The Implementation of the CLP Regulation for Mixtures

Understanding CLP

The Classification, Labelling and Packaging (CLP) regulation (European Regulation (EC) No 1272/2008) was
implemented on 20 January 2009, as the EU implementation of the United Nations’ Globally Harmonised
System on the classification and labelling of chemicals (GHS). Known hazards of a substance are
communicated using pictograms and hazard statements on safety data sheets and labels. The CLP regulation
replaces the Dangerous Substances Directive (DSD) and the Dangerous Preparation Directive (DPD) with full
implementation from June 2015 when mixtures must be classified in accordance with CLP. Substances have
been subject to the CLP regulation since December 2010, therefore this change has already been implemented
for the majority our products and our MSDS for these products carry the new classifications and labels.

CLP and mixtures

From 1st June 2015 the CLP regulation will begin to cover chemical mixtures (i.e. home care formulations). As
a result of this, suppliers of substances and mixtures will be required to clearly display labels on the packaging
of chemical mixtures that contain any hazardous substances above a certain threshold or where data exists on
the mixture. There will however be exemptions from displaying the hazard information on packaging smaller
than 125ml or that which is otherwise difficult to label. There will be a 2 year sell through period for any current
mixtures labelled under the DPD and are already in the supply chain before the regulation begins. In order to
help customers manage this change we have provided a summary of products carrying no classification.

New Concentration Thresholds

The CLP regulation for mixtures will alter the current classification thresholds which means some chemical
mixtures will appear to be more severely classified, or may have to carry a hazard pictogram that they didn’t
previously. For example a mixture containing 7% of a corrosive substance would carry an ‘irritant’ classification
under the DPD however with the new CLP regulation this will require a ‘corrosive’ classification.
This change will have the biggest impact on both the skin damage/irritation and eye damage/irritation
classifications.

Skin Damage/Irritation

Materials classified with skin damage/irritation are split into 2 categories depending on the severity. Skin
Category 1 is the most severe and materials will carry a corrosive label when used at a concentration ≥ 5% and
Skin Category 2 will carry an irritant label when used at a concentration ≥ 10%.

Eye Damage/Irritation

Materials classified with eye damage/irritation are split into 2 categories depending on the severity. Eye
Category 1 is the most severe and materials will carry a corrosive label when used at a concentration ≥ 3% as
well as having irreversible eye effects. Eye Category 2 will carry an irritant label when used at a concentration
≥ 10% and is considered to have reversible eye effects.

Potential Outcomes

The CLP regulation provides guidance on methods for classification of a mixture, such as classifying from test
data on the mixture; using ‘bridging’ principles to read across from similar formulations; using a calculation
method for ingredients or using the translation tables in CLP Annex VII. Some businesses have already
commenced in-vitro studies to determine the effects on skin and/or eye cells with the aim of reducing the
hazard classification that their formulations will carry. Data is being generated for new and existing substances,
and hence components of mixtures, which require REACH registration in Europe. This data may have an
impact on how many products are classified in the future.
