THE DISTRICT ATTORNEY OF ORANGE COUNTY hereby accuses the
18 aforenamed defendant(s) of violating the law at and within the
19 County of Orange as follows:
20 COUNT 1: On or about April 04, 2017, in violation of Section 664
21 (a)-187(a) of the Penal Code (ATTEMPTED MURDER), a FELONY,
RICHARD LEE AUSTIN JR did unlawfully, and with the specific
22 intent to kill, attempt to murder L_Smovt. , a human being.

COUNT 2: On or about April 04, 2017, in violation of Section 664
24 (a)-207(a) of the Penal Code (ATTEMPT-KIDNAPPING), a FELONY,
RICHARD LEE AUSTIN JR, did unlawfully and forcibly, and by any
25
other means of instilling fear, attempt to steal, take, hold,
26 detain, and arrest Uynav in California and carry k..—Ysetisv-
into another part of Orange County.

 1 COUNT 3: On or about and between January 18, 2013 and April 13,
2017, in violation of Section 646.9(a) of the Penal Code

(STALKING), a FELONY, RICHARD LEE AUSTIN JR did willfully,
3 maliciously, repeatedly, and unlawfully follow, and did
willfully, maliciously, and unlawfully harass U‘rY1.0•/ L., and did
4 unlawfully make a credible threat with the intent to place Jane
5 Doe in reasonable fear for the safety oft:INwv L. and the safety
of 1.-/ L. immediate family.

7 COUNT 4: On or about April 04, 2017, in violation of Section 245
(a) (1) of the Penal Code (ASSAULT WITH A DEADLY WEAPON), a
8 FELONY, RICHARD LEE AUSTIN JR did willfully and unlawfully
9 commit an assault upon the person of 000eletnielP.mlth a deadly
weapon and instrument, namely a Vehicle.

11 COUNT 5: On or about April 04, 2017, in violation of Section
10852 of the Vehicle Code (UNLAWFUL TAMPERING WITH VEHICLE), a
12 MISDEMEANOR, RICHARD LEE AUSTIN JR did unlawfully injure and
13 tamper with a vehicle and the contents thereof and did break and
remove part of a vehicle without the consent of the owner.

15 ENHANCEMENT (S)

16 As to Count(s) 2, it is further alleged pursuant to Penal Code

17 section 12022(a)(1) (ARMED WITH FIREARM), that defendant
RICHARD LEE AUSTIN JR was armed with a firearm in the commission
18 and attempted commission of the above offense.

As to Count(s) 3, it is further alleged pursuant to Penal Code
20 section 12022(a)(1) (ARMED WITH FIREARM), that defendant
21 RICHARD LEE AUSTIN JR was armed with a firearm in the commission
and attempted commission of the above offense.

section 12022(a)(1) (ARMED WITH FIREARM), that defendant
24 RICHARD LEE AUSTIN JR was armed with a firearm in the commission
25 and attempted commission of the above offense.

attempted murder was committed willfully, deliberately and with

premeditation within the meaning of Penal Code Section 664(a).
