed her


grievance of not having received the gratuity payment to which she is duly
entitled by way of email dated 23 September 2016. Our client expected to
settle the matter amicably with Nandi Institute of Technology and
Management Studies but has not received any clarification/ information
regarding the payment of the same. It is due to the lack of a response from
your end that our client is left with no other alternative but to call upon
you by way of this Legal Notice, requesting for the gratuity amount to be
released in her favour.

7. In the event that our client does not receive a prompt response from your
end regarding the release of the gratuity amount in her favour we will be
constrained to initiate necessary legal proceedings against you. Hence,
this legal notice has been issued accordingly.
