(1) only terms commencing on or after January 1, 1995, shall be counted; and
(2) Notwithstanding any other provision of this charter or any other law, a person
who is elected at the general election in November, 2003 to the position of mayor,
city council president, or city council member shall be eligible to be elected to
that office for two (2) complete consecutive four year terms. In calculating terms
of office, two or more consecutive two (2) year terms shall equal one four (4) year
term. However in no event shall any person hold the office of mayor, city council
president or council member for more than ten (10) consecutive years.
(2) (3) If the mayor, city council president or city council member resigns, vacates
or is removed from office prior to the completion of a full term, he or she shall be
deemed to have held that office for a full term for the purposes of this section of
the Charter. If the resignation, vacancy or removal occurs within the officer's two
year term of office, the person elected or appointed to replace him or her shall be
eligible to serve for two (2) four year terms of office. If the resignation, vacancy
or removal occurs within the first two (2) year of the officer's four year term, the
person elected or appointed to replace him or her shall fill out the incumbent's
original term and be eligible to serve for one more four (4) year term of office. If
the resignation, vacancy or removal occurs within the last two (2) years of the
officer's four year term, the person elected or appointed to replace him or her shall
be eligible to serve for two full consecutive four (4) year terms. In no event shall
any person hold the office of mayor, city council president or council member for
more than ten (10) consecutive years. No service for a partial term by any person
elected or appointed to fill a vacancy shall be included in calculating the three (3)
complete consecutive four (4) year terms.
Section 2. This local law shall take effect immediately in accordance with
provisions of law and shall apply to all elections held on or after the date of its enactment.

SUBMITTED IN ACCORDANCE WITH SECTION §C4-6 OF THE CHARTER
SPONSOR(S): Majority Leader Michael Sabatino & Minority Leader Mike Breen
PURPOSE: This law extends term limits for elected officers from two (2) complete consecutive
terms to three (3) complete consecutive terms.
JUSTIFICATION: So that the term limits for City of Yonkers elected officials are consistent
with the term limits of elected Westchester County officials as set forth in the Westchester
County Charter.
