Kyle Hill Review pane: 95/0 symopsrs: On 7-5-16 at approximately 0057 hours, the 1/0 was officer involved shoot-ng. Upon my arrival 2112 N. Foster Dr. (Triple S Food Mart), T contacted TTD aoc WEEE 256020 Patrol A Squad Supervisors), who waze both in the process of securing the scene where the events occurred. r later contacted SAZmmp given a brief synopsis of the investigation. 1 was advised by MMMM chee two uniformed officers with the Baton Rouge Police Department responded to @ disturbance at the Division) and was said business. Headquarters advised the officers that there was a black wale subject wearing a red shirt, standing in the front of the said business armed with a hand oun. ‘The complai tin this investigation stated that the subject pulled 2 gun on him and told him that he could not be in this area. The responding officers made contact with fa subject in front of the business that fit the cescription given by the complainant. Upon contact a briet struggle ensued between the subject and the officers, resulting in the suspect being tased and fatally shot. On Scene Observation: Upon my arrival, the 1/0 contacted i @iomicide Division) ané spoke with him regarding the details of ehis investigation. CNIMMENID stated that oft Blane Salanoni and Off. Howie Lake were involved in a brief struggle with the suspect (ALTON STERLING), prior to ofc. Salamoni firing several rounds from his weapon, striking STERLING. Det. Cook stated that STERLING died on scene from the gunshot wounds he sustained during his encounter with the officers. The I/O shows that this incident took place at 2112 N. Foster Dr, at the Triple S$ Food Mart (Parking Lot). ‘The 1/0 observed STERLING'S body lying on the ground near the front door ef the business. The 1/0 shows th STERLING was lying in 2 large amount of blood and it appeared as if he was bleeding heavily from his torso. The I/O shows that STERLING body vas lying in fro: of a Silver Toyota Camry (La Lict SOU 454), which was parked near the ont door of the business. The I/O also observed a folding teble near STERLING, which apparently held the music cd’s and video dvd’s, that he sold outside of the business. The I/O shows that the scene was processed by the Crime Scene Division and all videos and photos will be included with this report. Tine of Day: Nighttime (Yoon/Darknesst Weather Conditions: No Rain Temerature Approx. 80 degrees. Lighting: Artificial Lighting provided by Florescent Lights on the exterior of the business. There was also street Lights illuminating on W. Foster Dr. Weapons Inspection: 3/0 contacted both officers shat were involved in this investigation, in the back of the Mobile Crime tab Unit. ‘The 1/0 shows that both officers were instructed to renove the magazines from their weapens and clear the chanber. The 1/0 notes that the officers were carrying their departmental issued duty weapon (Glock Pistols) at the tine of this investigation. Note these acts took place in the Mobile Crime Lab Unit, vhich vas located at the 2200 block: of N. Foster Or, The following information shows each officers Post. qualifications scores, serial number to each officer's weapon and the amount of rounds in the officer's w pon at the time in which it was inspected. Bryan Taylor Internal Affairs Investigator: Cpl. Kyle Hill Summary of Off. Blane Salanoni statement: OFFICER RIGHTS FORM READ AND SIGNED BY OFFICER Off. Salanoni Interview begins at 1020 hour: the 1/0 was advised by Off. Salanoni that he was on duty fon the date of this investigation (7-5-16). off. Salamoni advised the 1/0 that on the stated date, he was wearing his Class & Department issued uniform and was operating his department issued police cruiser (#1225). Off. Salanont advised the 1/0 that on the morning of the incident, he vas Gispatched to 2112 N. Foster Or Triple S Food Mart. Off. Salanoni stated that he and Off, Lake received information from Headquarters (HO) that @ black male wearing a red shirt, was standing outside of the Triple S Food Mart, with a handgun in the pockets of his pants. Off. Salamoni fu stated that the complainant advised (HO) that the Subject was selling Cd’s outside of the store and that may assist the officers with locating him OFF. Solanoni stated that the complainant also advised that the subject pulled a gun on him and threatened his Life. Off. Sallamoni stated that he received this information via Police Radio and his department issued laptop computer. Off. Salanoni stated that he was not sure if