PROPERTY LAW

COURSE DESCRIPTION AND OBJECTIVES

This course deals with the fundamentals of private property Iaw in the
ehilippines, focused on the basic concepts of property; the Iaw on
ownershl-p, possession, and usufruct; and certain modes of acguisition
of propeityl as l-aid under the New Civil Code. Special Iaws pertaining
to specific property regimes (e.9., intellectual property) or
p.o.-"dt,t." t".S., lind titlinq) are not included. By the end of this
.o,rr"e, students should be well-acquainted with the most fundamental
rules on property and the exercise of property rights in the
ehilippines.

of the New Civil Code (NCC), students are rgquired.to read the
correspondinq commentaries by Tolentino. This applies to NCC

outside ifre UCC, students may then refer to any available textbook on
the subject.
SCHEDULE OF READINGS

The schedule of topic assignments over the course the semester is Iaid
out in the table at the end of this syllabus. Each topic assignment
corresponds to at Ieast one class session. Cases marked wj-th '*' are
optional readings for purposes of discussion, but students who are
able to discuss them will be accorded a premium,/bonus mark. Optional
readings are included in the coverage of examinations.

GRADING REQUIREMENTS

The final grade shall- have three components: recitations/quizzesl


including attendance (30U ), mid-term exam (35?) and the final exam
(3s% ) .

For recitation, students shall be called at random and then


interrogated, about their knowledge and comprehension of the provisions
and cases assigned. Students should focus on integration of rules,
exceptj-ons, quatifications, and interpretations. Special attention is
to be given to synthesis and integration of points of Iaw.

Discussions need not necessarily foIlow the linear path laid out in
the course outline; hence, students are advised to study the entire
assigned topic and not just sequential parts thereof.
If a student call-ed for recitation turns out to be absent, s/he shall-
be given one failing mark for recitation.
Surprise quizzes or speciaf/occasional assignments, normally held to
ensure that students keep up with assigned readings, shal1 be
consj-dered as one recitation. Students shall have ready at all times,
at least 2 sheets of yellow writing pad ( "yellow paper" ) for any
surprise quizzes, which may be held at any time at the discretion of
the professor. Each quiz is equivalent to one recitation.
Eor AY 2074-2015, periodi-c examinations shall- be given at the end of
each month.

GROT'ND RT'LES

The U.P. CoIIege of Law requires compliance with the highest standards
of academic performance, personal integrity, and self-discipline.
Those who fall behind with respect to these standards shoufd not
expect to remain in this cIass, or indeed this College, fot Iong.
Students shall- come to class decently dressed in appropriate attire.
Informal or house attire (i.e., shorts, undershirts, pajamas, flip-
flop slippers, etc.) is absolutely prohibited. Anyone coming to class
in such attire shal-I be immediately sent home where such attire
belongs.
In the classroom and in the presence of the professor, students shall-
observe proper decorum and conduct themsel-ves in a manner worthy of
the legal profession. Childj-sh or adolescent behavior shall not be
tolerated.
Laptop and tablet computers, mp3 players, cameras, video recorders,
smartphones, smart pens, or other simil-ar efectronic devices capable
of audio and,/or video recording are not al]owed in class. Anyone
caught with such devices on their tables, whether or not in operation,
shall be sent out of class and given an failed recitation grade.
Students are permitted to have only their personal handwritten notes
and ordinary pens or paper on their tables. Textbooks or photocopies
shall not be opened or referred to except upon direct instruction of
the professor. Anyone who violates this rul-e shal-I be sent out of
class and given a fai1ed recitation grade.
Students shal-I not attempt to give gifts of any kind to the professor,
regardless of value or occasion. Such actions shall be considered as
attempted bribery, or at the very least, attempts to curry special
favours from a public officer, in violation of Iegal and ethical rules
of conduct. Such actions shall be considered as sufficient to warrant
a f ailing grade outr j-ght.
Grades shall be rel-eased with ful-I transparency, with the bases and
computation thereof cl-early indicated. Grades are appea]lable on only
two grounds: ( 1 ) error j-n recording of grades previously given t for
which there is corresponding written evidence subsrj-bed by the
professorl, or (2\ error in the computation of the raw or final
grades. No other qround is acceptable.
Students shall not attempt to "negotiate" their final grades in any
manner or whatever reason, whether by manipulation of any of its
components or by seeking special treatment or consideration on grounds
not availabl-e to everyone el-se in cl-ass. Personal pleas for mercy or
sympathy are especially prohibited. Any such attempts shall be treated
with extreme prejudice, and may warrant a failing grade outright.
Evening students are not exempted from this rule.
Where the outline points to an unfamiliar technical word, phrase,
classification, or language, students are expected to exercise due
diligence and determine their meaning.
