 Caveat petition under Section 148-A

C.P.C. for granting an opportunity of

hearing to the Caveators/respondents

before granting any ex-parte ad-

interim relief to the expected

petitioners in the CR Petition.

RESPECTFULLY SHOWETH:-

1.That the present Caveator/respondent is

the plaintiff in the case titled

“Kuldeep Kumar & another Vs. Punjab

State Power Corporation Ltd. & others”

which is pending before the Ld. Court

Civil Judge (Jr. Divi.), Ludhiana.

2.That the caveators/respondents had filed

an application u/o 39 Rule 1 & 2 read

with section 151 C.P.C. and the same was

filed in the suit for mandatory and

permanent injunction. That this

application of the caveators/respondents

was allowed by the trial court vide

order dated 13.11.2017. Being aggrieved

of the order dated 13.11.2017, the

expected petitioners filed an appeal

against the above order passed by the

 court of Ms. Ramneet Kaur, Civil Judge,

Junior Division, Ludhiana.

3. That the Appellate Court vide order

dated 14.3.2018 partly allowed the

appeal filed by the expected petitioner.

Copy of the order dated 14.03.2018

passed by Addl. District Judge, Ludhiana

is attached herewith as Annexure C-1.

4.That now the above named expected

petitioners are very likely to approach

this Hon’ble Court by way of Civil

Revision thereby challenging the order

passed by Addl. District Judge Ludhiana

dated 14.03.2018 since the Appellate

Court has not awarded the appropriate

relief which was sought by the expected

petitioners and hence this caveat

petition before this Hon'ble High

Court.

5.That the Caveator/respondent seek kind

indulgence of this Hon’ble Court that he

may be granted an opportunity of hearing

before passing any order in favour of

 the expected petitioners so that he may

not suffer in any manner.

It is, therefore, respectfully

prayed that the Caveator/respondent may

kindly be granted an opportunity of hearing

before passing any ex-parte ad-interim

relief to the expected petitioners in Civil

Revision which is likely to be preferred by

the expected petitioners, so the Caveator-

respondent may not suffer in any manner.

sent by registered post to the petitioners

and postal receipt in respect thereof is

annexed herewith.
