1. This pertains to the death of EVELYN GUSTILO, the wife of SPO4


REYNALDO GUSTILO, the Chief Clerk of Investigation and Detective
Management Branch. She died at about 5:30 pm yesterday November 14,
2015 after months of battling against Stage 4 Pancreatic Cancer. Such
incident does not only brought Emotional grief and Physical breakdown on
our comrade and his family but also Financial difficulties while they exhaust
all medical treatments to save their sick family member.

2. In this regard, I would like to knock on your kind hearts and request
from you and your personnel any amount as voluntary assistance/donation
for SPO4 Reynaldo Gustilo and his family. The same will be of great help to
ease their concerns and problems as they endure and survive this very
unfortunate and difficult time.

2. This pertains to the failure of the above-named police officer to attend the accounting
of personnel conducted at about 8:00 am of May 26, 2017 in front of Admin Building, Davao
City Police Office as noted by the Chief Executive Senior Police Officer (CESPO).

3. In view thereof, the undersigned police personnel regretfully admit the failure to
appear and be present in the said accounting, however, are pleading that such failure was not
intentional and was justified.

4. That at about 7:00 am of May 26,2017, the abovementioned police officers left IDMB
Office to implement the Warrant of Arrest against NINE (9) Personalities identified as NELSON
BATULAN, NELO MILLANES, ANGELITA “LITA” SAIL-INES, FERNANDO MARTINEZ,
ALICIA PASYOL, ZOSIMO VILLAME, FERNANDO LUARDO, ROSE GENOSAS and
ROSALIE GASLANG at the area of Tibungco, Davao City. (Attached is a copy of the Warrant
of Arrest)

5. That the said personnel returned this office at about 10:30 AM of the same date and
endorsed three (3) of the said wanted persons. (Attached is a copy of the Blotter Entry of IDMB
Office dated May 26, 2017)

6. In this regard, the undersigned police officers humbly apologize for the said
unintentional failure but prayed that the same be given consideration as it was not maliciously
made and is justifiable.

4. References: Memorandum from Chief, RIDMD/R7 dated November


24, 2016 and Letter from Maria Luisa Salonga-Agamata, Director IV, Public
Assistance and Information Office, Civil Service Commission.

2. This pertains to an anonymous complaint lodged thru Contact


Center ng Bayan (CCB) against a certain JOPSON a PNP member assigned
with Davao City Police Office for allegedly extorting money to a motorcycle
driven while conducting checkpoint along San Rafael Road, Marfori, Davao
City.

3. Upon receipt of a copy of the complaint on November 25, 2016, this


office immediately conducted verification on the existence and/or identity of
the said complained personality at the list of personnel assigned at Davao
City Police Office. After thorough inquiry, it was found that there indeed a
personnel of Davao City Police Office identified as PO3 Alexander Japson who
is assigned at Police Station 2 (San Pedro) who was part of those who were
conducting regular checkpoint at the area of Marfori, Davao City, specifically
along the San Rafael Road.

4. After receiving such information, this Office immediately required


PO3 Alexander Japson to submit his written explanation regarding the
complaint. In his defense, he averred that there is no truth in the allegations
thrown against him. He admitted that he is one of the personnel of Police
Station 2 who conduct checkpoint in the said area yet claimed that he did
not extort money while conducting checkpoint. He further claims that the
accusation against him were only to discredit him due to his strict
implementation of the law RA 4136 which resulted to so many
apprehensions and issuance of citation tickets. (Attached hereto are the
Memorandum from Chief, IDMB re Explanation dated November 25, 2016
and the Explanation Letter of PO3 Alexander Japson dated November 28,
2016 with its attachments)

5. Based on the documents and evidences at hand, this office, due to


insufficiency of evidences, cannot yet established the reasonable ground to
cause the filing of any criminal or administrative charges against PO3
Alexander Japson. The admission of the subject personnel that he indeed
takes part in the conduct of checkpoint in the said place does not in any way
amount to the confession of the charges against him. His defense that these
were all retaliation of his strict implementation of traffic laws while in
checkpoint may also validly negate the complaint against him. Being so, this
office will continue to conduct further investigation and verification on this
matter and will immediately forward to that Office any development in the
matter.

6. Likewise, this office conducted reiteration to all police stations,


especially to all the field personnel, the observance of the proper conduct of
checkpoint and the avoidance of any sort of corruptions while in the
performance of their duties.

