ROME STATUTE

Article 1
The Court
(4) CPJC
An International Criminal Court (“the Court”) is hereby
established. It shall be a permanent institution and shall have the
power to exercise its jurisdiction over persons for the most
serious crimes of international concern, as referred to in this
Statute, and shall be complementary to national criminal
jurisdictions. The jurisdiction and functioning of the Court shall
be governed by the provisions of this Statute.

Article 5
Crimes within the jurisdiction of the Court
(5) LGHWA
The jurisdiction of the Court shall be limited to the most serious
crimes of concern to the international community as a whole. The
Court has jurisdiction in accordance with this Statute with
respect to the following crimes:
(a) The crime of genocide;
(b) Crimes against humanity;
(c) War crimes;
(d) The crime of aggression.

Article 6
Genocide

For the purpose of this Statute, "genocide" means any of the
following acts committed with intent to destroy, in whole or in
part, a national, ethnical, racial or religious group, as such:
(a) Killing members of the group;
(b) Causing serious bodily or mental harm to members of the
group;
(c) Deliberately inflicting on the group conditions of life
calculated to bring about its physical destruction in whole or in
part;
(d) Imposing measures intended to prevent births within the
group;
(e) Forcibly transferring children of the group to another group.

Article 7 (introductory paragraph only)


Crimes against humanity

For the purpose of this Statute, "crime against humanity" means
any of the following acts when committed as part of a
widespread or systematic attack directed against any civilian
population, with knowledge of the attack:

War crimes

The Court shall have jurisdiction in respect of war crimes in


particular when committed as part of a plan or policy or as part
of a large-scale commission of such crimes.

2. For the purpose of this Statute, "war crimes" means:

(a) Grave breaches of the Geneva Conventions of 12 August


1949, namely, any of the following acts against persons or
property protected under the provisions of the relevant Geneva
Convention: (3G^2P)

(b) Other serious violations of the laws and customs applicable in


international armed conflict, within the established framework of
international law, namely, any of the following acts: (3VAI)

(c) In the case of an armed conflict not of an international


character, serious violations of article 3 common to the four
Geneva Conventions of 12 August 1949, namely, any of the
following acts committed against persons taking no active part in
the hostilities, including members of armed forces who have laid
down their arms and those placed hors de combat by sickness,
wounds, detention or any other cause:

(d) Paragraph 2 (c) applies to armed conflicts not of an


international character and thus does not apply to situations of
internal disturbances and tensions, such as riots, isolated and
sporadic acts of violence or other acts of a similar nature.

(e) Other serious violations of the laws and customs applicable in


armed conflicts not of an international character, within the
established framework of international law, namely, any of the
following acts: (4)VAI^2

(f) Paragraph 2 (e) applies to armed conflicts not of an


international character and thus does not apply to situations of
internal disturbances and tensions, such as riots, isolated and
sporadic acts of violence or other acts of a similar nature. It
applies to armed conflicts that take place in the territory of a
State when there is protracted armed conflict between
governmental authorities and organized armed groups or

Article 11 (first paragraph only)


Jurisdiction ratione temporis

1. The Court has jurisdiction only with respect to crimes


committed after the entry into force of this Statute.

Article 12
Preconditions to the exercise of jurisdiction

1. A State which becomes a Party to this Statute thereby accepts


the jurisdiction of the Court with respect to the crimes referred
to in article 5.
2. In the case of article 13, paragraph (a) or (c), the Court may
exercise its jurisdiction if one or more of the following States are
Parties to this Statute or have accepted the jurisdiction of the
Court in accordance with paragraph 3:
(a) The State on the territory of which the conduct in question
occurred or, if the crime was committed on board a vessel or
aircraft, the State of registration of that vessel or aircraft;
(b) The State of which the person accused of the crime is a
national.
3. If the acceptance of a State which is not a Party to this Statute
is required under paragraph 2, that State may, by declaration
lodged with the Registrar, accept the exercise of jurisdiction by
the Court with respect to the crime in question. The accepting
State shall cooperate with the Court without any delay or
exception in accordance with Part 9.

UNCLOS

Article 3
Breadth of the territorial sea

Every State has the right to establish the breadth of its territorial
sea up to a limit not exceeding 12 nautical miles, measured from
baselines determined in accordance with this Convention.