he was the primary or assisting officer in this investigation, but he and Off, Lake were together prior to being dispatched to the said location. Off. Salamoni stated that upon his arrival to the Triple S Food Mart, his in car dash camera and body camera, were both activated. OfE. Salamoni stated that he arrived on scene a couple of seconds after Off. Howie Lake. Of, Salamoni stated that he observed Off. Lake walking towards a b/m subject wearing a red t-shirt, who appeared to be standing next to a Cd stand outside of the said business. This subject was later identified as ALTON STERLING. Off. Salanoni stated that he valked behind off, Lake and observed him make verbal contact with STERLING, advising him that we got @ complainant on him and he nesdea to put his hands on the car. Off, Salanoni stated that Off. take was trying to be nice and as calm as possible While speaking to STERLING: but STERLING becane very violent and began pulling away from the officers. off. Salanoni stated that he and OFF. Lake knew that it was @ high probability that STERLING had 2 weapon in his pants, so they were scared. OFF. Salamoni further stated that et that point, he didn't know if OFF. Lake could observe STERLING attenpting to reach for his pants, so due to his adrenaline and not, knowing if Off. take was about to get shot, he ran in as fast as he could and grabbed STERLING arm. Off. Salanoni stated that he and Off. Lake both fought with STERLING for a period of tine, while Off. Lake continued to give him oud verbal commands. Off. Salanoni further stated that STERLING was steadily reaching for his pockets prior to turning towards Off. Lake. Off. Salamoni stated that as STERLING turned towards him and Off. Lake, you could see the fear in their face. Off. Salamoni stated that at some point during the fight, STERLING continued to reach down for his pants, in which time he pulled his gun. Salamoni stated that his goal was to stop the incident, hoping that STERLING would just put his hands behind his back. off. Salanoni further stated that STERLING stood approxinately 6/5" wearing approximately 300 lbs. Off. Salamoni stated that ne is 60" 250 lbs. and STERLING almost doubled Fim in OF, Salamoni stated that he began yelling at STERLING stating “I'm going to shoot ycu in the fucking head and bitch I’m going to shoot you in the fucking head.” off. Salamoni stated that STERLING hoping he would realize that they were not playing. Off. Selamoni stated that he pointed his gun at the STERLING head and wanted him to know not to pull his gun out, because if he did he was going to loose. off. Salanoni stated that he continued to curse STERLING, in attempts to get him to comply with their commands. off Salanoni stated that none of these actions were working, so he stopped cursing. Off. Salanoni stated that Off. Lake said ovt loud, that he was going to tase STERLING. O££. Salanoni stated that Off. Lake stepped back and got in position to tase STERLING, while he held lethal cover. Off. Salamoni stated that Off, Lake tased STERLING, which caused him to drop to one knee and serean/acunt. off. Salanoni stated that he was still holding cover, just in case STERLING pulled @ gun on them. Off. Selanoni stated that after he noticed the first taser cycle was not affective, he yelled to Off, Leke to “tase him again.” Off. Salamoni stated that he watched all four probes from Off. take taser strike STERLING and he does not know why: the taser wasn’t affective. OEE. Salamoni stated that when the second probes hit STERLING, he could tell he was feeling the effects from the sacar, but he waz still moving and talking. off. Satamoni, stated at that time he knew OFF. Lake wae still armed with bis taser and knowing that 90% sure STERLING vas armed with a firearm, he thought to himself that if Off. Lake kept his. taser out, the subject was going to kill Off. Lake. off Salanoni stated that if STERLING killed Off. Lake, me and SYEKLANG would get in @ gun battle and STERLING may kill all of the civilians behind him, because it was obvious that he was not the best of shot. Off, Salamoni went on to say he holstered his weapon and attempted to tackle STERLING and take him to the ground, hoping to pin the gun underneath his stomach. off. Salamoni further stated that STERLING was so big that after he made contact with hin, they ran into a vehicle in the parking lot, as STERLING continued to fight with him, Off, Salanoni stated that after a brief struggle, he was able to take STERLING