FACTS:
Sarmiento assailed the constitutionality of the appointments of Mison as Commissioner of
the Bureau of Customs and Carague as the Secretary of the Department of Budget without the
confirmation of the Commission on Appointments.

ISSUES:
Whether or not the appointment of Mison and Carague is constitutional?

HELD:
Yes. The courts held that the appointments of Mison and Carague are constitutional as
they are not specifically provided under the first sentence of Sec. 16, Art. VII which states the
appointments that need the concurrence of the Commission on Appointments.
