CITY ORDINANCE NO. 2014-031

AN ORDINANCE CONTROLLING THE RATIONAL USE AND
SALE OF VETERINARY BIOLOGICS AND OTHER VETERINARY
PREPARATIONS IN THE CITY OF CABADBARAN, AGUSAN
DEL NORTE, AND FOR OTHER PURPOSES.

EXPLANATORY NOTE

The problem of satisfying the dietary requirements of a growing world

population is becoming increasingly acute. Drugs that improve the rate of weight gain,
improve feed efficiency, or prevent and treat diseases in food-producing animals are
critically needed to meet the challenge of providing adequate commercial amounts of
food for that population.

But, the benefit of improved production from the use of animal drugs in food
producing species is not obtained without risk - the risk associated with drug residues
that remain in the tissues of treated animals at the time of slaughter and non-
withdrawal period as specified by the manufacturer.

By definition, a chemical residue is either the parent compound or metabolite of

the parent compound that may accumulate, deposit, or otherwise be stored within the
cells, tissues, organs or edible products (e.g. milk, eggs) of an animal following its use
to prevent, control or treat animal disease, or to enhance production. Residues can also
result from unintentional administration of drugs, or food additives. Finally accidental
exposure to chemicals in the environment can also result in tissue residues.

From public-health viewpoint, both the U.S. Government and producers

associations have taken active roles in minimizing antibiotic residues in meats and
milk. Penicillin for example, is known to induce allergic reactions in some sensitive
people, and therefore, penicillin-tainted milk poses a health risk for these individuals.
Similarly, chloramphenicol has been reported to induce blood dyscrasias that may
lead to death; hence its use in food-producing animals has been prohibited by the
Food and Drug Administration (FDA). The FDA has also prohibited the use of
nitrofurans in food-producing animals (excluding the topical routes for administration)
because studies have shown them to be carcinogenic.

The responsibility for residue control and prevention cannot lie solely within a
governmental agency; rather the responsibility must be shared by the government,
producers, veterinarians, teachers and academicians, marketing associations, and
other interested parties, who must strive for both healthy and efficiently grown
animals as well as a safe food supply.

Government regulation and control should necessitate more stringent adherence

to withdrawal times.

On-site monitoring for many drugs must be instituted. 1

WHEREAS, Section 3 (a) of Republic Act No. 9296, otherwise known as the
Meat Inspection Code of the Philippines, declares that the state shall ensure the
protection of human and animal health against direct and indirect hazards and in
particular, the protection of consumers against zoonotic diseases, meat-borne infection,
intoxication and hazards associated with residue from treatment or exposure of
slaughtered animal;

WHEREAS, Administrative Order No. 14,series of 2006, was issued to

implement the National Veterinary Drug Residues Control Program and the creation of
an Inter-Agency Committee to ensure compliance to international standards on residues
of veterinary drugs in food and rational drug use in feeds;

WHEREAS, a collection of sample was taken from the Cabadbaran City Abattoir
and sent to Manila for laboratory testing to screen the content of veterinary drug
residue. Based on the laboratory report conducted by the National Meat Inspection
Service, there is a high content of drug residue;

WHEREAS, the presence of veterinary drug residue in human food is a concern

that should be addressed in the production, processing and marketing systems of food
producing animals and food products derived from them to ensure consumer
health and safety. Antibiotic residue produces potential threat to direct toxicity in
humans and low level of antibiotic exposure would result in alteration of microflora,
transfer of antibiotic-resistant bacteria to the humans, carcinogenicity, nephropathy,
hepatotoxicity, reproductive disorder, bone marrow toxicity and allergy.

BE IT ORDAINED, by the Sangguniang Panlungsod of Cabadbaran City, Agusan

del Norte in its 87th Regular Session assembled, that:

SECTION 1. TITLE – This Ordinance shall be known as “Veterinary Biologics

Ordinance” of Cabadbaran City.

SECTION 2. DECLARATION OF POLICY – It is the policy of the City of

Cabadbaran to protect consumer health and safety by regulating the use and sale of
veterinary biologics and other veterinary preparations.

SECTION 3. SCOPE AND COVERAGE- This Ordinance shall apply to all

veterinary clinics, agrivet stores/suppliers, pharmacy and other stores who sell,
dispose and distribute veterinary biologics and other veterinary products, feed
technicians, free lance technicians and veterinarians operating within the
jurisdiction of the City of Cabadbaran.

