4. COMMENDATIONS: FIRE AND POLICE PERSONNEL THAT RESPONDED TO THE
NORTHERN CALIFORNIA FIRESTORM, THOMAS FIRE AND MONTECITO
MUDSLIDES DISASTERS — F2N18-3
‘The City Council, on behalf of the cltizens of Alhambra, wishes to recognize and
commend members of the Alhambra Fire and Police Depariments for thelr response to

22618the recent Norther California Firestorm, Thomas Fire and Montecito Mudsides. During
the Northem Califomia Firestorm, a series of 250 wilfres that bumed throughout Napa,
Lake, Sonoma, Mendocino, Butie, and Solano Counties in October 2017, Alhambra
firefighters joined fre crews from other area cities to form Strke Team 1205 Alpha
Strike Team 1205A provided structure protection, evacuated residents and fought to
‘suppress numerous fires in their vision. During the Thomas Fire, the largest forest fe
in Calforsia history, AItambra Fire Fighters again joined fire crews from other area cities
to form Strke Team 1205A and worked tirelessly for 18 days straight to save as many
threatened homes as possible, cleared brush, alerted residents to the danger and urged
them to evacuate. After the devastating mudslides in Montecito, Alhambra Firefighters
joined Regional Urban Search and Rescue (US&R) Task Force 4 and assisted local fre
‘departments and other USBR teams by searching structures and vehicles that were
impacted by the mudslides and making numerous rescues. n adalton to Alhambra Fire
Department personnel, Alhambca Police Department personnel aiso answered the call
for assistance from the Santa Barbara County Sheriffs Department during the Thomas
Fire and after the mudsides in Montecito. Alhambra Police personnel helped assist local
officers with security to prevent criminal activity such as looting and provided necessary
trafic contol in the area, The Alhambra City Council is proud of the Alhambra Fire and
Police Departments” personnel for provising aid to thei fellow Californians during a time
‘of great need, Mayor Sham wil present the commendations to AFD and APD
responders as follows:

‘The ACT bus system transports over 26,000 patrons each month, Four ofthe buses in
the flet are well over ten years old and have In excess of 150,000 miles, it would be
prudent at this time to replace two of the higher mileage buses before they begin to
‘experience mechanical failure, The bid opening date has been set for March 28, 2018,
Recommended Action: City Council authorize the circulation of a Notice Inviting
Bids for the purchase of two compressed natural gas powered passenger buses for use
in the Alhambra Community Transit (ACT) system; and, crest staf to undertake the
steps necessary to finalize Counci' action.

APPROVE MOU: MTA - NATIONAL TRANSIT DATABASE ~ F2M3-72, c2m18-9,

22618Staff requests thatthe City Council approve a Memorandum of Understanding (MOU) for
‘collecting and reporting Alhambra ridership data for the National Transit Database for
the reporting year 2075. The City of Alhambra Is required to approve the MOU between
MTA ana the City and submit an invaice tothe MTA prior to December 31, 2018 in order
to receive payment
Recommended Action: City Council approve a Memorandum of Understanding
(MOU), subject to fina! language approval by the Cty Manager and City Alforney, by and
between tho City of Alhambra and the Loe Angolee County Mtropaltan Transportation
‘Authority (MTA) for collecting and reporting data for the National Transit Database for
the Report Year 2015; direct the Director of Finance to invoice the MTA for the amount
of $142,624 once the MOU is executed; and, direct staff to undertake the steps

