It is necessary that the notice of initial hearing for the land application be published
a. What is the purpose of this publication?
 The purpose of the publication are
o To confer jurisdiction upon the court over the res
o To apprise the whole world of the pending registration case so they
could assert their rights and oppose the application
b. Where are you supposed to publish?
 Section 23 of PD 1529, states that the notice of initial hearing be published once
in the Official Gazette and once in a newspaper of general circulation in the
Philippines.
c. Aside from publication, this notice of hearing shall also be posted by the sheriff of the
court. Where should the same be posted?
 The notice must be posted in:
o A conspicuous place on each parcel of land included in the application
o A conspicuous place on a bulletin board of the municipal building of the
municipality or city where the land or portion of which is situated.
2. Who can oppose the application? And what should be alleged in the answer or opposition?
 Section 25 of PD 1529 states that, any person claiming an interest, whether
named in the notice or not, may appear and file an opposition on or before the
date of initial hearing, or within such further time as may be allowed by the
court.
 The opposition shall state all the objections to the application and shall set forth
the interest claimed by the party filing the same and apply for the remedy
desired and shall be signed and sworn to by him or by some other duly
authorized person.
3. If one fails to answer what will be the move of the applicant.
 The applicant must file a motion to the court to issue an order of default and upon its
grant, the applicant can proceed with the presentation of his evidence.
4. What is meant by order of general default
 Order of general default—if no person appears and answers within the time
allowed; by description in the notice “to whom it may concern”, all the world are
made parties defendant and shall be concluded by the default order
5. What are the evidence you are supposed to present to support your application?
 The applicant must present the following:
o Documents to confer jurisdiction to the registration court must be first marked
as exhibits, presented and offered. Documents like a copy of the Official Gazette
containing notice of the initial hearing, affidavit of publication executed by the
editor, copy of the newspaper of general circulation containing the notice of the
initial hearing among others.
o Proof to show that he is the owner of the land being applied such as tax
declaration and other documents that shows continuous possession of the land.
As well as prove the identity of the land and that land is alienable or disposable
