Contract No.

: AQUA/ME/ITT/01 Date: 07 August, 2018

This contract is made on the 7th August 2018 between Aqua Refinery Limited (Employer),
(Address: South Avenue Tower, 2nd floor, House 50, Road 3, Gulshan 01, Dhaka 1212) and ME
Engineering (Contractor), Roha Mansion, House 13/1, Road no 2, Shyamoli, Dhaka-1207 for
the pipe line fabrication, pipe rack, pipe shoe fabrication, Hydro testing, commissioning and
handover of Inter tank transfer (ITT) line at Aqua Refinery Ltd.,Shantanpara, Danga, Polash,
Narsingdhi.

Project Location:

Shantan para, Danga, Polash, Narsingdhi-1600, Bangladesh

Contractor Scope of Works:

1. All consumables like Oxygen, Acetylene, Argon, LPG, Welding rods, grinding stones,
and emery paper etc.
2. Contractors must supply all electrodes as per code and standard supplied by ARL.
3. Welding machines, cutting sets etc.
4. Contractor shall follow different types of working procedures provided time to time by
ARL, such as surface cleaning and painting procedures, WPS, Hydro test procedures
etc.
5. Welding qualification test should be held on job site as per ASME section IX and only
qualified 6G welders will be allowed to weld field joints.
6. Pump and other tools and tackles arrangement for hydro test.
7. Hydraulic pressure test have to arrange by the contractor.
8. Flushing, drying, after hydro test shall be arranged by contractor. Air compressor and all
other tools and tackles shall be arranged by contractor.
9. For flushing, drying, after hydro test; required temporary spool piece, gasket, etc. shall
have to be arranged by contractor.
10. Painting consumable (power brush, round brush, rags and all others) for painting.
11. Painting will be as per painting and SSPC specification
12. Cranes, forklift, trolley, trucks, scaffolding materials and other tools and tackles required
to install process equipment, piping spools, valves etc. at any point and at any elevation
of the plant shall be arranged by the contractor.
13. Contractor shall have to engage technically sound, trained and experienced site
engineer, supervisor, fitter, fabricator, welders and other workers.
14. Contractor shall have to engage sufficient numbers of manpower, welding sets and
welders, equipment and accessories to complete all work within the date stipulated by
ARL authority.
15. Work should be done by supplied drawings and responsible ARL engineer’s instruction.
16. Production report and inspection report will be as per format provided by ARL.
17. Contractor authorized respective shall be present during working hours at the job site for
receiving orders and recording the measurement of work and he shall also maintain day
to day job progress report.
18. Quality of work shall be of the first order. For improper or irregular or haphazard
work done contractor shall have to rectify the defects. No compensation will be
entertained for such rectification work.
19. Contractor shall be responsible for proper and safe storing of materials of their
own and that of ARL after issuing from ARL store. In this respect ARL will not
entertain any demand or claim for any damage or loss of materials under any
circumstances.
20. Contractor has to make their office space, fabrication shop and store at their own cost.
21. Contractor will be liable for their manpower, machinery and tool.
22. Contractor must follow materials control procedure.
23. All documentation shall have to be done properly and for that reason a designated
document controller shall have to be appointed by controller.
24. All residential facilities will be arranged by contractor.
25. Contractor must equip their people with safety shoe, safety belt, safety goggles, and
helmet for ensuring their personal safety.
26. Contractor shall be fully responsible for any kind of accident while executing the work by
their staffs. In such cases compensation payable to the claimant shall be paid by
contractor.
27. Contractor will be responsible for all personal introduced at site for obeying all rules and
regulations of ARL including safety rules. For each and every personnel ID card issued
by ARL must be carried, gate entry and exit pass to be taken from security for any
materials entry and exit.

28. Contractor has to clean the site after completion of the work.
29. For unforeseen items mutually negotiated rates shall be accepted.

ARL Scope:

1. Water supply for hydro test of all tank area.


2. Quality and specification of consumables shall be defined by ARL.
3. Beam, angle, channels and plates will be given by ARL for pipe support fabrication.
4. ARL will supply all pipes, fittings, valves etc.
5. Fabrication, welding, inspection and testing will be as per ASME B31.3 (Process piping).
6. Suitable space will be given by ARL for office space, fabrication shop and store.
7. ARL will do the NDT.
8. ARL reserves the right to add or to cancel one or more than one items or quantity and
engage other contractors simultaneously for the items or for the whole job in the interest
for the quality and quick progress of the work or to complete the job within the stipulated
time.
9. Civil foundation works for pipe support is ARL scope.
10. Power (150KW-200KW, 3Phase, 4 wires, 415V 50Hz), water for construction and utility
is employer scope. Contractor will arrange to extend the connections with necessary
distribution box, cable, pumps etc.
11. Employer will provide only space to contractor to set up site office, store and labor shed.
Contractor will construct them by his own.
12. Rate of works is excluded VAT and TAX.
13. Contractor will not be allowed to appoint any subcontractor.
Rates of Work:

Please go through the Annexure 1.

Work and Quality:

1. ARL will do 5% RT (1st RT) on random basis from each individual pipe line. If the welding
joints found defective after performing 1ST RT Contractor will repair those joints. After
repairing ARL will do 2nd RT on those defective joints. Contractor will bear all re-repair
joint cost and subsequent RT cost as a penalty of the failure of 2nd RT on repair joint.
ARL will do next 50% RT of all joints in that pipe line done by that guilty welder. The
welder will be fired immediately after getting 20% failure of those 50% RT and contractor
will have to engage another qualified welder. Contractor will be responsible for rectify
those 20% defective joint and he should run and submit passed RT report on those
joints.
2. .Contractor has to arrange everything for his people to do on field welding qualification
test by supplying consumable, NDT etc. ARL will provide only pipe material, power.

Work Eligibility:

1. All jobs will be performed by qualified man power.

Safety and Security:

1. Contractor shall arrange all PPE for his people.


2. Employer will provide site security and lighting.

Completion of works:

All jobs will have to finish by two months after the date of start.

Payment Mode:

1. 10% of the total estimated value to be paid as mobilization advance along with the work
order.
2. 20% of total estimated value shall be paid as 1st running bill after completion of 30%
work of whole work.
3. Rest 20% of total estimated value shall be paid as 2nd running bill after completion of
60% work of whole work.
4. Rest 20% of total estimated value shall be paid as 3nd running bill after completion of
90% work of whole work.
5. Rest 20% of total estimated value shall be paid as final bill after completion of 100%
work of whole work.

10% retention money will be kept for six months as Guarantee period which may be released
upon submission of bank guarantee.