SUBJECT : Failure to Implement Warrant of Arrest

5. Reference: Memorandum from RD, PRO 11 dated October 19, 2016.

2. This pertains to the Order issued by Judge Emmanuel C Carpio, Regional Trial Court,
Branch 15, Davao City directing Police Station 9 (Tugbok) to explain the failure o implement or
made a return of the Warrant of Arrest against Junril Butal and Leunilyn Espina.

3. In this connection, please be informed that upon receipt of the memorandum this office
immediately conducted an investigation to determine the culpability of the personnel in-charge in
serving the said warrant of arrest and to further gather necessary evidences to support the filing
of administrative charges.

4. Based on the investigation conducted, it was discovered that the police personnel
charged to implement the abovesaid Warrant of Arrest is identified as PO2 Michael Jason
Balatero. It was however revealed that the subject PNCO has already submitted his explanation
to the Branch 15 of RTC Davao City on November 4, 2016. (Attached is the Original Copy of
the Explanation of PO2 Michael Jason Balatero duly received by the Branch 15, RTC, Davao
City)

5. Further investigation revealed that the infraction committed by PO2 Michael Jason
Balatero was already brought to the attention of the appropriate Disciplinary Office. An
administrative case pertaining to the subject omission was already filed against him by the
complainant at the Regional Office which case was already submitted for resolution of the
designated Summary Hearing Officer. In connection with the said admin case, Special Order No.
1494 was issued by PRO 11 last October 10, 2016 relieving PO2 Balatero from Davao City
Police Office (DCPO) and reassigning him to Regional Personnel Holding and Accounting Unit
(RPHAU). (Attached hereto is a copy of the Charge Sheet with Admin Case No. PRO 11 AC No.
84-081116, Pre-charge Investigation against PO2 Michael Jason O Balatero dated July 28,
2016, and Special Orders No. 1494 dated October 10, 2016)

2. This pertains to the failure of this office to submit a copy of the Police Station 9’s
explanation addressed to the court in relation to the latter’s failure to implement or make a return
of the Warrant of Arrest against Junril Butal and Leunilyn Espina.

3. In view thereof, this office regretfully admits the failure to comply with the said
memorandum, however, is pleading that such failure was not intentional but was only
inadvertently overlooked.

4. That on November 2, 2016, a reply to the subject memorandum was already drafted by
our Warrant and Subpoena NUP endorsing a copy of the explanation of PO2 Michael Balatero
but the same was not yet signed but the City Director and directed that a necessary investigation
be conducted as the Order of the Court dictates that the subject PNCO committed a violation of
duty and thus should be investigated and penalized if the same be found to be appropriate.

5. That upon receipt of the handwritten directive, this office immediately conducted
investigation wherein it was found that PO2 Michael Jason Balatero was already charged
administratively in relation to the said complaint and in fact was already relieved from the Davao
City Police Office (DCPO) and reassigned to Regional Personnel Holding and Accounting Unit
(RPHAU) since August 3, 2016. After receipt of the information, this office immediately
coordinated to appropriate offices to gather the necessary attachments for the investigation report
but in the process this office unfortunately overlooked the supposed submission of the copy of
the Explanation of PO2 Balatero. (Attached is the Original Copy of the Explanation of PO2
Michael Jason Balatero duly received by the Branch 15, RTC, Davao City)

6. In this regard, this office humbly apologize for the said unintentional failure but prayed
that the same be given consideration as it was not maliciously made and is merely an inadvertent
mistake.

This is to certify that PO1 Johnny S Lluvido, 40 years old, married, and a resident of
Mangkilam, Garcia Ville, Tagum City, Davao del Norte was placed under Restrictive Custody at
this Office on March 25, 2015 after he was found positive in the surprise Drug Test conducted at
Police Station 6 (Bunawan).

Further certify that on or about 8:15 am of March 26, 2015, PO1 Johnny S Lluvido left
this Office without the consent or knowledge of the duty police officers. Diligent effort was
exerted by this office locate the whereabouts said police officer and to eventually bring him back
to this office’s custody yet the same were unavailing. Three (3) Return to Work Order were
likewise sent to his abovesaid residence but the same were unheeded.

27. This pertains to the alleged illegal discharge of firearm committed by PO3
Virginio Berdin Pajerado Sr last April 13, 2015 at Kabayan, Tibungco, Davao City.

28. Investigation conducted disclosed that one Christian Delos Santos Pajerado, son
of the subject PNCO, averred that his father arrived at their house at around 6:00 am of April 13,
2015 from Mati, Davao Oriental. When the said police officer discovered that his breeding
chicks were missing, he became angry, drew his firearm and fired twice. He further alleged that
his father hit him in the arm with a piece of wood.

