AFFIDAVIT OF UNDERTAKING

I, SAMUEL TOBIAS y PABIO, after having been duly sworn

to in accordance with law, do hereby deposes and states:

1. That I respectfully request to transfer the custody of Black

Pick up Ford Ranger registered in the name of my wife ROWENA
MERCADO TOBIAS, from Santiago City Police Station 1, Santiago
City, to their residence at Purok 1, Dipantan, Nagtipunan Quirino
more particularly described as follows:

Series: Ranger Black Pick-up
Engine No: P4AT2423274
Chassis No: MNCLMFF80HW713535

2. That the aforesaid Utility Vehicle figured in an alleged

buy-bust operation on 25 January 2018 at around 3:50 PM at Four
Lanes, Malvar, Santiago City;

3. That I undertake to produce the said Utility Vehicle

whenever required for evidentiary purposes and to present the
certificate of registration and official receipt whenever required and
upon due notice;

4. That the Santiago City Police Station 1, Santiago City has

no obligation regarding the release of the above-described Utility
Vehicle;

5. That I execute this affidavit in order to affect the release of

the above-described Utility Vehicle in my custody;