Article 8
Internal waters

1. Except as provided in Part IV, waters on the landward side of


the baseline of the territorial sea form part of the internal waters
of the State.
2. Where the establishment of a straight baseline in accordance
with the method set forth in article 7 has the effect of enclosing
as internal waters areas which had not previously been
considered as such, a right of innocent passage as provided in
this Convention shall exist in those waters.
Article 17
Right of innocent passage

Subject to this Convention, ships of all States, whether coastal or


land-locked, enjoy the right of innocent passage through the
territorial sea.

Article 33
Contiguous zone

1. In a zone contiguous to its territorial sea, described as the


contiguous zone, the coastal State may exercise the control
necessary to:
(a) prevent infringement of its customs, fiscal, immigration or
sanitary laws and regulations within its territory or territorial
sea;
(b) punish infringement of the above laws and regulations
committed within its territory or territorial sea.
2. The contiguous zone may not extend beyond 24 nautical miles
from the baselines from which the breadth of the territorial sea
is measured.

Article 57
Breadth of the exclusive economic zone

The exclusive economic zone shall not extend beyond 200


nautical miles from the baselines from which the breadth of the
territorial sea is measured.

Article 46 (paragraph b only)


Use of terms

(b) "archipelago" means a group of islands, including parts of


islands, interconnecting waters and other natural features which
are so closely interrelated that such islands, waters and other
natural features form an intrinsic geographical, economic and
political
entity, or which historically have been regarded as such.

Right of archipelagic sea lanes passage

3. Archipelagic sea lanes passage means the exercise in


accordance with this Convention of the rights of navigation and
overflight in the normal mode solely for the purpose of
continuous, expeditious and unobstructed transit between one
part of the high seas or an exclusive economic zone and another
part of the high seas or an exclusive economic zone.

Article 22 (paragraph 1 only)


Nullum crimen sine lege

1. A person shall not be criminally responsible under this Statute


unless the conduct in question constitutes, at the time it takes
place, a crime within the jurisdiction of the Court

Article 23
Nulla poena sine lege

A person convicted by the Court may be punished only in


accordance with this Statute.

Article 26

A person convicted by the Court may be punished only in


accordance with this Statute.

Article 27
Irrelevance of official capacity

1. This Statute shall apply equally to all persons without any


distinction based on of cial capacity. In particular, of cial capacity
as a Head of State or Government, a member of a Government or
parliament, an elected representative or a government of cial
shall in no case exempt a person from criminal responsibility
under this Statute, nor shall it, in and of itself, constitute a
ground for reduction of sentence.
2. Immunities or special procedural rules which may attach to
the of cial capacity of a person, whether under national or
international law, shall not bar the Court from exercising its
jurisdiction over such a person.

Article 28
Responsibility of commanders and other superiors

In addition to other grounds of criminal responsibility under this


Statute for crimes within the jurisdiction of the Court:
(a) A military commander or person effectively acting as a
military commander shall be criminally responsible for crimes
within the jurisdiction of the Court committed by forces under
his or her effective command and control, or effective authority
and control as the case may be, as a result of his or her failure to
exercise control properly over such forces, where:
(b) With respect to superior and subordinate relationships not
described in paragraph (a), a superior shall be criminally
responsible for crimes within the jurisdiction of the Court
committed by subordinates under his or her effective authority
and control, as a result of his or her failure to exercise control
properly over such subordinates, where:
(i) The superior either knew, or consciously disregarded
information which clearly indicated, that the subordinates were
committing or about to commit such crimes;
(ii) The crimes concerned activities that were within the effective
responsibility and control of the superior; and
(iii) The superior failed to take all necessary and reasonable
measures within his or her power to prevent or repress their
commission or to submit the matter to the competent authorities
for investigation and prosecution.

Article 29
The crimes within the jurisdiction of the Court shall not be
subject to any statute of limitations.

Section 9.

Irrelevance of Official Capacity. - This Act shall apply equally to


all persons without any distinction based on official capacity. In
particular, official capacity as a head of state or government, a
member of a government or parliament, an elected
representative or a government official shall in no case exempt a
person from criminal responsibility under this Act, nor shall it, in
and of itself, constitute a ground for reduction of sentence.
However:

(a) Immunities or special procedural rules that may be attached


to the official capacity of a person under Philippine law other
than the established constitutional immunity from suit of the
Philippine President during his/her tenure, shall not bar the
court from exercising jurisdiction over such a person; and

(b) Immunities that may be attached to the official capacity of a


person under international law may limit the application of this
Act, nut only within the bounds established under international
law.

Article I
Establishment of the Organization

The World Trade Organization (hereinafter referred to as “the


WTO”) is hereby established.