29. Further disclosed that the neighbours of the said policeman heared the two (2)
gunshots from the residence of the subject PNCO as well as the arguments between him and his
son. However, the investigator claimed that a crime has not been filed due to want of evidence to
support the charge as there are no complainants against the said police officer and that the son of
the subject police officer also chose not to lodge a complaint or be a witness against his father.

equipped with knowledge in making a detailed and comprehensive Powerpoint Presentation.
Also, this office are faced with the problem of converting the regional format into a city format
as what was given by the higher office is only a raw regional level presentation.

2. In this regard, this Office respectfully request that PO3 Junmarie Alconcel of
Infortation Technology Section of OPN Branch to be exempted from the Araw ng Davao
Celebration deployments and be specially detailed to this Office for the construction and

33 years old, married, PNP member assigned at Rapid Deployment Platoon of Davao Public
Safety Company, and a resident of #75 Agdao Beach Village, Agdao, Davao City.

32. Investigation conducted disclosed that on or about 7:30 pm of February 23, 2015,
the suspect was seen by the witnesses arrived at the place of incident and left his motorcycle
improperly parked in front of the tricycle terminal. The victim then picked up the motorcycle to
allegedly have it properly parked. When the suspect saw this, he immediately drew his pistol,
and shot the victim several times but failed to hit him at first. The victim was then chased by the
suspect towards the former’s tricycle wherein he was hit by the suspect at the leg, causing him to
be immobilized. The victim allegedly kneeled and ask that his life be spared but the suspect
instead reloaded his firearm and shoot the victim twice in the forehead and then several times to
the chest which caused the victims instantaneous death. (Attached is the Investigation Report of

33. After the incident, the suspect who is about to leave the crime scene was
immediately apprehended by the responding police officers of Police Station 9 (Tugbok).
Recovered from his possession is his issued 9mm Glock 17 pistol bearing serial number
PNP18877 with chamber load and one (1) magazine with seven (7) live ammunitions, while
recovered from the crime scene are twenty-three (23) fired 9mm catridges, one (1) deformed slug
and one (1) DT Yamaha Motorcycle without plate number.

34. The suspect is currently detained at Investigation and Detective Management


Branch of Davao City Police Office while a criminal case of Murder has already been filed
against him at the City Prosecutors Office XI docketed with I.S. No. XI-02-INQ-15-B-0405.

(Talomo) from January 9 to 10, 2015 which led to the recovery of the kidnap victim, Arthur Troy
Del Prado Valdez, 4 years old, and arrest of the suspect, Julita Alison Quijoy, 39 years old,
married, stay-in house-helper at Blk. 32 Lot 24, Gold Street, Ruby Subdivision, Catalunan
Grande, Davao City and a resident of Purok 3, San Isidro, San Miguel, Zamboanga Del Sur.

41. Investigation conducted disclosed that at about 9:30 am of January 9, 2015, the
suspect was seen by her co-househelper, Judith Ongob Camad, bringing the victim outside the
house, allegedly to buy soap and shampoo at the nearby store. However, the suspect failed to
return thus prompted the family of the victim to report the incident to Police Station 3 (Talomo)
of Davao City Police Office. Thereafter, an investigation is conducted by Police Station 3 which
led to the information that the suspect is on her way to Zamboanga del Sur to bring the child
thereto and subsequently to ask for a ransom money of Php 100,000.00. Due to this information,
a rescue operation was conducted by the personnel of Police Station 3 to arrest the suspect while
she is on her way to Zamboanga del Sur. At about 5:45 am of January 10, 2015, the operating
personnel successfully arrested the suspect and rescued the victim at the vicinity of COMPATSI
terminal located at Jose Lim Sr. Street, Poblacion 5, Cotabato City. (Attached is the Investigation

42. On January 12, 2015, a criminal case of KIDNAPPING was filed against the

,onitoring at the patients when she observed that Norman Downey was not responding and when
she further checked him, he was no vital signs. Thereafter, Irene Morcianos immediately
informed her co-employee Janeneth Tabudlong Lenterna as well as the owner of the
establishment, Mr. Rudolph Ochoa Ambrosio. (Attached is the Investigation Report of Police

46. At about 6:30 am of January 25, 2015, responding investigator of Police Station 3
was able to talk with the wife of the deceased, Alejandrina Bacaltos Downey, who complained
about the procedure of the establishment in wrapping the dead body of her husband with plastic
cellophane.

