This letter is in response to the Freedom of Information Act (“FOIA”) request received by the City of
Chicago Office of Budget and Management (“OBM”) on September 25, 2018. OBM is now responding to
your request seeking:

“Details of all spending on police overtime from April 1, 2018 to present. Please include names of all
officers paid overtime, their titles and the amount paid.”

Enclosed are the records responsive to your request. Please be advised that records were redacted or
withheld pursuant to the Illinois FOIA.

The names of current undercover police officers and other sworn personnel performing certain
specialized functions are redacted pursuant to section 7(1) (D) of FOIA. 5 ILCS 140/7(1) (D) exempts
from disclosure “records in the possession of any public body created in the course of administrative
enforcement proceedings, and any law enforcement or correctional agency for law enforcement
purposes”.

Specifically, the names of these officers are exempt pursuant to subsection 7 (1) (D-vi) which exempts
information when it would “endanger the life or physical safety of law enforcement personnel or any
other person”. Because these officers are working undercover or on sensitive investigations and due
to the nature of their work in, disclosing their names as CPD personnel could expose them to risk of
physical harm and are therefore properly withheld pursuant to 5 ILCS 140/7(1)(D-vi). Moreover, the
names of these officers are also exempt under subsection 7 (1) (v) which exempts “unique or
specialized investigative techniques” in that once the identity of an undercover officer is disclosed, the
ability to use them for undercover officers in the future is compromised. Please note that their pay
information is included in full in the attached document, only the names are redacted.
To the extent your FOIA request is denied, you have a right of review by the Illinois Attorney General’s

telephone at (217)558-0486. You may also seek judicial review of a denial under 5 ILCS 140/11 of
FOIA.
