DECLARATIO0N OF HEIRSHIP AND CONFIRMATION SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by, the heirs of AURORA D. RODRIGUEZ ,
namely: WAVEN VILLARETE, husband and ANGELO R. VILLARETE, both of legal age,
Filipinos, and a resident of barangay Ajong, Sibulan, Negros Oriental, hereinafter called the
FIRST PARTY, in favor of,

HECTOR Q. ABOL and ARACELI O. ABOL, also of legal ages, Filipinos, and residence
and postal address at barangay Agan-an, Sibulan, Negros Oriental, hereinafter referred to as the
VENDEE;

WITNESSETH:

That AURORA D. RODRIGUEZ acquired and one of the Absolute co-owners of a


parcel of land, being the portion of Lot No. 3725 of the Cadastral Survey of Sibulan, Province
of Negros Oriental, situated in barangay Ajong, Sibulan, Negros Oriental, consisting of Three
Hundred Two (302) Square Meters, more or less; by virtue of a Deed of Absolute Sale known as
Doc. No. 299-A; Page 61; Book XIV; Series of 1997; notarized by ATTY LEO B. DIOCOS,
Notary Public;

That AURORA RODRIGUEZ had sold FIFTY (50) square meters over the said Three
Hundred Two (302) Square meters to HECTOR Q. ABOL and ARACELI O. ABOL, in a Deed
of Absolute Sale known as Doc. No. 506; Page 103; Book No. 31; Series of 2012; notarized by
Atty. Dino Tanoy, Notary Public;

That when an actual survey was made on the land sold by Aurora Rodriguez, the total
area of the land became FIFTY FIVE (55) square meters but the said whole area was already
sold by vendor Aurora Rodriguez as shown in the aforementioned Deed of Sale;

That AURORA RODRIGUEZ died intestate last 2014, leaving without any testamentary
will nor debt not settled until the present time and upon her death she was survived by her
husband Waven Villarete and son Angelo R. Villarete and invoking the provisions of Section 1 of
Rule 74 of the Rules of Court of the Philippines, the herein vendors have settled and adjudicated
unto themselves the Five (5) square meters;

That for and in consideration of the sum of THREE THOUSAND PESOS (Php3,000),
Philippine Currency, in hand paid by the herein Vendees, and receipt in full is hereby
acknowledged by the Vendor herein to her entire satisfactions and that by virtue of these
presents, the Vendors do hereby SELL, TRANSFER, and CONVEY unto the vendees, his heirs
and assigns, all the vendor’s rights, interests and participations over that portions of Lot
No.3725, consisting of FIVE METERS (5) Square Meters, more or less, including all the
improvements found therein, and free from all liens and encumbrances;

That the vendor herein declares that due notice has been given to all persons affected by
this transaction in compliance with the provisions of the New Civil Code of the Philippines,
pertaining to the rights of the redemptioner and preemptioner, but nobody opted to exercise the
said rights; further the vendor declares that the said parcel of land is not covered by the
Comprehensive Agrarian Reform Law because the same is a residential land and within the
retention limits of the vendor; and that the vendor warrants her title and ownership over the said
portions of land and will defend the rights of the vendee against any adverse claim whatsoever.

Poblacion, Sibulan, Negros Oriental, being of sound and disposing mind and memory, not acting
under undue influence, violence, fraud, or intimidation of whatever nature, DO BY THESE
PRESENTS, declare this document to be my LAST WILL AND TESTAMENT which I have
caused to be written in English, the language which is known to me. And I hereby declare:

I. That I give and bequeath unto my niece FATIMA ARANAS and FRETZIE
ARANAS, all my rights and interests over that portion of land known as Lot No.
502 and the house built therein, located at Campaclan, Poblacion, Sibulan, Negros
Oriental;

II. That I acquired this portion of Lot No. 502, consisting of One Hundred Twelve
(112) square meters, more or less, and house, thru a Deed of Sale known as Doc.
No. 172; Page 36; Book No 39; Series of 2009, notarized by Atty. Santiago
Sameon V, Notary Public;

III. That I designate ATTY. TIRSO F. BANQUERIGO, the sole executor of this Last
Will and Testament and I direct that the executor named herein or his lawful
substitute should serve without bond.

CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This DEED is entered into and executed by ADELAIDA O. GREGANA, of legal age,
Filipino, widow, and a resident of barangay Magatas, Sibulan, Negros Oriental, hereinafter called
the LESSOR and PAUL STEWART RHODES, likewise of legal age, British, and temporarily
residing at The GENSAN RESTHAUS, Sitio Aparador, barangay San Antonio, Sibulan, Negros
Oriental, hereinafter referred to as the LESSEE,

W I T N E S S E T H:

That the LESSOR, by these presents, DOES HEREBY let and lease unto the LESSEE the
Rest House, situated in Sitio Aparador, barangay San Antonio, Sibulan, Negros Oriental subject
and AGREE the following terms and conditions:

I. That the term of this Contract of Lease shall be for a period of one year from
_______________, 2009 to expire on ______________2010; however, may be
renewed for another year at the option of the LESSOR;

II. That the LESSEE agrees to pay the lessor a monthly rental of Php 5,000.00,
Philippine Currency, payable within the first seven days of the month without the
necessity of a demand from the Lessor ;

III. That the lessee may introduce permanent improvement on the property of the lessor
upon written notice to the lessor whose approval shall be implied if no written
objection is interposed within seven (7) days after the receipt of the notice, provided
however, that all improvements so introduced shall automatically become the
property of the lessor upon the termination of the contract of lease without need of
reimbursement for the expense incurred thereof nor any legal formality in regard
thereto;

IV. That the charges of water and electricity shall be for the sole account of the lessee;

V. That the lessee shall not sublease the premises in whole or in part to anybody without
the prior permission and approval of the lessor;
VI. That the lessor or her duly authorized representative should be allowed by the lessee
free access to the said premises or any part thereof, for inspection purposes during
reasonable hours of the day;

VII. That during the year and upon a Thirty (30) day notice, the lessor is allowed to use
the Rest House for a period of ten (10) days subject to the rental adjustment,
preferably during summer vacation;

VIII. That the lessee hereby binds herself/himself and agrees that in the event that any of
the conditions herein set forth is violated knowingly or unknowingly, the LESSOR
may unilaterally terminate this contract and can require the lessee to vacate the
premises. Should the lessor be compelled to file any action in court litigation against
the lessee in order to protect or enforce her rights under the contract of lease, the
former agrees to pay the latter the sum of Php10,000, Philippine currency as damages,
exclusive of Attorney fees and expense of the litigation;

That the parties herein have executed this contract freely and voluntarily and has fully
understood the contents herein and any violation of the condition is a ground for the
revocation and termination of this contract and the lessor has the right to demand from the
lessee to vacate the leased premises.