47. After the incident, the cadaver of the victim was brought to St. Peter Funeral
Homes, Calinan, Davao City for the required autopsy.

48. Necropsy report issued by Dr. Danilo P Ledesma, Medico-Legal Officer IV of


Davao City health Office revealed that the cause of death was ACUTE MYOCARDIAL
INFARCTION or heart attack.

identified as RAYMART C PADADA, 21 years old, single, and a resident of Banaybanay,
Davao Oriental who was charged of Theft through inquest proceeding last January 28, 2015.

12. Investigation conducted revealed that at about 7:45 am of February 9, 2015, the
duty jailer, PO3 ROMAN BASLAN, was conducting the routine inspection and cleaning of the
detention cell when he instructed the above-said detainee to carry and bring outside the collected
sack of garbage. Thereafter, the said detainee ran managed to escaped by running towards the
interior portion of Mini Forest, Brgy 23-C, Davao City. (Attached is the Special Written Report
of Police Station 1 dated February 10, 2015 with complete attachments)

13. In his explanation, PO3 Roman Baslan admitted that he indeed bring the said
detainee out of the detention cell to throw the sack of garbage that was collected, but he also
alleged that he was surprised when he was suddenly pushed by the said detainee and the latter
immediately ran towards the area of Mini Forest, Boulevard. He claimed that he immediately
informed the Senior Duty Officer PSINSP AQUINO SERENIO of the said incident. Afterwhich,
personnel from Police Station 1 immediately conducted pursuit operation to arrest the escaped
detainee but the same failed as the said detainee manages to successfully flee from the pursuing
police officers.

14. Police Station 1, is still conducting a manhunt operation to recover information


and eventually arrest the escaped detainee.

2. This pertains to the death of FREDDY TER VEEN, 61 years old, single, dutch
national, seaman, and a resident of #032, Cordillera Street, Central Park Subdivision, Davao
City. Investigation conducted disclosed that at about 12:00 midnight of February 3, 2015, Ms.
Luzviminda Alep Elosario, the live in partner of Freddy Ter Veen, was awaken when the said
dutch national stood up from their bed and after a while she heard a loud thud and when she
verified it, she discovered Freddy lying in prone position beside the cabinet, unconscious and
with blood flowing from his head. (Attached is the Investigation Report of Police Station 3 dated
February 6, 2015 with complete attachments)

3. Investigation further revealed that the house was CCTV cameras and the same
shows that there are only three (3) persons inside the house when the incident happened, Ms.
Luzviminda Elosario, Freddy Ter Veen and their house helper April Joy Abarquez. Ms Elosario
further averred that her live-in partner is taking medications for arthritis and liver disease but he
already stopped taking them as he was always drinking alcohol. She also claimed that lately she
had a phone conversation with the ship captain of ship wherein he was employed and that ship
captain said that Freddy has health problems at the time they were on duty.

4. After the incident, Freddy Ter Veen was immediately brought to Davao Adventist
Hospital, Bangkal, Davao City wherein he was declared dead on arrival by Dr. Sol Oledan.
Necropsy report issued by the Office of the City Health revealed in its post mortem findings that
the caused of Freddy Ter Veen’s death is Acute Myocardial Infraction or commonly known as
“Heart Attack”. (Attached is the Necropsy Report issued by Medico-Legal Services Division,
Office of the City Health with Necropsy No. 15-06)

17. This pertains to the directive to make some rectification on the dispositive portion
of the decision as well as in the Certificate of Finality of the administrative case against PO1
Edwin V Yeso Jr as the penalty of REPRIMAND, as imposed therein, was not among those
mentioned in the NMC 2007-001.

18. In this regard, this office however would like to clarify if such action be not
improper as the copy of the said Decision and Certificate of Finality has already been received
by the subject police officer.

19. This Office further clarifies on the fact that the penalty of Reprimand cannot be
imposed as aside from the fact that the said penalty was actually imposed in recent cases,
especially on cases involving non-compliance with the Physical Fitness Test, it is likewise
provided in Rule 4, Section 1, Paragraph a of NMC 2007-001 which provides in substance that
cases involving breach of internal discipline shall be brought to Chief of Police or Equivalent
Supervisors provided that the imposable penalty is admonition, reprimand, restrictions to
specified limits, withholding of privileges, forfeiture of salary or suspension, or any combination
thereof, provided that in all cases, the total period shall not exceed fifteen (15) days.

