An Ordinance for responsible dog and cat ownership of Bislig City,


prescribing penalties for violation thereof and providing funds therefor;

RA 8485 Animal welfare act

Whereas, Republic Act 9482 or the Philippine Anti-Rabies Act of 2007 declares
the policy of the state to protect and promote the right of the people to health, through
the system of control, prevention of spread of rabies, and eventual eradication of
rabies.

Justification inclusion of cats

Whereas, it has been generally observed that the dog and cat population in the
locality is rapidly increasing and our locality which is one of the main contributor in the
proliferation of rabies incidence in our locality and road accidents due to stray animals.

Whereas, presently, the City lacks the necessary tool and mechanism, personnel
complement and required office and equipment to monitor and control such problem.

Whereas, aside from the great concern for the constituents, the City of Bislig is
also now considered as one of the tourist destinations in our country and as such there
is a pronounced need to maintain health, sanitation and public safety.

Be it ordained by the Sangguniang Panlungsod of the City of Bislig; in session


duly assembled. (c/o Atty. Carmelo)

Section 1. Title – this ordinance shall be known as “Responsible DOGS AND


CATS ORDINANCE of Bislig City”.

Section 2. Declaration of Policy – it is a declared policy of the City of Bislig to


protect and promote the right to health of the people. Towards this end, a system to
regulate dogs and cats ownership for prevention and eventual eradication of human
and animal rabies shall be provided and the need for responsible pet ownership
established.

Section 3. Definition of terms – for the purpose of this ordinance the following
terms or words used herein shall mean as follows: (*alphabetize, review all definitions)

a) Dog – shall apply to all animals belonging to canine family (canis famillares)
b) Rabies vaccination – means the inoculation of dogs with a rabies vaccine for the
species licensed by the Bureau of Animal Industry.
c) Owner – shall mean any person keeping, harboring or having custody or control
of, or permitting any dog o habitually remain in, or be lodge or fed within such
person’s house, yard or premises.
d) Pound – shall apply to the designated keeping area or establishment with which
all astray dogs/cats & other animals are kept prior to disposal.
e) Animal welfare – refers to the total well-being of all animals domesticated or wild
in terms of its habitats, treatment and general health conditions acceptance in
general.
f) Animal Control and Welfare Officer – duly authorized persons responsible for
enforcement of this ordinance and management of RA 8485 and RA 9482 or the
Phil. Anti-rabies act.
g) Dog bite – any part of the body of a person which has been incised the teeth of
a dog so that the skin of the person has been wounded, pierced or scratched.
h) Enclosed premises – means the owner’s house, or fenced yards where the other
people have no reason to enter except to conduct business or visit the member
of the household.
i) Restraining – refers to the control of the movement of the animal.
j) Stray animal – refers to all animals that are roaming around public places, let
loose or not under complete control of its owner, unlettered or unleashed.
k) Color Coded Collar – refers to the design choker attached or hooked on the neck
of the dog or cat for the entire life of the animal.
l) Dog and Cat Tag - refers to the Tag Identification attached to the collar which
contains permanent registration number.
m) Public place - includes national, provincial, city, municipal, barangay places,
parks streets and other places open to the public.
n) Euthanasia
o) Zoonotic disease

Section 4. Creation of City Anti-Rabies and Animal Control Committee


- The composition of which is the same as that of cities rabies control
committee as its function are complimentary in nature. (*insert ordinance no.
2005-02)

Section 5. Duties and functions of Animal Control Officer/ Animal Welfare Officer
(c/o Atty. Carmelo)
The City Veterinarian shall function as Animal Control Officer/ Animal Welfare
Officer and shall have the following functions:

a) Conducts proper interview to all applicants for dog and/or cat ownership
for qualification.

b) Explains and orients to qualified owners pertinent national law’s and local
ordinances that covers his scope of responsibilities and liabilities in case of
damages and violation incurred towards the general public during the
duration of his custody of the pet which was identified properly in the
approved permit.

c) Causes the tracking and confiscation of those dogs and cats infected with
rabies and other zoonotic disease regardless of whether they are registered
or not.

d) Receives and acts immediately on reports on every barangays regarding


unregistered, problematic, and unmanageable animals.

e) conducts information and education campaign as regards to this ordinance.


f) Performs other functions as may be designated by the chief executive as
prescribed in this ordinance.

Section 6. – Permit fee and Registration Cost for Dogs and Cats

All residents of Bislig City who wants to own a dog and/or a cat shall secure a
permit from the City Veterinary Services Office thru the animal welfare section
immediately prior to acquisition thereof.

An ownership and registration permit fee of P200.00 pesos per animal


shall be borne by the applicant/pet owner. The fee shall cover the cost of certification of
ownership, Dog and/or Cat Tag, Collar and anti-rabies vaccine.

Dog and/or Cat Tag Collar shall be permanently carried/worn by the animal.
Animal not bearing this proper tag shall be automatically confiscated by the City
Veterinary Services Office.

The approved permit/certificate shall include the following information in full


details:

a) Name of owner, address and contact number (mobile/telephone no.)


b) Description of the pet animal (pet’s name, color, sex, markings, age,
name species, breed if any)
c) Vaccination and medication or health record
d) Assigned dog and/or cat tag number and color coded collar

The pet owner shall be provided with the original copy of the approved permit.
The officer of City Veterinary thru its animal control officer shall retain a copy of the
animal record for future references and recording. A durable metal or plastic dog and/or
cat tag serially numbered will be issued together with the approval of the certificate
with corresponding dog and/or cat collar color coding per barangay’s for easy
monitoring.