to the ground. Off, Salamoni stated that during the struggle, he and Off, Lake attempted to do everything they could, to keep STERLING from reaching into his pockets to grab the weapon. Off, Salamoni stated STERLING was so strong that he was unable to get him onto his stomach. Off. Salamoni stated that he and STERLING were belly to belly, in which time he could feel STERLING pulling his head down, OFF. Salamoni stated that while he was positioned on top of STERLING, he could feel STERLING right hand aoving Off. Salanoni stated that he believed STERLING was. attenpting to use his right hand to reach for his pocket, which he believed the gun was located. off. Salanoni stated that he was saying to himself “oh God please don’t et this guy shoot me, 1 don’t want to die’. Off. Salanoni further stated that Off. Lake grabbed STERLING's hand, which freed his head from STERLING grasp. Off, Salanoni stated that if Off, Lake did not pull STERLING’s hand, 1 think myself and Off. Lake would have been killed. Off. Salanoni stated that as soon as Off. Lake grabbed STERLING’s hand, T looked down and observed STERLING holding a silver revolver with a dark handle. off. Salamoni stated that the revolver was the majority of the way out of STERLING’s pocket. Off. Salemoni stated that STERLING had his finger and hand on the revolver. off. Salanoni further stated that the revolver looked huge. Off, Salamoni stated that he grabbed the gun, in which time he and STERLING began fighting over the weapon. off. Salanoni stated that during the struggle, both of treir hands cane up. OFF, Salamoni stated that he wos then able ko draw his weapon and control STERLING's hand at the sane time. Off, Salamoni further stated that STERLING pushed his hands away and goes under his hand going for his pocket. Off. Salamoni stated that he screamed aloud “gun, 2 ‘gun, gun. Off. Salamoni stated that he began screaming to Off. Lake that STERLING was going for the gun. Off. Solenoni stated that God was probably the only reason that STERLING did not shoot him because if he did, he would have shot him in his femoral arteries or groin and he would be dead. off Salamoni stated that if this would have happened, OFF. Lake may have attempted to render eid to him ond STERLING may have shot and killed Off. Lake. Off. Salamoni stated that he pulled his gun out and continued to scream out loud he's going for the gun. Off. Salanoni stated that Off. Lake reaches STERLING and at that time, it appeared that STERLING was able to get back to his gun, in which time he was in fear of being shot and dying. OFF. Salamoni stated that once he observed STERLING get to his weapon, he fired his weapon, Off. Salamoni stated that he initially fixed his weapon once, but then he fired two more rounds. Off, Salanoni stated that Off. Lake was attempting to help me control STERLING. Off. Salanoni stated that he knocked Off. Lake off STERLING, as he was screaming and before he fired his weapon. Off, Salanoni stated that after Off, Lake gets pushed to the side, he renenbers hitting the ground on his side and then renesbers STERLING coming up and reaching for his gun again. Off. Salamoni stated that he didn’t realize how close STERLING was to him. Off, Salanoni stated that as soon as STERLING gets the gun again I began firing. Off. Salanoni stated that he fired three shots as STERLING was attempting to pull the gun out of his pocket. Off. Salamoni stated that after firing the three shots, STERDING falls to the ground and his hands feli to the side. Off, Salamoni stated that it was at that tine that he found that STERLING was no longer a threat. off. Salanoni stated that he called Off. Lake over and told him that the gun was sticking out of STERLING front right pocket. Off. Salanoni stated that Off. take pulled the gun out of the right pocker of STERLING and secured it in his police cruiser, Off. Salanoni stated that he doesn’t really remember much, but he did curse a lot, due to an adrenaline dump and due to him not wanting to kill STERLING Off. Salamoni stated that he was so mad at STERLING for making him kill him and for him trying to kill us. off. Salanoni stated that he was talking to STERLING knowing that he wasn’t coherent, stating that you "you're a fucking idiot why did you make me do this.” Off. Salanoni stated that he remembered being so upset that he made me do that and I remember cursing. Off, Salanoni stated that ne renenbers Off. Lake calling for EMS and notifying HO that shots were