20. In was also noted that Title VI, Section 52, paragraph b, subparagraph 1 of
Republic Act 8551, provides that in cases of breach of internal discipline, Chiefs of police or
equivalent supervisors may summarily impose the administrative punishment of admonition or
reprimand; restriction to specified limits; withholding of privileges; forfeiture of salary or
suspension; or any of the combination of the foregoing: Provided, That, in all cases, the total
period shall not exceed fifteen (15) days.
21. Due these given provisions, this Office are confound whether the non-inclusion of
reprimand as imposable penalty in administrative cases involving internal discipline under NMC
2007-001 effectively contradicted the law RA 8551 or if the said NMC and Republic Act are
indeed not compatible with each other, does the said NMC 2007-001, a Memorandum Circular,
did impliedly repealed the RA 8551, a Special Law.

22. We hope we be clarified on these matters so that it will shed light on us so that we
may be able to be more effective in carrying our duty as part of the disciplinary mechanism of
our Office.

41. Reference: Memorandum from Acting Chief, Operations and Plans Branch dated

42. In connection with the above reference, please be informed that the main
emerging concern that this office is facing is the fact that the warrant officers of this office are
burdened by the numerous subpoenas that the Courts require them to serve. To that effect, the
said personnel are therefore left with substantially lesser time in serving Warrants of Arrest and
to effect arrest of wanted persons. As a result thereof, the office therefore accomplished a very
minimal number of arrests of wanted persons.

43. In this view, this office recommends that the subpoenas from Courts be removed
from the warrant officer’s disposal as the Courts have in fact there own subpoena servers. If
there are Memorandum of Agreement to that effect, it is further recommended that the same be
reviewed or be amended. If the warrant and subpoena servers of this office be given only with
Warrants of Arrest for them to be served, then a more efficient and effective police operations
which will result to the successful arrests of wanted and most wanted persons shall be achieved.
44. Major wins that this office achieved for the calendar year 2014 are the vast
number of police operations conducted against illegal drugs. This office has arrested and
neutralized a number of drug users and pushers within the area of jurisdiction through the
conduct of buy bust operations within the city. In effect, the illegal drugs activities and
commission of crimes are effectively lessened. The Isumbong kay CD text campaign likewise
contributed a lot to this accomplishment as it makes the community-police partnership against
illegal drugs and criminality to be very more efficient and immediate.

conducted verification on the said case however it was found that no any kidnapping case or
complaint against John Christopher Mira was lodged to this office. It was however found that
sometime on March 10, 2014, the person of Marie Cris Fambi Ibarra appeared at Police Station 2
(San Pedro) of this Office and requested the WCPD personnel therein for assistance in rescuing
his son William John Mira at Doña Vicenta Village, Brgy. 19-B, Davao City. (Attached hereto is
a copy of the Excerpt of Police Station 2 from its Blotter Entry No. 14-7818 and 14-7819)

56. WCPD Personnel of PS2, together with social workers and barangay officials,
immediately proceeded at the area, yet the child’s grandmother Maria lo Mira and father John
Christopher Mira, assisted by their counsel Atty. Salcido, refused to turn-over the custody of the
child to the complainant and public officers. Thereafter, the police officers assisted the
complainant to the Public Attorney’s Office (PAO) for legal advice.

57. Further be informed that this Office has not received any Warrant of Arrest
against the persons of Marian Lo Mira and Florencio Dante Mira in relation to the above-

2. In this connection, request be informed that the subject police officers are already
subjected by this office for a pre-charge investigation wherein it was found that two (2) of them,
PO1 Jeffer Villegas and PO3 Bernardo Flauta, were found to be the arresting officer of the
suspects Sulpicio Biaco and Reynaldo Sajulan, respectively. In that case, it was found that
probable cause did exist to indict the said arresting officers to the offense charged and therefore
formally charged with Simple Neglect of Duty. (Attached hereto are the Approved Pre-charge
evaluation dated September 30, 2014 and Charge Sheet dated October 1, 2014)

3. With respect to the other six (6) police officers , the charged against them were
dropped for they are not the proper party in the complaint as it was found that they are were not
the arresting officers of the arrested suspects nor they are involved in the police operations which
to their arrest. It was also found that the said police officers has no pending case that warrant
their continued restrictions to this office.

4. In this regard, it is recommended that this office be allowed to relieve the said six
(6) police officers from restrictive custody of this office and to reassign them to Police Stations,

74. This pertains to the electronic mail complaint from a certain Peter C Simpao
which was addressed to DILG Secretary Mar Roxas indicating number of alleged violations that
are committed by PO3 Freddie Sta. Ana.

