CITY RESOLUTION NO. 2015-050

A RESOLUTION INTERPOSING NO OBJECTION TO THE
APPLICATION OF MR. PETRONILO G. PAJARON TO EXTRACT
COMMERCIAL SAND AND GRAVEL LOCATED AT CABADBARAN
RIVER, BARANGAY MABINI, THIS CITY

WHEREAS, presented for consideration was the letter of Mr. Petronilo G. Pajaron
requesting interposing no objection for the Proposed Commercial Sand and Gravel
Project located at Cabadbaran River, Barangay Mabini, this City;

WHEREAS, the same was referred to the Committee on Environment and Natural
Resources for evaluation, comments and recommendations;

WHEREAS, the Committee conducted a Committee Hearing and Site/Area

Ocular inspection conducted by the Office of City Environment and Natural Resources
and the City Planning and Development Coordinator/Zoning Administrator;

WHEREAS, it was found out that the proposed site has a total of 7,728 square
meter situated within the bed of Cabadbaran River and shows an abundant source of
marketable aggregates of sand and gravel for infrastructure and construction material.

WHEREAS, the applied area is an Agricultural Zone, and favorable for

extraction;

WHEREAS, the Barangay Council issued Barangay Resolution No. 03-2015

that interposes no objection of the applied extraction project;

WHEREAS, the Committee on its report recommends for the approval of the
application of Mr. Petronilo G. Pajaron to extract commercial sand and gravel at
Barangay Mabini provided that the proponent must comply with the provisions of City
Ordinance No. 2008-35 and all other related laws.

NOW THEREFORE

BE IT RESOLVED, by the 3rd Sangguniang Panlungsod, in its 109 th Regular

Session assembled, to interpose no objection to the application of
Mr. Petronilo G. Pajaron to extract Commercial Sand and Gravel at Barangay Puting
Bato, City of Cabadbaran, Agusan del Norte.

RESOLVED FURTHER, to give copies of this Resolution to

Mr. Petronilo G. Pajaron and the Barangay Council of Barangay Mabini thru Punong
Barangay Hon. Florencia S. Dy, both of this City for information and guidance.

RESOLVED FURTHERMORE, to provide copies of this Resolution to

Ms. Adela G. Antega, OIC PENRO - Designate, Capitol, Butuan City and to
Ms. Eva M. Milan, City Environment and Natural Resources Officer, this City for
their information and guidance.
