JUDICIAL AFFIDAVIT OF WITNESS

DR. CHESTER C. COSIN

I, DR. CHESTER C. COSIN, of legal age, married and a resident of F.

Abellanosa Street, Cagayan de Oro City, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Olezardo Jose I. Uy with address at

Max Suniel Street, Carmen, Cagayan de Oro City. The examination being held at
the same address. I am answering his questions fully conscious that I do so
under oath and may face criminal liability for false testimony and perjury.

This affidavit/testimony of Dr. Chester A. Cosin is being offered as support

to the counter-affidavit of defendant Pedro D. dela Cruz in the abovementioned
criminal case filed by private complainants Cedric D. Javier and Efren N.
Corona.

Questions (designated by “Q”) by Atty. Olezardo Jose I. Uy.

Answers (designated by “A”) by Dr. Chester C. Cosin.

Q.1: Will you state your name and other personal circumstances?
A: I am DR. CHESTER C. COSIN, 45 years old, married, and a resident
of F. Abellanosa Street, Cagayan de Oro City. I am a psychiatrist and
currently working in Northern Mindanao Medical Center in the same
city. I also affiliate myself with Balay Paglaum Center, a rehabilitation
center located in Bayabas, Cagayan de Oro City which caters the needs
of teenagers with drug addiction.
Q.2: Do you personally know the defendant in this case, Pedro D. dela
Cruz?
A: Yes, I know him personally.

Q.3: How do you him?

A: He is one of my patients at Balay Paglaum Center. He was admitted in
the center last year due to psychosis as a result of severe long-term
drug use.

Q.4: How long was his admission in the center? What was his treatments
in the center?
A: He stayed for six months in the center. His treatments were comprised
of taking prescribed medications as well as therapies.

Q.5: How did Pedro cope during his rehabilitation at the center?
A: He did well. He responded to the medications and his therapies better
than I expected, that was why I permitted his release six months after
his admission.

Q.6: What happened after his release from the center?

A: I instructed him and his mother, Petra, to see me once a month after
his release, that is every first Thursday of the month, in the center for
his monthly check-up with me and also to get his monthly maintenance
of medications.

Q.7: Did Pedro and his mother followed your instructions?

A: Yes, they did for about four months after Pedro's release.

Q.8: What happened after that?

A: They did not come back to me after that.

Q.9: What did you then?

A: I made contact with Pedro's mother. She said that they could no
longer come to our monthly check-up because of financial constraints.

Q.10: By any chance, have you heard from Pedro or his mother after your
last monthly check-up?
A: Yes, two days ago, that is August 13, 2013. Pedro's mother sought me
out to request for a certification from me stating details about Pedro's
admission in the center as his treatment and rehabilitation.

Q.11: Did you ask for the purpose of the request?

A: Yes, I did. Petra said that her son was arrested last August 9, 2013
and that she needed the certification as evidence for the case against
his son.
 Q.12: Did you agree to the request?
A: Yes, I did.

Q.13: Did anyone coach you or made any suggestions to you in making
answers to these questions?
A: No, all my answers are based on what I personally know.

Q.14: Will you swear under oath that all your answers herein are based on
your own personal knowledge and belief and will you sign this affidavit
to attest to the truthfulness of all your answers here?
A: Yes, I do.

1. I was the one who conducted the examination of witness DR. CHESTER
A. COSIN at my aforementioned office in the same abovementioned
address;

2. I have faithfully recorded or caused to be recorded the questions asked

and the corresponding answer that the witness gave; and

3. I nor any other person then present or assisting him coached the
witness regarding his answers.