75. In this connection, Please be informed that upon receipt of the said memorandum
and letter of complaint, it was discovered that the person of PO3 Freddie Sta. Ana is not within
the jurisdiction of this office as he was already relieved from Davao City Police Office since
April 12, 2013 and reassigned to the Regional Personnel Holding and Accounting Unit of Police
Regional Office 11 by virtue of Special Order No. 525 PRO 11.
76. In this view, this office has therefore no authority to pass upon the matters
regarding his alleged pending administrative and criminal cases nor to the charges against his
being currently engaged in gambling acivities. As previously said, he was long been relieved
from this office, thus the matter regarding the charges of not rendering duty and providing
personal security to a certain Romeo Berry are likewise not within the ambit of this office’s
jurisdiction.

77. The issue on the alleged well-to-do lifestyle of the subject police officer as well as
ownership of various properties are also not within the investigative power of this office.
Investigations on the acquisition of properties or economic status of personnel are not included to
those which this office can take cognizance as that power belongs to other government agencies.

78. This office however conducted an investigation on the charge of alleged operating
of illegal gambling (mah-jong) in his residence. In the investigation report submitted by Police
Station 3 (Talomo), it was found that the subject police officer has transferred his residence at
Royal Pines and only occasionally visiting his family at South Villa, Catalunan Grande, Davao
City. The investigation further revealed that there is actually a mah-jong game that are conducted
in the place but PO3 Freddie Sta. Ana was not the operator but a certain Marites Acenas who has
secured a permit for such activity. (Attached hereto is the Special Written Report of Police
Station 3 dated September 22, 2014)

79. The issue of threatening of construction workers are already investigated by this
office last July 22, 2014 when a complaint regarding the matter was brought to the attention of
the City Director thru the “isumbong kay cd” text hotline, however, it was discovered that there
was actually no threat that occurred but a retaliation of those workers who were dismissed from
employment by Architect Berrey, believing that they were terminated due to the
recommendation from the subject police officer. (Attached is the Memorandum addressed to
City Director dated July 22, 2014)

back of Camp Quintin Merecido, Catitipan, Davao City.

3. In this connection, please be informed that investigation conducted by Police


Station 5 (Buhangin) revealed that the parcel of lands which are the subject of the controversy
are in fact claimed by two owners: first, by the alleged heirs of Mamaba who averred that they
inherited the said lands from their ascendants and second, by the Gaisano’s who claimed that the
said lots were owned by them and that they granted those lands, with Memorandum of
Agreement with the City Government of Davao, to those informal settlers who were ejected from

11. In this connection, this office immediately conducted an investigation regarding
the veracity of the complaint wherein it was discovered that there are actually no maltreatment,
abuse, torture or any form of Human Rights violations committed by the personnel Police Station
8 (Toril), including the seven (7) police intelligence operatives who were previously relieved.

12. In support to the said investigation, submitted herewith are handwritten


Certifications of detainees of Police Station 8 stating that there were no incidents of
maltreatments and the certifications were witnessed by an elected member of Sangguniang
Barangay of Toril and Maa, Davao City to show proof of the absence of any coercion or force
upon the execution of the above certifications.

13. In this regard, the absence of any complaint against personnel of Police Station 8
of alleged torture or maltreatment of detainees has not been established and until such time that a
complainant will surface then it is considered that no such incidents had transpired.

14. However, the seven (7) intelligence operatives relieved from Police Station 8 will
be re-assigned to other police stations of Davao City so that their services can be utilized and
also for the purpose of defusing tensions from quarters making complaint against the said police
station.

August 25, 2014 at the Bunawan Police Station and alleged that you failure to investigate the

18. Upon receipt of the letter complaint, this office immediately made PO3 Rodriguez
to explain regarding the charges against him. In his explanation, he however presented a different
version of story than that of the complainant. The subject police officer claimed that the issue of
the controversy was the alleged failure of two parties to return the properties that belong to them.
The differences however may have been settled already if after they both agreed to return the
properties at the station, both of them complied, but the controversy instead worsen when Mr.
Acopio failed to appear and further claimed that the items that are in the possession of the other
party were actually unlawfully taken from him.

19. The claims of the complainant, however, are not supported by any evidence other
than his own declarations. On the other hand, all the events that PO3 Rodriguez claimed to
happened are all recorded in the blotter of the Police Station 6 (Bunawan).