fired. Off Salamoni stated that it was at that time that officers responded and they began to secure and tape off the scene. Of, Salamoni stated that he then remembers turning off his body camera and separating himself from the officers on scene Off, Salamon Interview Questions and Answers 1/0 asked Off, Salamoni upon your arrival to the scene, you stated that Off, Lake contacted the subject who vas later identified as Alton Sterling (0: peor to your arrival correct? Off, Salamoni replied, “Yes.” -1/0 asked Off, Salemoni what did you observe once you arrived on scene? Off. Salamoni replied, “Of. Lake was. attempting to contact Sterling.” JO asked Off. Salanoni did you observe Sterling reach into his pockets or make any actions as he was: attempting to reach into his pockets for a weapen? off Salanoni replied, “Yes sir due to my training and numerous, arrest T have knowledge of a person’s demeanor and his demeanor was completely on going into his pockets to grab something, Due to the complaint 4 was 100% sure it was @ weapon, At that time, T could not see it but due to his manneriss I could see he was going for @ weapon.” 1/0 asked Off. Salamoni as far as his demeanor was Sterling verbally combative or hostile, did he make any motions as if he was going towards his pockets? off. Salamoni replied, “Mr. Sterling was constantly going towards his front pocket with his hands, Every time we try ko get hie hands avay from his pocket, he would either pull them in or stretch it way out. At the beginning he was going straight for hie pockets he was punching in and out, 20 we could not control that hand.” 1/0 asked Off. Salamoni do you remenber the statements Sterling was making at che tine? Off, Salamoni replied, “He stated what did I do several times, OFF. Lake told him to put his hands on the car, in which time I became aggressive stating hey you better listen.” 1/0 asked OFF. Salamoni do you know if Off, Lake advise: tering why contact was being made with him, or did you advise Mz. Sterling your reason for making contact with him? Off. Salamoni replied, “I don’t remember Off. Lake's exact term, mt he did tell Me. Sterling wa ware called here just put your hands on the car.” 1/0 asked Off. Salamoni at what point in the investigation did you draw your duty weapon? Off. Salamoni replied, wohere were several tines I holetered and wn-holatered. 1 un-holeter my weapon at the beginning of the investigation, when he was going for his pockets, in fear that he war going to choot me and Off. Lake. I re-holetared to tackle Sterling and once I tackled him, my gun was in the holster for an extended period of time, I un-holstered my weapon again, when Sterling pulled his gun out on me. Salamoni being on the SRT your required to yualify four tines per year correct? Off. Salamoni replied, “Yes Sir.” 1/0 asked Off. Salamoni was Sterling actively resisting and if so describe his astions? O€€. Salamoni replied, “ie was elbowing and swinging, in attempts to push him off of -1/0 asked Off. Salamoni were there any intermediate weapons used pric: to lethal force? Off. Salamoni replied, “Yes Off, Lake used his department issued taser twice, which was not affective.” JO asked Off. Salamoni was the taser affective onytine against Sterling? Off. Salanoni replied, “It was effective enough to cause him to freeze up for a second. He was still standing so you could tell that he was getting the Fide of the taser because of hie mannerien, which also made us super nervous." =1/0 asked Off, Salamoni after Sterling was tased did he ever go to the ground? Off, Salamoni replied, "Yes." 1/0 asked Off. Salamoni do to your experience with tasers, would the suspect's demeanor fir the demeanor of someone who was feeling the full affects fron the taser? off. Salanoni replied, “In my opinion Sterling had at least three or four probes lodged in him. It’s nothing that led me to believe that there was something that stopped the Probes from penetrating Sterling’ s body.” 1/0 asked Off. moni at this point you've tried a hand on approach and also an intermediate weapon to gain control of Sterling correct? Off. Salanoni replied, “He had not pulled it out of his pants at that time.” 1/0 asked Off. Salamoni so at that tine you had no knowledge of Sterling having a weapon in his pocket at that time? Of€. Salamoni replied, “I wouldn't say no knowledge: we received a call that he had a weapon and due to his manneriem 1 was fairly positive he was armed.” “1/0 asked Off. Salamoni your knowledge of Sterling having a weapon was nothing certain, it was just based on the Anformation given to you by headquarters correct? O#f. Salamoni replied, "Yes sir.” 1/0 asked Off. Salanoni at any tine did you make contact with the complainant? Off. Salamoni replied, “No.” 1/0 asked Off. Salamoni when you tackled Sterling, did he Ammediately go to the ground? Off. Salamoni replied, "No not immediately after a brief struggle I was able to take him to the ground.” 