All confiscated and impounded animal shall be placed in the government’s animal
pound center and after the grace period embodied in the law has expired, it shall be at
the animal control officer’s proper disposal.

Section 7. Mandatory Mounting precautionary signs

A. at the gate of “Beware of Dogs or any words that will inform the people outside that
you own Dogs” and its liabilities of the dog owner/pet owner.

B. In case of biting incident committed by registered dogs/cats within the


house, NO responsibility shall be borne by the owner but it is the responsibility of the
owner to warn the visitor especially children. But if biting happened outside the house,
full responsibility shall be borne by the owner of the animal in accordance with RA 9482
or the Phil. Anti-rabies Act of 2007 which includes medical cost plus the damages
incurred by the animal physically and psychologically towards the victims or aggrieved
party.
C. In case of biting incident and accident committed by unregistered
dogs/cats within or outside the house the full responsibility shall be borne by the
owner of the animal in accordance with RA 9482 or the Phil. Anti-rabies Act of 2007
which includes medical cost plus the damages incurred by the animal physically and
psychologically towards the victims or aggrieved party and repair of damage vehicle.

Section 8. Captured Dogs and Cats Penalties for violation of this ordinance.
Any dog owner who violates any of the provision of this ordinance shall be meted
with a penalty of:

For registered Dogs and Cats:

1st Offense -P 300.00 Demand letter with picture using Camera with GPS
will be issued within two (2) days.
2nd Offense -P 500.00 – plus 1 day community service
3rd Offense -automatically, animal will be set for adoption within 48
hours to other pet owner who can take care of the animal if not, animal will be
terminated or properly disposed. This is in support to the implementation of Animal
Welfare Act RA 8485 and RA 9482 or the Phil. Anti-rabies Act of 2007. If the pet owner
will insist to rescue or claim the pet, the owner will pay P 5,000.

For not registered Dogs and Cats:

Since, the implementation of Animal Welfare and Anti-rabies Act already lasted
for almost 20 years now and the national target to Free-Rabies Philippines by 2020, all
dogs and cats not registered and not wearing proper tag shall be automatically
confiscated by the duly constituted authority designated by the local government unit
which is under the purview of section V. And animal will be terminated within 48 hours
from the time captured and cannot be redeemed by the owner.

All confiscated and impounded animal shall be placed in the government’s animal
pound center and will be given 24 hours of grace period to claim or saved their pet with
a penalty of P5, 000.00 for not registered and P2, 000.00 for (first offense) not wearing
proper tag design by the City Veterinary Services Office or as approved by the City
government/council. Second offense of not wearing proper tag shall be automatically
terminated as embodied in the law. This is in support to the implementation of Animal
Welfare Act RA 8485 and RA 9482 or the Phil. Anti-rabies Act of 2007.

1st Offense – P 1,000.00


2nd Offense – P 2,000.00 – plus 1 day community service
3rd Offense – P 3,000.00 – plus 2 day community service

Proceeds of the penalties and registration shall be deposited to the trust fund of
the LGU in which 40% will go to City Veterinary Trust Fund and 60% to General Fund.
The 40% will be used in the maintenance of the City Animal Pound, food/feed for the
impounded animals, fuel for vehicle and other materials or paraphernalia’s needed.

Section 9. Color Coded Collar

Color Coded Collar shall be imposed carried or hooked on the neck of the dog or
cat for the entire life to easily identify the animal area of residency from where they
came from as well as to identify their pet owner name and address. Color coded collar
shall be assigned to respective barangays.

1.) RED -Bislig Poblacion, San Fernado and Kahayag.


2.) PINK -Pamaypayan, San Jose and Burboanan.
3.) WHITE -Bucto, Tumanan and Caguyao.
4.) VIOLET -San Vicente, Sta. Cruz and Sibaroy.
5.) YELLOW -Maharlika, Coleto and San Roque.
6.) ORANGE -Mone, San Isidro and Pamanlinan.
7.) LIGHT BLUE -Lawigan, Labisma and San Antonio.
8.) NEON GREEN -Mangagoy, Tabon and Cumawas.

No collar shall be removed from any animal except by the duly constituted
authority particularly the City Veterinary Services Office in case of the death of
the animal either of natural cause or sickness and other causes, the owner
should notify or inform the CVSO for proper recording and monitoring.

In case of accidental lost, damage or natural deterioration of the collar, the


owner must change the collar of the same color at his/her own expense. But if
the Tag is lost, it should be reported to the CVSO for replacement and proper
recording the same expenses should be borne by the owner.

Section 10. Adoption of Impound Animals – any person who is willing to adopt
an impounded animals (dogs/ cats) shall apply to the office of the City Veterinary for
proper briefing and interview and shall pay the corresponding penalty accruing such
animal during captivity which should not be less than Five Hundred Pesos(P500.00) and
sign pertinent documents related to adoption.

Section 11. Budgetary Requirements.

Section 12. Trust Fund – There shall be created City Veterinary trust fund.
Proceeds of the penalties and registration shall be deposited to the trust fund of the
LGU. Utilization of the said funds shall be subject to the approval of Sangguniang
Panlungsod Office.

Section 13. Repealing Clause – any existing ordinance or section thereof which is
contrary to the provision and intent of this ordinance is hereby deemed repealed or
amended upon approval of this ordinance.

Section 14. Effectivity Clause


This ordinance shall take effect upon approval
