2 What is a will

 Testator, testatrix and beneficiary

 Legally valid and enforceable if the Will has been executed in accordance with applicable law
 Singapore law applies to Wills executed by a person domiciled in Singapore at the time the Will
was executed or at time of his death
 Domicile: place that he regards as his permanent residence

2.2.1 Requirements as to Testator

 At least 21 yo
 Of sound mind and capacity at the time the Will is executed
 If he understands that he is executing a Will
 What effect his Will is intended to have on his property
 What property he has
 Who is to benefit under his Will
 On what terms the beneficiaries are to benefit
 Not an undischarged bankrupt at the time he executes the Will (when someone is made bankrupt,
assets and property are vested with the Official Assignee instead so any document purporting to
dispose of his assets and property is void)

2.2.2 Requirements as to form

 Has to be in writing