SECTION 4. DEFINITION OF TERMS. – For the purpose of this ordinance,

the following terms shall mean:

a) Agrivet supplier - shall refer to any establishment selling agricultural

products, pesticides, fertilizers, and other veterinary products;

b) Veterinary biologics – are animal health products such as vaccines, antibody

products that are used for the prevention, treatment, or diagnosis of infectious
diseases including domestic livestock, poultry, pets, wildlife and fish;

c) Blood dyscrasia – an abnormal condition of the body especially the blood;

d) Medicinal preparations - for veterinary use, are those pharmaceutical

products for the treatment and prevention of diseases as well as for other
purposes in the protection and improvement of livestock, poultry and house pets;

e) Feeds - shall include all such articles used for the purpose of feeding supporting
to supply protein, carbohydrates, fats, minerals, vitamins, antibiotics, and/or
correcting nutritional disorders. Such articles may be locally produced or
imported, mixed, or in the form of simple ingredients;

f) Livestock - comprise the mammalian animals, and poultry, the avian animals
which are domesticated and kept or raised in backyards or on farms;

g) House Pets - are those animals which are kept in homes like dogs, cats, birds,
etc.;

h) Technicians - are individuals trained to perform veterinary and/or agricultural

practices, but can work under direct supervision of a licensed veterinarian;

i) Veterinarian - is a graduate of Veterinary Medicine and issued with a

registration of Professional Identification Card and registered with the
Professional Regulatory Board of Veterinary Medicine in the Philippines;

j) Zoonotic disease – a disease communicable from animals to human under

natural condition;

k) Carcinogenicity – a substance or agent causing cancer;

l) Nephropathy – an abnormal state of the kidney;

m) Hepatotoxicity – a state of toxic damage to the liver

SECTION 5. REGULATIONS AND PROHIBITIONS. – All veterinary clinics,

agrivet supply establishments, pharmacy and other stores who sell, dispose, and
distribute veterinary biologics and other veterinary products within the jurisdiction of
Cabadbaran City, must:

a) Be a Duly Registered Veterinary Drug and Product Outlet (VDAPO) from the
Bureau of Animal Industry (BAI);
b) Not dispense any veterinary biologics and medicinal preparations (water soluble
powder, capsule, tablet, injectable, and ampule) without a prescription from a
duly licensed veterinarian;
c) Keep a file and record in a prescription book all prescriptions for veterinary
presentation or ethical drugs. Said file or record shall be kept for two(2) years
after its last entry and shall be open for inspection at any time during business
hours by the City Veterinarian or his/her duly authorized representative;
d) Separate animal feeds and other veterinary products from pesticides and
fertilizers to avoid contamination. Pesticides and fertilizers must be enclosed in
one area away from veterinary products;
e) A prescription should not be pre-prescribed or ready-made signed by the
consultant veterinarian.
f) Have different and exclusive filing cups for fertilizers and veterinary products, in
case of retail.
g) Hire licensed veterinarian.
h) Prohibit licensed and non-licensed technicians from acting as consultants or
prescribing veterinary biologics, veterinary medicine and acting on animal health
by injecting, vaccinating and treating or administering Rx preparation without
direct and actual supervision of a licensed veterinarian.

SECTION 6. MONITORING – For the proper and effective implementation of

this Ordinance, the City Veterinary Office shall conduct random monitoring and
surveillance of all establishments selling veterinary products and biologics, fertilizers
and pesticides within the jurisdiction of the City of Cabadbaran.

SECTION 7. PENALTIES. – The following fines and penalties shall be imposed

to any person, natural or juridical, who violates any provision of this ordinance.

A. 1st Offense - (P2,000.00)

B. 2nd Offense - (P5,000.00)
C. 3rd Offense – Temporary closure of establishment (5 days)
D. 4th Offense – Permanent closure of establishment

If the violation or offense is committed by a corporation, partnership, single

proprietorship, association or other juridical entities, the penalty provided for in this
Ordinance shall be imposed upon the directors, officers, employees or other
officials or persons therein responsible for the offense, without prejudice to the civil
liabilities arising from the criminal offense.

SECTION 8. INFORMATION, EDUCATION AND COMMUNICATION

CAMPAIGN – In order to give all affected parties adequate time for learning and
adjustment, the City through the City Veterinary Office shall conduct Information,
Education and Communication (IEC) campaign fifteen (15) days from the date of
the effectivity of this Ordinance.

SECTION 9. SEPARABILITY CLAUSE. – If for any reason, any provision,

section, or part of this ordinance is declared invalid by the court, such judgment
shall not affect or impair the remaining provisions, sections or parts which shall
continue to be in full force and effect.

SECTION 10. REPEALING CLAUSE. – All Ordinances, rules and regulations

or parts thereof in conflict with or inconsistent with any provisions of this ordinance
are hereby repealed or modified accordingly.

SECTION 11. EFFECTIVITY. – This ordinance shall take effect immediately

upon approval and compliance of the posting and/or publication requirements.
