HOW TO APPLY FOR A MARRIAGE LICENSE

IN THE MUNICIPALITY OF SANTA, ILOCOS SUR

 Before saying “I do” with their special someone, there are important things engaged couples need to
do to keep them busy. And wedding day is not all that beers, food, etc. They also need the legal
documents to complete prior to their most awaited day. And one of the most important is the
Marriage License.

 A marriage license is required of couples (male and female, 18 years old and above) who intend to
get married in a church or through civil rites in the Philippines. Whether a marrying party is tying the
knot with a Filipino, or a foreign national, he/she still need to secure a marriage license. It can be
secured at the city or municipal hall where the marrying parties reside.

 Here are the list of requirements and steps to follow when applying for a marriage license at the
SANTA MUNICIPAL HALL.

To get a marriage license you need the following:

1. Certified true copy of Birth certificate of both applicants from the Philippine Statistics Office (PSA) (1
original and 2 photocopies)

2. Latest Certificate of No Record of Marriage (CENOMAR) of both applicants from the Philippine Statistics
Office (PSA) (1 original and 1 photocopy).

 This document will prove that the contracting party haven’t been married before.

3. Community tax certificate(CEDULA) of both applicants (1 original and 2 photocopies)

4. At least one GOVERNMENT ISSUED ID & the PHILHEALTH ID/MDR of both applicants (1 original and 1
photocopy)

 One of the applicant should bring an ID which indicates his/her address in Santa – bring the original
copy and one photocopy

5. Two (2) 2x2 Picture (colored or black and white) of each applicant

ADDITIONAL REQUIREMENTS

1. PARENTAL CONSENT For applicants between 18 to 21 years old


a. Both Parents to personally appear at the Santa Municipal Hall; bring a valid ID (original and
photocopy)
b. Both Parents to fill up Parental Consent form (provided for under Article 14 of the Family Code of
the Philippines) duly verified and taken oath to in front of the Civil Registrar (5-20 minutes) which
must be signed if identity is affirmed.
c. Father, Mother, surviving parent or Guardian – follow this order when one of the parents is not able
to personally appear at the municipal hall
2. PARENTAL ADVICE For applicants between 21 to 25 years old
a. Both Parents to personally appear at the Santa Municipal Hall; bring a valid ID (original and
photocopy)
b. Both Parents to fill up Parental Advice form (provided for under Article 14 of the Family Code of the
Philippines) duly verified and taken oath to in front of the Civil Registrar (5-20 minutes) which must
be signed if identity is affirmed.
c. Marriage license shall not be issued until after three months if parental advice is not obtained or if
parents are not in favor of the marriage. During the 3-month waiting period, the publication of the
application shall be completed. A sworn statement of the contracting parties must likewise be
submitted indicating therein that the parents refuse to give advice.

2. DEATH CERTIFICATE OF DECEASED SPOUSE (IF WIDOWED)

 If widowed, present a certified true copy of the death certificate of deceased spouse, issued by the
Local Civil Registrar or National Statistics Office – 1 original and 2 photocopies

3. ANNULMENT PAPERS (IF ANNULED)

 If previous marriage was annulled, present a copy of the Court Decision with the Absolute Decree of
Finality (1 original and 2 photocopies)

4. PHOTOCOPY OF APPLICANT’S VALID PASSPORT (IF FROM ABROAD) showing data and date of arrival

5. PASSPORT AND CERTIFICATE OF LEGAL CAPACITY TO MARRY (IF FOREIGNER)


 When either or both of the contracting parties are citizens of a foreign country, or former Filipino
citizens but now naturalized citizens of another country it shall be necessary for them before a marriage
license could be obtained, to submit,
A. Photocopy of Applicant’s valid passport (showing date of arrival)
B. Certificate of Legal Capacity to Marry to be issued by their respective diplomatic or consular
officials. This document, issued by the consular office/embassy of the foreigner’s country, serves
as a proof of his/her civil status and eligibility for marriage in the Philippines.

5. PASSPORT, CERTIFICATE OF LEGAL CAPACITY TO MARRY AND COPY OF THE FINAL DECREE OF
ABSOLUTE DIVORCE OR THE JUDICIAL RECOGNITION OF THE ABSOLUTE DECREE OF DIVORCE
obtained abroad of his/her previous marriage (If one of the applicants is a Flipino citizen and a divorcee or
foreign national formerly married to a Filipino)

AFTER COMPLETING ALL THE REQUIREMENTS

To apply for the marriage license in the Philippines, both parties must go personally to the local civil registrar of
the city, town or municipality where either the groom or the bride habitually resides.

Note:
• Either one of the applicant must be a resident of the municipality of Santa, Ilocos Sur.

1ST STEP
Proceed to the office of the Local Civil Registrar

2nd STEP
 Submit requirements and Fill-up application Form which shall specify the following:
a. Full name of the contracting party;
b. Date of birth and age;
c. Place of birth;
d. Sex (Male or Female)
e. Citizenship
f. Residence
g. Religion
h. Civil Status
i. If previously married, how, when and where the previous marriage was dissolved or annulled;
j. Degree of relationship of the contracting parties;
k. Full name, residence and citizenship of the father;
l. Full name, residence and citizenship of the mother; and
m. Full name, residence and citizenship of the guardian or person having charge, in case the
contracting party has neither father nor mother and is under the age of twenty-one years.

3rd STEP
Pay the necessary fees of P500.00 at the Office of the Municipal Treasurer

4th STEP
Proceed to the Municipal Health Center to get schedule for pre-marriage seminar. The person in charge
will inform the client of the schedule of the pre-marriage seminar. (3 minutes)

5th STEP

Attend the Family Planning, Marriage Counselling and Responsible Parenthood seminar on scheduled date
at the Balay Taripato, Santa, Ilocos Sur. Bring O.R. (Please see Orientation –Marriage counselling
service)

 These sessions are scheduled for one half day, every Tuesday only from 1:00-5:00 noon within the
premises of the SANTA MUNICIPAL HALL.

6th STEP
Get Certificate of Attendance after seminar

7th STEP
Get claim slip with schedule for return

8th STEP
Pre Marriage Counselling (PMC) certificates will be forwarded to the Local Civil Registrar (LCR) Office.

9th STEP
After evaluation of the completeness of the requirements, the MCR approve/subscribe the application and
a notice will be posted at the bulletin board for ten days. A copy of which will be sent to the
Municipality/City where either the applicant resides.

10th STEP
Wait for posting period to transpire (10 days)

11th STEP
Get Marriage License and copies of application from Marriage section
 The marriage license will be released on the 11th day after the 10 day posting period after the
application for marriage license was filed
 Marriage licenses are released by the Santa Municipal Hall Monday to Friday from 8:00 in the
morning until 5:00 in the afternoon.

AND THERE YOU HAVE IT THEIR MARRIAGE LICENSE.


 Once marriage license is issued, it can be used wherever the couple wants to get married in the
Philippines.

 Just an Important Reminder:


 The marriage license is valid within 120 days from the date of issuance and according to law, “shall be
deemed automatically cancelled at the expiration of said period if the contracting parties have not
made use of it.”
 After the wedding rites and all the documents have been duly signed by the couple and their
witnesses, the certificate of marriage must also be submitted to the Local Civil Registry of the Santa
Municipal Hall to have the marriage registered.