2. Please be informed that upon receipt of the above-said memorandum, this Office
immediately directed PO3 April Love Cabañog to report to this office and explain her side with
respect to the charge against her. (Attached hereto is the explanation of PO3 April Love

3. PO3 Cabañog claimed that she never had any adulterous nor romantic relationship with
Police Inspector Richlie D Murallon. She however admitted that she met PINSP Murallon last
December 2014 at the Police Regional Training School 11 when she was about to undergo the
PSJLC training while PINSP Murallon, on the other hand, was about to graduate on their
Officers Basic Course.

4. It was further discovered that soon after PINSP Murallon graduated from their
schooling, he was immediately reassigned to Region 10 and was not seen again at this City.

5. The complainant further never alleges that PINSP MURALLON was married nor
claimed that she was the legal wife of the said Police Inspector. It must be noted that before an
adulterous act be charged, It must first be established that the person complained was legally
married and was engaging in extramarital affair.

6. Assuming arguendo that PINSP MURALLON was indeed married and that the
complainant is his legal wife, still the fact of adulterous affair cannot be established with
reasonable certainty as there are no evidences which will prove that the subject police officer
was engaging in any dating or romantic relationship with PINSP MURALLON, given that the
latter was immediately reassigned to other region after his schooling and that he was not seen
again in the area.

7. In view of the foregoing, this Office recommends that the complaint against PO3 April
Love Cabañog will not be given merit. Further recommend that the complainant be requested to
submit substantial evidences supporting the charge.

47. At about 9:00 PM of June 5, 2014, RAMON TEODORO YUVIENCO GARCIA,


67 years old, married, businessman, and a resident of las Terrasas, Brgy. Maa, Davao City, left
his house on board his Toyota Innova vehicle bearing plate number LGN-887 to have a social
meeting at the Blue Room Bar of Apo View Hotel with his friends RAMON BELLO MORADA,
67 years old, married, doctor, and a resident of #2 Guijo St., Nova Tierra, Lanang, Davao City
and DAISY JOY SUPATAN CACHAPERO @ ANGEL, 26 years old, with live-in, umbrella
girl, a native of Purok 13, Brgy Poblacion, Sulop, Davao del Sur and a transient resident of
Sparrow St., Ecoland, Davao City. However, at about 9:45 PM, DR. MORADA, left RAMON
TEODORO GARCIA and DAISY JOY CACHAPERO at the Bar to go home.

48. At about 9:00 AM of June 6, 2014, a dead body was found at Sitio Baluyan, Brgy.
Bolton, Malalag, Davao del Sur. The said victim was identified as a male person of about 55 to
60 years old, 5’6” in height, 60-70 kilograms, wearing blue t-shirt and stripe blue brief, with
masking tape covering his mouth and stabbed wounds on his neck.

49. At about 11:00 PM of the same date, an abandoned and razed by fire Toyota
Innova was found at the area of Sitio Dalandang, Brgy. Nagpan, Malungon, Saranggani
Province. Said vehicle was bearing plate number LGN-887, engine number 2KD6381545 and
chassis number KUN405032309, and was found out to be registered under the name of Nanay
Bebeng Culinary Enterprises of Davao City.

50. Follow-up investigation conducted resulted to the discovery of one witness in the
person of JONABE MENREDONDO LADAG, 30 years old, single, jeepney driver, and a
resident of Sabroso, Kabacan, Davao City who testified that at about 12:30 AM of June 6, 2014,
he was soliciting passengers when saw one vehicle from Ecoland highway which stopped at
Sparrow St., Ecoland, Davao City and while thereon, a female person disembarked from the
passenger side and puke on the road while after some time, a male person appeared and suddenly
entered the vehicle. The said witness positively identified the female who disembarked form the
vehicle and the male person who entered the vehicle as the are both renter/boarder of the said
place.

51. Further investigation at the area of Davao del Sur led to the arrest of DAISY JOY
SUPATAN CACHAPERO @ ANGEL and one ARIEL JOHN JAMORA LIAWAN @ JANAN,
23 years old, a native of Koronadal City and a transient resident of Sparrow St., Ecoland, Davao
City at the residence of DAISY JOY SUPATAN CACHAPERO at Purok 13, Brgy. Poblacion,
Sulop, Davao City.

