Staff Report
RECOMMENDATION:
That the City Council approve Resolution No. 2018-093, authorizing the City Administrator to execute a
Professional Services Agreement with Fasulo Investigations.
BACKGROUND/SUMMARY:
Over the past several years the City has used an outside professional service (Fasulo Investigations) to provide
code compliance support as an alternative to in-house staffing. The City is in the final stages of the recruitment
for a full-time Code Compliance Coordinator, and it is anticipated that the position will be filled by the end of the
calendar year.
The current contract with Fasulo Investigations expired on August 31, 2018. It is recommended that the City
enter into a new agreement with Fasulo Investigations to cover the remainder of the fiscal year, from September
11, 2018 through June 30, 2019; for an amount not to exceed $44,000. The contract will allow Fasulo
Investigations to provide training support and additional code compliance services as needed. Staff
recommends that Council adopt this resolution authorizing execution of an agreement for services commencing
on September 11, 2018.
FISCAL IMPACT:
Within the proposed Fiscal Year 2018-19 budget, the Community Planning and Building Department has
included funding for contractual code compliance services and there will also be salary savings available from
the Code Compliance Coordinator position, which was not filled for the first several months of the fiscal year.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA
AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE AN AGREEMENT WITH FASULO
INVESTIGATIONS FOR CODE COMPLIANCE SERVICES IN AN AMOUNT NOT TO EXCEED
$44,000 FOR THE PERIOD OF SEPTEMBER 11, 2018 – JUNE 30, 2019
WHEREAS, the City’s Community Planning and Building Department’s utilizes contracted
code compliance services to help ensure compliance with land use, zoning, and public health and
safety codes and regulations as an effort to preserve the Village’s character and aesthetics; and
WHEREAS, the Department has included funding for contractual code compliance services
within the proposed Fiscal Year 2018-19 budget; and
WHEREAS, the City issued a Request for Proposals on April 25, 2016 and published a notice
soliciting proposals in the Carmel Pine Cone on April 29 and May 6, 2016; and
WHEREAS, Carmel Municipal Code §3.12.160 allows for competitive negotiation and the City
to accept the best offer as judged against proposal criteria; and
WHEREAS, the City received three proposals on May 13, 2016 and reviewed the proposals
for responsiveness, experience in providing services in similar communities, hourly rate and approach
to code compliance and selected Fasulo Investigations based on these criteria; and
WHEREAS, per Municipal Code §3.12.160, any offer of $25,000 or more shall require
approval by resolution of the City Council.