5, NIB: 2018 USDA SUMMER FOOD SERVICE PROGRAM - F2M6.60, N2M18-22
Staff requests that the City Council approve the City’s participation in the Summer Food
Service Program for 2018 and authorize the staff to culate a Notice Inviting Bids to
secure a vendor to provide prepared lunches and snacks for the program. Distribution of
lunches and snacks are proposed for Monday through Friday, beginning June 4 through
August 10, 2018
Recommended Action: City Council approve the City’s participation in the 2018
‘Summer Food Service Program (SFSP) and authorize staff to circulate a Notice Inviting
Bigs to secure a vendor to provide prepared lunches and snacks forthe program.
6. APPROVE AGREEMENT WITH NATIONAL FITNESS CAMPAIGN TO BUILD A
FITNESS COURT AT ALHAMBRA PARK ~ F2M18-26 C2M48-10, M2M18-20
Community Services staff applied to be one of 100 cities in the U.S. that wil build a
National Fitness Campaign Fitness Court in 2018, The National Fitness Campaign Is
‘a social enterprise paving the way for proactve heath. The NFC Fliness Court is an
‘outdoor Badyweight circuit training system built In public spaces. The equipment is for a
7 movement, 7 minute system that provides a ful-bedy workout to people of all ably
levels. This Fitness Court will come ata time in which the community recently completed
' survey of park amenities, with fitness options being the number one most requested
tlement to be installed at each park
Recommended Action: City Council take the following actions: 1) Authorize staff
to enter into an agreement, subject to final language approval by the City Manager and
City Attomay, wih the Nationel Fittess Campaign in an amount not to exceed $75,000
for the purchase of an NFC Fitness Court at Alhambra Park; waive additonal formal
bidding procedures; and authorize either the Mayor or City Manager to execute the
agreement; and, 2) Authorize staff to obtain proposals for the installation of the NFC
Fitness Court and the instalation of pour-in-place rubberized surfacing for the new
Fitness Court at Alhambra Park: and, ditect staf to undertake the steps necessary to

‘On October 23, 2017, the City Council adopted Ordinance O2M17-4722, authorizing the
City of Alhambra to enter into a joint pawers authority fo become a member of the Clean
Power Allance (CPA), formerly the Los Angeles Community Choice Energy or LACCE,
whieh is a Communty Choice Energy program for the counties of Los Angeles and
Ventura, Within the CPA structure, each member city and county has the authonty to set
the default renewable energy fir info which their ropidonte and businesses wil
‘automatically be enrolied, Each CPA member will select one of three renewable energy
tiers as the default product, Should the Cty of Alhambra set the default tothe 60 percent
renewable ter, customers would automaticaly be enrolled in the 50 percent renewable
product unless the customer Indiduall elects the 100 percent renewable product, the
536 percent renewable product or opts-out to stay with Souther California Edison
‘Selecting the 50 percent renewable plan would allow the residents and businesses
fof Alhambra to have an estmated 3 percent reduction of thelr electric bls wile reducing
heir carbon Imprint by using greener more renewable energy.

CONDITIONS. FIRE CREWS FROM ALHAMBRA, MONROVIA, ARCADIA AND MONTEREY
PARK FORMED A STRIKE TEAM CALLED 1205 ALPHA. STRIKE TEAM 1205A WAS
ASSIGNED TO PROVIDE STRUCTURE PROTECTION, EVACUATION OF RESIDENTS AND
SUPPRESSION OF NUMEROUS FIRES IN THEIR DIVISION, THE NUNS FIRE BURNED AN
ESTIMATED 52,000 ACRES. THE CITY OF ALHAMBRA IS PROUD OF THE ALHAMBRA

the City of Alhambra and the Los Angeles County Metropolitan Transportation Authority (LACMTA)
for collecting and reporting data forthe National Transit Database for the Report Year 2015, subject
to fina language approval by the City Manager and City Attomey; direct the Director of Finance to
Invoice the LACMTA forthe amount of $142,624.00 once the MOU is executed; and direct staffto

BACKGROUN
‘Annwally, the LACMTA collects data from the smaler, locally funded transit operators in LA. County
‘and submits @ Consolidated National Transit Database (NTD) report to the Federal Transit
‘Administration (FTA). Once the consolidated repotis submited, Congress and the FTA issue unit
‘values for the revenue mile and passenger mile data reported through NTO. Federal Section 5207
‘capital funds then flow to the region based upon these unit values and the data reported for the
region, LACMTA makes payment to each municipality based upon the unt values and formulas
described in Aricle 30 ofthe MOU.

