MOTION TO LIFT WARRANT OF ARREST

COMES NOW, ACCUSED, through the undersigned Public Attorney,

unto this Honorable Court, most respectfully avers:

1. That on August 14, 2018, the Honorable Court ordered the issuance of the
Warrant of Arrest against herein accused for his failure to appear on the
scheduled hearing of his case; a copy of the said Order is hereto attached as
Annex “A”;

2. That accused was not able to attend the scheduled hearing of his case
because at that time and date, he was also attending the hearing of his case
at RTC Branch __, __, for Criminal Case No. for Violation of Sec. 11 of
R.A 9165, as evidenced by a Certification issued by the Clerk of Court of
RTC Branch __ certifying the attendance of the accused in the above-entitled
case; a copy of the said Certification is herein attached as Annex “B”;

3. That accused failure to appear on his scheduled hearing was not deliberate
or meant to belittle the Court Notice regarding the hearing of his case or
belittle the proceedings of the case but for the reason afore-stated;

WHEREFORE, premises considered and in the interest of

substantial justice, it is most respectfully prayed unto this Honorable
Court to reconsider its Order on August 14, 2018 and lift the Bench
Warrant of Arrest issued against accused.