1/0 asked Off. Salamoni did you go to the ground with Sterling? Off. Salamoni replied, “He was so strong when T was taking him to the ground, he pulled me to the ground with hin.” a =1/0 asked Off. Salanoni in your opinion, when you tried to Sterling or take him to the ground, did he try to pull you co the ground with him? O€f. Salamoni replied, “He was actively trying to stand up and trying to keep me from taking him to the ground.” =1/0 asked Off. Salamoni when you took Sterling to the yeound, Was he ine standing position? Off, Salament replied, “¥ 1/0 askec OF. Salameni vhat once you and Sterling were on the ground, what was your position ana what was your actions once on the ground? Off. Salamoni replied, “I was on top of Sterling belly to belly.” 1/0 asked Of€. Salamoni what was your actions and what was u's ations? OS€, Salanoni replied, “sterling put his am over my head in a choking position and I was pinned down, I could feel Sterling's right arm reaching for his Hight pocket, which I knew there was a high probability that there was a weapon in that pocket. I repeatedly said to mysel€ please God don’t let him shoot me. T was not sure if he was going to get a round off in ay side. I remember pushing up very hard, in which time my head was up and I looked down and observed Sterling with a silver revolver with a black handle, partially out of his pocket. [At that time, T reached down and grabbed the revolver with 2 both hands -1/0 ached Off. Salamoni were you still giving Starling verbal commande during this struggle? Off. Salamon replied, “At that point in time I was screaming gun, gun, 1/0 asked Of€. Salanoni was Off. Lake assisting you hile you were still struggling Jk Sterling on the ground? Off. Salanoni replied, “Yes cir he came in and got Alton Sterling's hand.” -1/0 asked Off. Salanoni did you visually observe Sterling put his hands on @ weapon that was in his pocket? off. Salamoni replied, “I vatched him pull a weapon from his pocket out.” -1/0 asked Off, Salamoni when you say pull it out what hand and what pocket? Of€. Salamoni replied, “It was his right pocket and right hand. Most of the weapon was out of his pocket, I could see it was a silver revolver with a dark handle.” =1/0 asked Off. Salamoni you observe Sterling reach into hig right pocket with his right hand and pull an object from his pocket, that you believed was a silver revolver with @ dark colored handle? O€£. Salamoni replied, “Right Z knew 1008 that it was a revolver. I have held revolvers and n revolvers I knew it was a real weapon.” =1/0 asked 0: Salamoni when you stated Sterling pulled it out of his pocket, can you describe those actions? Off. Salamon replied, “He was laying on the ground 1 could seo the butt of the weapon with the barrel still inside of his pocket. It was at that time that I stated oh no oh God I’m about to get shot, that was when I put both hands on the weapon. 1/0 asked Off, Salanoni did you put both of your hands on Alton Sterling's hand or on the revolver? Off. Salamons replied, “On his hand but I could feel the ccldness of the revalvar. T don’t know if my pinky was lying on the side, but I knew for sure what T felt was a gun.” 1/0 asked O££, Salamoni with you having your hand on his hand you briefly felt a metal object that was cold to the touch correct? Off. Salameni replied, "Correct." 1/0 asked O£f, Salamoni when Sterling was removing the object from his right pants pocket, did you ever see the barrel of the weapon? Off. Salamoni replied, “I may have but I don’t recall.” “1/0 asked Off. Salamoni could you tell me if the weapon was pointed at you at anytine? O€€. Salamoni replied, “1008 it wae pointed at me, we were laying belly to belly and the gun was pointed straight tovards by thighe and groin.” 1/0 asked Off. QM stated that the first tine he heard three shots and then he heard chree nore shots. WIHMJHB stated that the first volley of shots he was able to see, but he did not visually observe the second volley of shots, he only observed Sterling bleeding.
