    The Defendant’s response to March 13, 2011 letter addressed to Charles Witcher was letter of suspension for 10 days without pay in May 2012, Defendant’s criminally minded but unsuccessful provocation to kill Plaintiff on May 31, 2012 , UC Police Poster with Plaintiff’s photo and description which was closely akin to FBI posters for “Most Wanted “ criminals and terrorists and termination of Plaintiff ‘s employment on December 7, 2012 at Plaintiff ‘s age of 61 and half not to mention one and half year long Defendant’s psychological terror aimed at Plaintiff by Defendant’s agents and officers . Dear Mr. Witcher: I hope it's not any surprise for you that an employee is getting concerned after he found out or discovered that one group of employees in the same department got quite secretly a significant wage increase (over 10%) and he was left behind and forgotten and did not receive a penny in this share of dollars. It is appears that Cogen Operators wages under Title Code 8094 for Non —Represented were increased from level 5. to level 11.0. (Six levels up) I would not write this letter but money talk and stirring people mind and saying more simply I just feel discriminated in this share of goods. At the best of my ability to write, I will try to explain why I feel discriminated and left behind like an orphan in abandoned orphanage. Last year in August 2010 after I came back to work from vacation, my coworker from HVAC shop, Bill Rabidoux asked me if I will be willing to work swing shift because HVAC shop manager told him that second shift would be created for the Metasys System operation outside the Central Plant. I responded that it would be no problem. However, whole conversation got my attention and I concluded that during my vacation absence the Metasys Operation is still unresolved issue for somebody inside the department and he is trying to fix something that is not broken. My other thought was that Central Plant Operators submitted complaint and they are asking to remove the Metasys Operation from the Central Plant Shortly after, in September 2010, I received by copy of the undated but signed petition by four Central Plant operators in regards to Metasys Operation After I read the petition and attached to the petition the wages disclosure printed from the Sacramento Bee website, the first my thought was that the petition is a follow up to their earlier complaint which I thought they submitted in August during my vacation absence. The petition itself alleged that Metasys System operation has became full time job to monitor and it was my understanding from the petition that the $ 4.00 /hour wage increase for them would magically convert the full time Metasys Operation job to relaxing leisure in nice resort. Furthermore , the individuals who signed the petition alleging (without mentioning my name) that I am making $ 15,000.00 more than they are( I wish) earning and I am doing considerably less than they are . On top of this, petitioners are raising issue of three managers for twelve person crew in the Central Plant. I don't know how they omitted Mr. Mike Lewis in their calculations who appears to be in charge of these three mentioned managers. I don't know if it is lack of respect for Mr. Lewis or they are targeting Central Plant Maintenance Supervisor who I as heard he became a salt in their eyes. Few days later after I got the petition I have heard from source different than Central Plant that Central Plant Manager Mr. Steve McGrath making accusations that I was involved in writing this petition for Central Plant Operators. I did not want to engage myself in any conflict or discussion with these individuals who are attacking my wages and my duty and I did pass the copy of the petition to Mr. Dennis Curry. Thereafter I forgot about it and concluded this event as a "NEVER ENDING TRAUMA IN THE CENTRAL PLANT " taking in consideration that the same group of individuals viciously and recklessly attacked me an

    This is really out of the norm to post this in the department and I was not aware that we were going to do
    this. Did we ask the police to do this? His letter stated that he would remain on paid leave which implies
    the same expectations but I am a little concerned that this is being posted in the department since we
    have not done this before on any other violence cases.
    s Just want to make sure that we sanctioned this before it was posted in the department because I suspect
    we will be getting an email about it soon.

    The Bulletin attached below was delivered to FSSB Suite 1500 yesterday afternoon about 3:00 pm by a
    uniformed officer.

    Were these Bulletins delivered to other locations were PO&M has staff located?

    The Letter of Intent to Dismiss, our last communication with Jerry, did not have any statements requiring
    Mr. Waszczuk to stay away from the Sacramento Campus as a requirement of his "paid administrative
    leave". Is any additional communication with Jerry required to ensure his understanding of this
    requirement?

    Can you please go into eHR as there appears to be an eval in the system with an unsatisfactory rating for
    Jaroslaw Waszczuk employee ID 100007732. Once you located it please cancel the eval totally out of the
    system (i.e., delete). Steve has indicated that he was on leave for the majority of the review period and
    should not have been evaluated with an unsatisfactory rating. 4..__.__

    Can you please initiate a deferral on this employee as well, pushing the eval date out a year to September
    2013? -dd

    Can you advise the dept that we have done this? Steve shared with me the pending action on this
    employee and that we will probably want to correct the system immediately.

    The reason J. Waszczuk is not receiving an incentive is that he was on leave and suspension without pay
