Los órganos del concurso mercantil, son aquellos cuyas funciones están encaminadas a
apoyar e iluminar las decisiones del juez, son personas físicas seleccionadas y supervisadas
por el Instituto Federal de Especialistas de concursos Mercantiles (IFECOM), siendo éste
último, un auxiliar de la Judicatura Federal, cuyos papeles serán los de VISITADOR,
CONCILIADOR o SÍNDICO en primer lugar, y en segundo, se señala a aquellos denominados
INTERVENTORES, cuyo papel es velar por los intereses de los acreedores que previamente
se hayan constituido como RECONOCIDOS.
Cada Órgano tiene un cargo o encargo particular y se espera que quien lo asuma
sea particularmente apto para ello y cumpla con el trabajo en las condiciones de
oportunidad, formalidad y corrección que la ley le exige.
SÍNDICO Toma posesión de la empresa, vende los bienes y paga a los acreedores.
The organs of the commercial bankruptcy, are those whose functions are directed to
support and illuminate the decisions of the judge, are natural persons selected and
supervised by the Federal Institute of Commercial Competitors (IFECOM), the latter being
an auxiliary of the Federal Judiciary , whose papers will be those of VISITOR, CONCILIATOR
or SÍNDICO in the first place, and secondly, it is indicated to those called INTERVENTORES,
whose role is to watch over the interests of the creditors that have previously been
constituted as RECOGNIZED.
Each Body has a particular charge or assignment and it is expected that whoever assumes
it will be particularly apt for it and will comply with the work in the conditions of
opportunity, formality and correction required by law.
VISITOR It is the one that makes the visit to the company, makes sure to have access to all
kinds of information that has to do with it, as well as being the one who decides if the
merchant, as a subject of Mercantile Law, is in certain cases by law, to be declared in
Commercial Contest.
CONCILIATOR This seeks the conclusion of an agreement between the merchant and his
creditors and monitors the performance of the merchant. It should be noted that the
conciliator takes action when it is in the Conciliation stage -Value redundancy- since it is at
this stage that the merchant avoids being executed, suspends payments and continues
with the administration of his company, under the supervision of this figure. The
conciliator actively participates in the recognition, graduation and priority of credits. The
conciliation stage normally lasts six months, but when there is a probability of signing an
agreement, there may be up to two extensions of three months each. The conciliation
stage may end even before six months, when the conciliator requests it because there is
no provision or possibility for the conclusion of an agreement.
SÍNDICO He takes possession of the company, sells the goods and pays the creditors.

It should be noted that unlike the L.C.M., there is no figure of the inspector or conciliator,
however, in both are the figures of the SÍNDICO and INTERVENTOR.