‘MEMORANDUM OF UNDERSTANDING
FOR COLLECTING AND REPORTING DATA FOR THE
NATIONAL TRANSIT DATABASE
FOR REPORT YEAR 2015
‘This Memorandum of Understanding (MOU) is entered into as of july 31,2017 by and
between Las Angeles County Metropolitan Transportation Authority (LACMTA”) and the
City of Alhambra (the “City
WHEREAS, ou Noveauber 14, 1980, dhe wotei9 ofthe County of Los Angeles approved
by majority vote Proposition A, an ordinance establishing a one-half percent sales tax for public
transit purposes; and
WHEREAS, at its September 26, 2001 meeting, the LACMTA authorized payment of
Proposition A Discretionary Incentive funds to each participating agency in an amount equal
to the Federal funds generated for the region by each agency's reported data; and
WHEREAS, at its June 15, 2016 meeting, LACMTA approved the Fiscal Year FY 2016+
17 tansit fund allocations, which included finds to make payments to all cities that voluntarily
reported NID data for FY 2014-15;and
WHEREAS, the City has been a participant in LACMTA's Consolidated National
‘Transit Database (NTD) Reporters Random Sampling Program for FY 2014-15 and has
voluntarily submitted NID data tothe LACMTA for FY 2014-15 which successfully passed
independent audit without findings: and
WHEREAS, the City has requested funds under the Proposition A Discretionary
Incentive Program for collecting and reporting data forthe NTD from the FY 2014-15 Report
Year (the "Project’j-and
WHEREAS, on July 11,2017, the Federal Transit Administration (FTA) published in
the Federal Register the FY 2016-17 Apportionments, Allocations, and Program Information
including unit values for the data reported to the NTD; and
WHEREAS, the parties desire to agree on the terms and conditions for payment for
the Project.
NOW, THEREFORE, LACMTA and the City hereby agree tothe following terms and
procedroe:
ARTICLE 1, TERM
1.0 This Memorandum of Understanding (*MOU") will be in effect from July 1, 2017,

“To receive payment for the submittal ofthe FY 2014-15 NID statistics, the City
‘warrants that it
'A, Adhered to the Federal Guidelines for collecting and Reporting NTD statistics;
1B, Prepared and submitted the FY 2014-15 ANNUAL NTD REPORT of the City’s
ixed-route and/or demand response transit service tothe LACMTA on or before
September 30, 2015;
C. Allowed the LACMTA to assign an independent auditor to review the submitted
FY 2014-15 NTD statistics for conformity in all material respects with the
accounting requitements of the FTA as set forth in its applicable Uniform System
‘of Accounts.
ARTICLE 3. PAYMENT OF FUNDS TO CITY

LACMTA shall pay the City for collecting and reporting FY 2014-15 NTD statistics.
LACMTA shall pay the City for submitting the FY 2014-15 ANNUAL NTD REPORT
for the applicable transit services as follows:
MOTOR BUS SERVICE
For City's motor bus service, LACMTA shall pay an amount equal to the 166,716
revenue vehicle miles reported by the City raultiplied by the FTA unit value of |
‘54219075 per revenue vehicle mile, plus the 1,427,654 passenger miles reported by
the Gity squared, divided by the $931,972 operating cost reported by the Cty,
‘multiplied by the FTA unit value of §.0115687 less the cost of the $3,763 in audits
paid by LACMTA. See Attachment A for detail,
DIALA-RIDE SERVICE
For City’ le service, LACMTA shall pay an amount equal to the 124,913
revenue vehicle miles reported by the City multiplied by the FTA unit value of |
§.4219075 per revenue vehicle mile, plus the 106,994 passenger miles reported by
the City squared, divided by the $1,087,834 operating cost reported by the City,
snultipled by the FFA unit value of §.0115687 less the cost ofthe $2,079 in audits
paid by LACMTA. See Attachment A for detail,
‘The City shall submit one invoice to LACMTA prior to December 31, 2018, in the
amount of $142,624 in order to receive its payment described above.

