AGREEMENT DEED

(hereinafter called “First Party” which expression shall unless the contract otherwise
requires, be deemed to include his successors and assigns) of the one part and (hereinafter called
“Second Party” which expression shall unless the contract otherwise required be deemed to
include his successors and assigns) of the other part.
Whereas the First party is desirous that Second Party executes the Consultancy Services
for Works given below –

The First party has accepted the Bid of 0.75% of Estimated cost submit by Second Party for the
execution and completion of such Consultancy Services. The terms and conditions of agreement
are given below.
1. The Work shall be started and completed by the agency on or before the due date given in
contract except in the case where an extension is granted by Municipal Engineer, M
2. The Agency shall abide by all the terms and conditions mentioned in the tender form
DNIT and shall complete the work according to PWD specifications/ specifications
prescribed in estimate, to the satisfaction of Engineer-in-charge.
3. The agency will have to work as per instruction of Engineer-in-charge and rejected work
will not be paid at any cost.
4. In case of any dispute the decision of the President Municipal Committee, Indri will be
final and binding on the agency.
5. In case the agency fails to abide by any or all conditions stated above the Municipal
Committee will be at liberty to impose the penalty as per conditions mentioned in work
order.
6. The executing Agency has to do work as per Specification and Future during the
Inspection of Work/Testing at any time in future by any govt. department/Agency, if any
efficiency or fault in the Work is noticed the Agency “Personally” Will be held
responsible instead of any Municipal Official.

the under signed do hereby declare that I fulfill all qualification criteria as given
in DNIT General rules and we would forfeit the earnest money if it is
discovered at a later stage that the information given by me is wrong or false in
respect of the works.