52. Also recovered are number of items including the one (1) black IPHONE cellular
phone, one (1) Gold necklace with cross and Virgin Mary pendant, one (1) UNIONBANK (E-
Wallet Card), and one (1) Gold bracelet which was previously pawned by the suspect ARIEL
JOHN LIAWAN. The said items were all identified by the son of the victim THEORDORE
DELFIN MARAVILLA GARCIA as his father’s personal belongings.

53. Using the testimonies witnesses and all evidences gathered, a case of Robbery
with Homicide was already filed against DAISY JOY SUPATAN CACHAPERO @ ANGEL
and ARIEL JOHN LIAWAN at the City Prosecutors Office XI, under Summary Inquest
Procedure docketed with NPS # XI-02-INQ-14-F-0869.

54. At about 9:00 PM of May 30, 2014, a shooting incident transpired at BPI Lanang
Branch, Davao City wherein the victim was identified as ATTY. EMMANUEL LEDESMA
ACUÑA, 31 years old, single, former PAO lawyer and a resident of 145 4th Street, Ecoland,
Davao City who sustained multiple gunshot wounds on different parts of his body.

55. Initial investigation conducted disclosed that the victim was sitting in his Toyota
Avanza car color gray bearing plate number WKO-430 when an identified male suspect
suddenly appeared and shot the victim several times using a calibre .45 pistol.

56. After the incident, the victim was immediately brought to Davao Doctors Hospital
for medication yet at about 2:00 PM of June 1, 2014, he was still declared dead by attending
physician Dr. Gonzales.

57. Follow-up investigation yield to a composite facial sketch of the suspect as


described by the witness, one CHITO MALSIN BERNALES, 27 years old, single, automotive
technician of Hyundai Davao and a resident of PDRHAI Village, Km. 12, Sasa, Davao City.

58. On June 2, 2014, SITG ACUÑA was created by virtue of DCPO Special Order
Number 114 designating DCDO PSUPT NOEL M FERMIN as SITG Commander and PSUPT
ANTONIO E RIVERA, PSUPT ANTHONY O PADUA, PSUPT LINY T CORPUZ, PCI
WARREN E DABLO and PSI PAULINO A ZAULDA JR as members.

59. SITG ACUÑA conducted an interview with the victim’s girlfriend, a certain JO
ANN NG TAN, 29, years old, single, BPI employee and a resident of Alpha Tire Door No. 5,
Metrobank Bldg., Lizada Street, Davao City who revealed that she has a former boyfriend
identified as FRANCIS GERALD YEE ANG, 31 years old, single, businessman and a resident
of Road 1, No. 10, Doña Vicenta Village, Bajada, Davao City.

60. JO ANN NG TAN claimed that she was engaged with FRANCIS GERALD YEE
ANG for almost thirteen (13) years yet their relationship ended last 2013. She also averred that
after their break-up, she received text messages from different cell numbers that her boyfriend
want to renew their relationship and want to marry her until such time that she had a relationship
with the victim.

61. On or about 8:00 AM of June 4, 2014, SITG ACUÑA was able to interview one
KEVIN GERALDO FUENTES, 21 years old, single, a security guard of CORSAI Security
Agency and a resident of Tubalan, Malita, Davao Del Sur who alleged that at about 9:00 PM of
May 30, 2014, he was on duty at the guard house of insular Village, Phase 1, Brgy. Hizon,
Davao City when he saw an unidentified male person running along the highway and
immediately boarded a black pick-up which head towards Sasa area.

62. Recently, SITG ACUÑA was able to secure a material witness, whose identity
was still withheld for his/her security, who already executed an Affidavit linking FRANCIS
GERALD YEE ANG to the killing of the victim.

63. In view of the above development, SITG ACUÑA is looking at the love triangle
angle of the case and was in the process of consolidating all the physical and circumstantial
evidences for the filing of an appropriate case against FRANCIS GERALD YEE ANG.

issuance is centralized at the Criminal Records Management and Evidence Unit (CRMEU) of
DCPO thru a service provider, CAJ Information Solutions Corporation (CAJ).

67. In lieu of the collected fees, the City Government of Davao provides logistical
support to Davao City Police Office on a monthly basis, listed as the following:

a) Php1,000.00 amelioration allowance toall DCPO personnel; and


b) 191 sacks of rice and 8,450 cans of sardines which are distributed to all
DCPO police stations;

found to be unsatisfactory to absolve you from the offense charged. It is undeniable that the
wearing of the proper uniform and to have the complete paraphernalias are mandatory
requirements for every police officer, and thus failure to comply to such are not dependent on the
intention but merely to the fact of lack of ordinary prudence.