ARTICLE 4. CONDITIONS
40. "The City agcces to comply with all requirements specified by the FTA guidelines for
reporting NTD statistics.
4.1 The City understands and agrees that LACMTA shall have no liability in connection
with the Citys use ofthe funds. The City shall indemnify, defend, and hold harmless
TACMTA and its officers, agents, and employees from and against any and all
liability and expenses including defense costs and logal fees and claims for damages
of any nature whatsoever, arising out of any act or omission of the City, is officers,
agents, employees, and subcontractors in performing the services under this MOU.
42. The City is nota contractor, agent or employee of LACMTA. The City shall not
represent ittelf asa contractor, agent or employee of LACMTA and shall have no
power to bind LACMTA in contract or otherwise.
43. The City agrees that expenditure of the Proposition A Discretionary Incentive funds
will be sed for projects that meet the eligibility, administrative, audit and lapsing,
‘requirements ofthe Proposition A and Proposition C Local Return guidelines most
recently adopted by the LACMTA Board.
44 These expenditures will be subject to AUDIT as part of LACMTA’s annual
Consolidated Audit.
ARTICLE 5. REMEDIES
50 LACMTA reserves the right to terminate this MOLI and withhold or reenp finds
determines thatthe City has not me the requirements specified by the FTA for
collecting and submiting NTD statistics through LACMTA.

RECOMMENDATION:
‘To request that he City Council approve the Ciy's participation in the 2018 Summer Food Service
Program (SFSP) and authorze staf to circulate a Notice Inviting Bids to secure a vendor to provide
prepared lunches and snacks fr the program.
BACKGROUND:
|. SFSP is a federally funded program, administered by the State of Califia Department of
Esucation (CDE).
2. According to the Alhambra Unifed School District statisti, more that 50% of the children who
reside within specific areas of the Cty of Alhambra, qualify fo free or reduced meals.
3. In Summer 2017, the Cy of Alhambra provided 20,863 lunches and snacks to children,
4. The proposed 2018 SFSP will begin cistibution of lunches and snacks on Monday June 4,
2016 and willbe provided Monday through Friday, through August 10, 2018,
5. The City wil be eligible for reimbursement for inches, snacks and operational costs by the

RECOMMENDATION:

final language approval by the City Manager and City Atlomey, in an amount not to
‘exceed $75,000 for the purchase of an NFC Fiiness Court at Alhambra Park; waive
‘adaitional formal bidding procedures; and authorize either the Mayor or City Manager to
‘execute the agreement; and,
2, Authorize staf to obtain proposals for the installation of the NF Fitness Court and the
installation of pour-in-place rubberized surfacing for the new Fitness Court at Alhambra
Park; and direct staff to undertake the stops necessary to finalize Counci's action.
BACKGROUND:
Community Services staff applied to be one of 100 cites in the U.S. that wil build an NEC
Fitness Court in 2018. The National Fitness Campaign is a social enterprise paving the way for
proactive health, NEC Fitness Courts are a pavrful way to encourage activity and promote
community wellness.
‘The NFC Fitness Court is an outdoor bodyweight cicul traning system buit in public spaces.
‘The equipment is for a 7 movement, 7 minute system that provides a ful-body workout to
people of all ablty levels," Inis Fitness. Court wil come at a tme in which the community
Fecenty completed a survey of park amenities, with finess options being the number one most
requested element o be installed at each park
12017, NFC partnered with Ft Rado to launch a sponsor-unded National Fitness Campaign
in 100 communities across the United States. In adeiton to the Fitness Court, the equipment
Comes with a mobile app that users can downloed and access free “coaching” on how to use
the equipment and other tips.‘The City has been selected as one of the 100 Cities that wil build a Fitness Coutt in 2018, the
City has also been avarded the $10,000 grant from Fit Radio to apply to the cost of the Fitness
Court. The Fitness Court costs $80,000, and the City was awarded the $10,000 Fit Radio grant,
‘and a $5,000 credit from the National Fitness Campaign towards the cost of installing pour-in~
place rubber surfacing, That leaves a balance of $75,000 for the purchase ofthe Fiiness Court
plus the cost of installation and pour-in-piace rubber surfacing

