Your Affant has been a police officer for 14 years with 7 years in investigations, § of those years investigating Homicides. As @ patrol officer and as a criminal investigator your afiant has conducted hundreds of investigations and participated in the prosecution of criminal acts within the jurisdiction of Allegheny County and the District of Columbia, Allof the information contained inthis affidavit was leamed directly bythe affiant, or was communicated to him by other law ‘enforcement officers, victims, witnesses, or medical clinicians and technicians. (On June 19, 2018, the North Braddock Police Department requested the investigative assistance of the Allegheny County Police Homicide Unitin reference to a shooting, Detectives Dolf and Foley along witn Scientists Jason Clark and Bil Best responded to the scene for processing. Detective Gril responded to AHN Forbes Hospital to speak withthe victim, ‘The inital investigation revealed that, at approximately 8:28PM, the North Braddock Police Department received 911 calls for service for a shooting at Jones Avenue and Baldridge Avenue. Officers arrived on scene and located the victim, who was identified ‘as Thomas Cole, Jr. He suffered a gunshot wound to the abdomen. Cole was transported to AHN Forbes Hospital for treatment and was released following treatment. Upon arrival, North Braddock Police officers were receiving reports of a tan- or gold-colored Chevy Cruze that was involved inthe shooting made right turn from Jones Avenue onto North Avenue, An alert was broadcast for officers to be on the lookout for this vehicle, During the scene processing, Detectives recovered nine spent .40 caliber casings, four spent .45 caliber casings, and 7 projectile agents During the course ofthe investigation, itwas learned that surveillance cameras are located on the building atthe comer of Baldridge Avenue and Jones Avenue, Review of footage from those cameras revealed that, at approximately 8:27PM, a light-colored Chevy Cruze, was traveling east on Baldridge Avenue. As the vehicle approached the intersection of Baldridge Avenue ‘and Jones Avenue, the rear passenger-side window goes down and a gun comes cut the window. Several gunshots were fired from the rear passanger side of the vehicle. The vehicle then makes a left onto Jones Avenue and a right onto North Avenue. As the vehicle is making the two tums, the surveillance camera captures the victim and a black male wearing a red shit onthe opposite side of Jones Avenue, The black male withthe red shir is then seen producing a handgun and returning fire atthe Chevy Cruze. The victim and the black male withthe red shir then leave view of the camera, During the course ofthe investigation, a witness referred to herein as Witness #1 provided information. The witness's identity has been specifcally ascertained by officers. Your affiant has verified the witness's identity through positive proof of identification. ‘To provide for the safely ofthe witness and to preserve the integrty ofthe investigation, the witness’ identity is being withheld for the purpose ofthis affidavit On June 25, 2018, Witness #1 was interviewed at Allegheny County Police Headquarters. The interview was audio- and video-recorded. Witness #1 sald thatthe male inthe rear passenger ‘seat then fired shots at an individual standing on the street. Witness #1 said that anther individual on the street returned fre at hisiher car as they fled the area, Witness #1 stated he/she never saw either of the passengers possess a gun, however, stated the shots defintely came from the rear passenger seat of his her vehicle During the course of the investigation Zaliuan Hester was developed as a suspect inthis incident. Your affiant created a photo array containing Zaijuan Hester and seven similar images. During the interview of Witness #1, the witness was shown the photo array. In particular, Witness #1 was read AGP Form L3 (Photo Collection Instructions) which helshe understood and signed. Witness +#1 was provided 10 folders containing 8 single images and two blank pages. Witness #1 viewed all ofthe folders individually. Witness #1 identified the individual in folder number 4 2s one of the individuals he/she picked up in Hawkins Village. Further, |Witness #1 confirmed the indivicual in folder #4 was the person in the rear passenger seat of histher vehicle. Blank 10. Blank During the course ofthe investigation, a 2014 Chevy Cruze bearing PA Resistration KLM6817 was processed. Witness #1 Confirmed that ths isthe vehicle that had been used during the drive-by shooting in North Braddock. During processing, 8 Glock 22 40 caliber pistol, serial number AKNSBOUS, was collected from the rear passenger compartment ofthe vehicle. A check through NCIC revealed thatthe firearm was reported stolon from Lower Burrell, PA on August 5, 2016, by the registered owner, Jon Little twas reported by Lit that he last saw his frearm in his truck on August 3, 2016 and that he discovered the theft on ‘August 4, 2016, when he arrived back at his residence from work. Along withthe gun, Lita report four magazines missing, two of ‘which were fully loaded.