City of Alhambra to enter into a joint powers authority to become a member of the Clean
Power Alliance (CPA), formerly the Los Angeles Community Choice Energy or LACCE,
‘which is a Community Choice Energy program for the counties of Los Angeles and Ventura,
2, Within the CPA structure, each member cty and county has the authority to set the default
renewable energy tier inlo which their residents and businesses wil automaticaly be
tenrolled. Each CPA member will elect one of three renewable energy ters as the default

ity of Inglewood, The contract with the City of Inglewood will expire on June 30, 2018,
2. The current contract with the Cty of Inglewood allows for one two-year extension.
8. The average monthly cost for processing parking citations is $7,000. The extension wl
be put into place by July 1,2018 and will run concurrent withthe City's fiscal year until
June 30, 2020.

breakfast, lunch, water, snacks and otter logistics and supplies needed for the

CONSIDERATION OF AN URGENCY ORDINANCE TO AMEND CHAPTER 9.101 OF
‘THE ALHAMBRA MUNICIPAL CODE RELATING TO SEX OFFENDER RESIDENCY
RESTRICTIONS - 26-39, O2m18-4730
City Attorney MONTES reported that on November 7, 2006 the voters of the State of
Calfornia approved Propastion 83, the Sexual Predator Punishment and Contral Act,
‘commonly referred to as "Jessica's Law,” which specifically prohibts sex offenders from
residing within certain distances of parks and schools and authorized municioal
jurisdictions to enact local ordinances that further restrict the residency of any
Fagistered sex offender. Thereafler, the City of Alhambra adopted an ordinance that
prohibits any registered sex offender from residing within a certain distance of parks,
Schools and chid care facies. The City’s ordinance also restcted sex offenders from
living with each other in the same residence, or unit of a multi-unit building. Subsequent
to the adoption of that ordinance, several cases challenged Jessica's law throughout the
State, In Decamber of 2010, Los Angeles Superior Cour Judge Peter Espinoza issued
{an order staying the distance restriction provisions of Jessica's law with respect to al
individuals within Los Angeles County. Notwithstanding the court order, on December 4,
2017 the City was served with a civil action by John Doe, challenging the distance
restrictions for sex offenders in the Ciy’s ordinance based on in re Taylor and People v.
Lynch which held that residency restrictions can only be lawfully applied to sex offenders
\whie they are on parole, and thatthe distance restrictions in Jessica's law unreasonably
prohibit housing for sex offenders.
Continuing, he noted that separate and apart fforn the distance restrictions, the Cy
Temains concerned about the poterilal for mutple registered sex offenders to reside in
Cisters in the City’s neighborhoods. The proposed amendments to Chapter 9.101 inthe
lugency ordinance are intended to eliminate the unenforceable distance restrictions
fouind in Jessica's law, while preserving the residency concentration limits that remain a
cconeatn forthe City, This orcinance is required as an urgency ordinance based upon the
pending igation, as well asthe health, safety and welfare interests of the residents to
Fetain the ability to enforce the concentration restrictions in the current municipal code, to
preserve the character of the Citys neighborhoods,

ordinance to change the land use designation for the 48,770 square foot (1.12 acres)
area of land designated Valley Boulevard Corridor Specific Plan zone from Retail
‘Commercial (C) (Specific Plan-RC(C)) to Office Professional (8) (Specific Plan- OP(8))
for the property located at 1428 South Marengo Avenue, in the City of Alhambra, The
Camelia Court mixed-use project was spproved by the City Council on September
11, 2017, Since obtaining Counel approval forthe projec, the applicant has determined
that office use wil be a better use for the subject site and consistent withthe proposed
2-story 18,000 square-foot medical office bulging that vl be located just to the east of
the site on a separate parcel that is also part of the Camellia Court project. The current
land use designation allows tis site to be used for rela and commercial uses but does
hot allow for office uses, Under the proposed Office Professional (B) land use
designation, office uses will be allowed but retall wil not be allowed. The proposed
change of land use designation will result in @ use of the ste that is less intense than

the Police Department. He also announced that March 3, 2018 would be the 65° anniversary of
the Alhambra American Lite League and that i would be a great event

Neviletie which provided the Councl with weekly updates on the work being performed by City

announced the City’ annual Lunar New Year celebration would take place on Februaty 24, 2018
along Valley Boulevard between Almansor Streel and Vega Street from 10:00 am. to 5:00 p.m,
